P   ` Wefirstexaminethelengthofthesentencesimposed.Attheoriginalsentencinghearing,thetrialcourtimposedmidrangesentencesforeachcount.ThisCourtexpresslyapprovedthelengthofthosesentences,anddefendantassignsnoerrorinthisregard.Thus,thetwentyyearandtenyearsentencesforfourcountsofaggravatedrapeandsixcountsofaggravatedsexualbattery,respectively,areappropriate.@+ III.  `  ` Wenextexaminethetrialcourtsimpositionofconsecutivesentences.DefendantqualifiesforconsecutivesentencingunderTenn.CodeAnn.4035115(b)(5)since [t]hedefendantisconvictedoftwo(2)ormorestatutoryoffensesinvolvingsexualabuseofaminorwithconsiderationoftheaggravatingcircumstancesarisingfromtherelationshipbetweenthedefendantandvictim...thetimespanofdefendantsundetectedsexualactivity,thenatureandscopeofthesexualactsandtheextentoftheresidual,physicalandmentaldamagetotheϜvictim.....𛀀Initsremandorder,thisCourtacknowledgedtheapplicabilityof4035115(b)(5). ` Thus,theremainingquestioniswhetherconsecutivesentencescomportwiththerequirementsthatthesentence(1)reasonablyrelatetotheseverityoftheoffensescommitted;(2)servestoprotectthepublicfromfurthercriminalconductbytheoffender;and(3)iscongruentwiththegeneralprinciplesofsentencing.Statev.Wilkerson,905S.W.2dat939. 0948 Ї@, A.    ` Insupportofitsdecisiontoimposeaneffectivesentenceoffiftyyears,thetrialcourtwrites, withoutanyquestion,thesentenceannouncedhereinisconsistentwiththeseverityofthenumeroussexualactsperpetratedonthisinnocentandvulnerablevictimoveranextendedperiodoftime.Thetrialcourtthusaddressedtherequirementthatthesentencebereasonablyrelatedtotheseverityoftheoffense.Wewillnotdisturbthisfinding.@, B.    ` Thedefendantassertstherewasnoexperttestimonyattheresentencinghearingtoindicatethatdefendantposesathreattothecommunityorislikelytoreoffend.Thetrialcourtexplicitlyrejectedthisclaimandfoundthatthedefendantis P atrisktoreoffendinthefutureand,assuch,posesathreattothecommunity. ` Thedefensecalledtwoexpertwitnesses:Dr.HaroldJordan,apsychiatricexpert,andMs.DeloresButler,anexpertinthetreatmentofsexualoffenders.Dr.JordansandMs.Butlerstestimonywaspresentedtoestablishthatdefendantposesnodangertothecommunityuponrelease.However,thetestimonyofbothwastemperedbytheadmonitionthatsuchreleasewouldrequirestrictconditionsincludingcounselingandnocontactwiththevictim.Ms.Butlerindicatedthatthedefendantwouldbemostlikelyto losecontrolinafamilysituationandadmittedthatdefendantwouldrequirecontinuoustreatmentinordertoavoidarelapse. ` Thetrialcourtalsohadbeforeitamentalhealthevaluationperformedpriortotheoriginalsentencinghearing.Thatevaluationstatedthatdefendantwasatrisktoreoffend. ` Therewassufficientevidencebeforethetrialcourttosupportitsfindingthatthepublicneedsprotectionfromfurthercriminalconductbythedefendant.Wewillnotsubstituteourjudgmentforthatofthetrialcourt. 0948 @xx( CONCLUSION    ` Thetrialcourtfoundthatthecircumstancesofthiscasewarrantaneffectivefiftyyearsentenceandthatthesentenceservestoprotectthepublicandthevictimfromanyfurtherseriouscriminalconductbythedefendant.ItsfindingsandconclusionscomportwiththeprinciplesofWilkerson.Ifourreviewreflectsthatthe `  trialcourtfollowedthestatutorysentencingprocedure,imposedalawfulsentenceaftergivingdueconsiderationandproperweighttothefactorsandprinciplessetoutunderoursentencinglaw,andthetrialcourtsfindingsoffactareadequatelysupportedbytherecord,thenwemaynotmodifythesentenceevenifwewouldhavepreferredadifferentresult.Statev.Fletcher,805S.W.2d785,789(Tenn. p МCrim.App.1991).̛̜ ` Therefore,weAFFIRMthetrialcourtsimpositionofaneffectivefiftyyearsentence. `     h      p ____________________________ `     h      p JOEG.RILEY,JUDGE  % # ̜ CONCUR: `'"% ̜ ____________________________  ,`'* PAULG.SUMMERS,JUDGE̛̜ ̜____________________________  2-1 JOSEPHM.TIPTON,JUDGE
