OnJuly31,1996,JoyceCarterparkedherautomobile,a1993BuickCentury,intheparkinglotatherplaceofemployment.Atabout3:00p.m.,RodneyJenkins,afellowemployee,whowasleavingwork,watchedastwomenlefttheparkinglotinCartersvehicle.JenkinsrecognizedtheautomobileasbelongingtoJoyceCarter,andheknewCartershusband.TheBuickpassedwithineightfeetofJenkins,andhepaidparticularattentionbecauseherealizedthatthedriverwasnotCartershusband.Hedescribedthedriverasablackmaleweighingabout165to185poundswithalightbrowncomplexionandwearingadarkcoloredTshirtandawhitehat.Thenextdaythepolicerecoveredtheautomobile.Althoughithadbeen burnttoacrisp,thepolicewereabletoidentifyitthroughitsVINnumber,andCarterrecognizedsomeofherbelongingswhichhadnotbeencompletelydestroyed. Approximatelyonemonthlater,onAugust30,1996,someofCarterscoworkersnotedthattwostrangemenwerewalkingaroundintheparkinglotandpointingtovariouscars.Jenkinswenttotheparkinglottoobservethemen,andherecognizedoneofthemasthemanwhodroveCartersautomobileoutoftheparkinglot.Whenthe 728 policearrived,JenkinspositivelyidentifiedthedefendantasthepersonwhohadpreviouslyremovedCartersautomobilefromthelot.  #  2      ׀   Thegrandjuryreturnedatwocountindictment.Inthefirstcount,theindictmentchargedthatonJuly31,1996,thedefendant didunlawfullyandknowinglyobtainproperty,towit:amotorvehicle...withouttheeffectiveconsentofJoyceCarterwithintenttodeprivetheownerthereof....Thesecondcountchargedthedefendantwithunlawfullyandknowinglyexercisingcontroloverthesamevehicle.Thejuryfoundthedefendantguiltyonbothcountsoftheindictment. Firstweconsiderwhethertheevidencepresentedattrialissufficienttoprovebeyondareasonabledoubtthatthedefendantisthepersonwhocommittedtheoffensechargedintheindictment. InTennessee,appellatecourtsgivegreatweighttotheresultreachedbyajuryinacriminaltrial.Ajurysverdictapprovedbythetrialjudgeaccreditsthestateswitnessesandresolvesallconflictsinfavorofthestate.Statev.Williams,657S.W.2d !  405,410(Tenn.1983).Onappeal,thestateisentitledtothestrongestlegitimateviewoftheevidenceandallreasonableinferenceswhichmaybedrawntherefrom.Statev. b% $ Cabbage,571S.W.2d832,835(Tenn.1978).CLeCC CLeBecauseaverdictofguiltyremovesthe 3'"& presumptionofinnocenceandreplacesitwithapresumptionofguilt,theaccusedhastheburdeninthiscourtofdemonstratingwhytheevidenceisinsufficient,asamatteroflaw,tosupporttheverdict.Statev.Tuggle,639S.W.2d913,914(Tenn.1982).# CLeCCCLeo#CLeCC CLeOur ,', standardofreviewwhenthesufficiencyoftheevidenceisquestionedonappealis"whether,afterviewingtheevidenceinthelightmostfavorabletotheprosecution,anyrationaltrieroffactcouldhavefoundtheessentialelementsofthecrimebeyondareasonabledoubt."Jacksonv.Virginia,443U.S.307,319,99S.Ct.2781,2789(1979).# CLeCCCLe# 3:/4  5 16  Theidentityoftheaccusedasthepersonwhocommittedtheoffenseforwhichheisontrialisaquestionoffactforthejury.Statev.Williams,623S.W.2d188,  М120(Tenn.Crim.App.1981);Byrgev.State,575S.W.2d292,295(Tenn.Crim.App. R 1978).TherecordbeforeusindicatesthatRodneyJenkinsstoodwithineightfeetofthedefendantduringdaylighthours.Hetestifiedthathepaidparticularattentiontothedriverofthevehiclewhenherealizedthatthemanwasnottheownershusband.HewasabletodescribethedriverasablackmalewithalightbrowncomplexionwhowaswearingadarkTshirtandawhitehatwithsomewritingonit.Amonthlater,Jenkinsagainsawthedefendantinthesameparkinglot.HewaswearingthesamehatandJenkinsrecognizedhimatonce.ThearrestingofficertestifiedthatJenkinsidentifiedthedefendantwithouthesitation.Jenkinsalsopositivelyidentifiedthedefendantattrial.Questionsofcredibilityareforthejury,andthejurybelievedJenkinstestimony.WefindthattheevidenceissufficientforarationaltrieroffacttoconcludebeyondareasonabledoubtthatthedefendantwasthemanwhodrovethestolenBuickfromtheparkinglot.SeeStatev.Williams,623S.W.2d118,120(Tenn.Crim.App.1981) n (victimstestimony,byitself,issufficienttosupportaconviction);Statev.Livingston, ? 607S.W.2d489,491(Tenn.Crim.App.1980)(eyewitnessidentificationsufficienttosupportconviction). Inhissecondissue,thedefendantcontendsthathistwoconvictionsfortheftviolatedoublejeopardyprinciples.Thestateagreesthatonlyoneconvictionmaystand. ThegrandjuryindictedthedefendantbothforunlawfullyandknowinglyobtainingamotorvehiclebelongingtoJoyceCarterandforunlawfullyandknowinglyexercisingcontroloverthatsamemotorvehicle.Thejuryfoundthedefendantguiltyonbothcounts.Atthehearingonthedefendantsmotionfornewtrial,thetrialcourtandbothcounselagreedthatoneoftheconvictionshadtobedismissed.Thetrialcourt,however,wasreluctanttodismisseitherchargebecausehewasuncertainwhichcountshouldberetainedandwhichshouldbedismissed.Therecordbeforeuscontainsonly 84: onejudgment.Accordingtothisjudgment,thedefendantwasconvictedoncountoneoftheftofpropertyvaluedatmorethan$1000inviolationofTennesseeCodeAnnotatedsection3914103. Weagreethatthesecondcountshouldbedismissed.Theevidenceintherecordissufficienttoprovebeyondareasonabledoubtthatthedefendant unlawfullyandunknowinglyobtainedamotorvehicleworthmorethana$1000butlessthan$10,000withouttheconsentofJoyceCarter,theowner,andthatheactedwiththeintenttodeprivetheownerofherautomobile.
