ÐÌà  àParks€testified€that€during€the€robbery,€the€employees€remained€on€the€floor.€€Ô#†¼Ø9»XX—wv#ÔÔ‡X—wX»¼Ø9ÔAccording€toÐ ‹$Û# ÐParks,€ð ðAnthony€York€was€incredibly€calm;€he€didnððt€say€a€word,€make€any€noise€at€all.€€AmandaÐ t%Ä $ Ð[Murray]€and€Ashley€[Hodges]€were€just€hysterical,€I€mean,€very€hysterical€.€.€.€[and]€[c]rying.ðð€Ð ]&­!% ÐParks€stated€that€Ô#†¼Ø9»XX—wç/#ÔÔ‡X—wX»¼Ø9Ôalthough€she€attempted€to€remain€calm,€she€was€frightened€and€worried€she€wouldÐ F'–"& Ðnever€again€see€her€daughters.Ô#†¼Ø9»XX—wO1#ÔÔ‡X—wX»¼Ø9Ô€Ô#†¼Ø9»XX—w2#ÔÔ‡X—wX»¼Ø9ÔÐ /(#' ÐÌà  àAnthony€York€testified€at€trial€that€he€was€working€at€Fazoliððs€on€October€18,€1999,€whenÐ *Q%) Ðtwo€men€walked€into€the€restaurant.€€York€recognized€the€appellant,€a€former€high€school€classmate.€Ð ê*:&* ÐÔ#†¼Ø9»XX—wV2#ÔÔ‡X—wX»¼Ø9ÔYork€testified€that€as€he€and€the€other€employees€prepared€for€closing,€ð ð[t]he€other€gentleman€.€.€.Ð Ó+#'+ Ðcame€back€with€the€gun,€told€us€to€get€down,€and€then€he€got€[Parks]€up€and€took€her€to€the€cashÐ ° Ðregisters,€took€her€back€to€the€safe€to€get€all€the€money€and€they€left.€€The€[appellant]€.€.€.€stayed€upÐ ™é Ðfront.ðð€€York€stated€that€he€feared€Arnold€who€walked€around€pointing€his€gun€at€the€employees.€Ð ‚Ò ÐAlthough€York€was€not€as€afraid€of€the€appellant€whom€he€did€not€observe€with€a€weapon,€YorkÐ k» Ðbelieved€that€the€appellant€willingly€participated€in€the€robbery.Ð T¤ ÐÌà  àYork€testified€that€after€the€men€left,€he€and€the€other€employees€got€up€from€the€floor.€€HeÐ & v Ðrelated€that€by€the€time€he€walked€to€the€front€of€the€restaurant,€the€police€had€arrived.€€YorkÐ  _ Ðinformed€the€police€that€he€had€recognized€the€appellant.€€€Days€later,€the€police€returned€to€FazoliððsÐ ø H Ðto€obtain€a€statement€from€York€and€to€ask€York€to€view€a€photographic€lineup.€€York€provided€aÐ á 1  Ðstatement€and€identified€the€appellant€in€the€lineup.€€York€circled€the€appellantððs€photograph€andÐ Ê   Ðwrote€underneath€the€photograph,€ð ðI€had€a€class€at€Germantown€High€School€with€this€person.€€ThisÐ ³  Ðis€the€person€that€did€not€have€the€gun€Monday€night.ððÐ œì  ÐÌà  àKevin€Gonzalez€testified€that€on€October€18,€1999,€he€participated€in€the€robbery€of€Fazoliððs.€Ð n¾  ÐHe€related€that€he€had€been€employed€at€the€restaurant€several€months€prior€to€the€robbery,€but€hadÐ W§  Ðbeen€terminated.€€On€the€day€of€the€robbery,€Arnold€telephoned€Gonzalez€and€said€that€he€and€theÐ @ Ðappellant€planned€to€rob€Fazoliððs.€€Ô#†¼Ø9»XX—w¤3#ÔÔ‡X—wX»¼Ø9ÔArnold€asked€Gonzalez€to€ð ðwait€with€the€doors€open.ðð€€ShortlyÐ )y Ðafter€their€telephone€conversation,€Arnold,€the€appellant,€and€the€appellantððs€girlfriend€arrived€atÐ b ÐGonzalezððs€apartment.€€Arnold€and€the€appellant€informed€Gonzalez€of€their€plan,€stating€that€afterÐ ûK Ðthe€robbery€ð ð[t]hey€were€going€to€come€back€and€change€clothes€and€they€were€just€going€to€waitÐ ä4 Ða€little€bit€and€leave.ðð€€According€to€Gonzalez,€Arnold€had€the€ð ðmovie€prop€pistolðð€when€he€arrivedÐ Í Ðat€Gonzalezððs€apartment.€€Gonzalez€explained€that€when€he€and€Arnold€were€young,€a€friend€hadÐ ¶ Ðgiven€them€the€pistol.€€Gonzalez€testified€that€Arnold€and€the€appellant€asked€him€for€weapons.€€HeÐ Ÿï Ðgave€the€appellant€a€BB€gun€and€provided€a€duffle€bag€in€which€to€place€the€money€taken€from€theÐ ˆØ Ðrestaurant.€€Prior€to€leaving€the€apartment,€Arnold€and€the€appellant€placed€the€guns€in€the€bag.Ð qÁ ÐÌà  àGonzalez€testified€that€after€the€robbery,€Arnold€and€the€appellant€returned€to€his€apartment.€Ð C“ ÐThereafter,€Gonzalez,€Arnold,€the€appellant,€and€his€girlfriend€went€into€Gonzalezððs€bedroom€toÐ ,| Ðcount€the€money,€which€totaled€approximately€$1,000.€€Arnold€and€the€appellant€divided€the€moneyÐ e Ðand€gave€Gonzalez€between€$50€and€$60.€€Arnold€and€the€appellant€then€changed€clothes,€and€theÐ þN Ðgroup€went€to€ð ðplay[]€pool.ðð€€According€to€Gonzalez,€the€appellant€never€appeared€to€be€afraid€ofÐ ç 7 ÐArnold.Ð Ð!   ÐÌà  àÔ#†¼Ø9»XX—wU;#ÔÔ‡X—wX»¼Ø9ÔApproximately€five€days€later,€police€officers€questioned€Gonzalez€about€his€involvementÐ ¢#ò" Ðin€the€robbery.€€Gonzalez€testified€that€initially€he€was€uncooperative,€but€the€next€day€he€providedÐ ‹$Û# Ðthe€officers€with€a€statement,€informing€the€officers€of€each€of€their€roles€in€the€robbery.€€He€alsoÐ t%Ä $ Ðtold€the€officers€that€he€had€thrown€the€guns€into€a€dumpster€behind€his€apartment.€€The€officersÐ ]&­!% Ðlocated€the€weapons,€collecting€them€as€evidence.€€Additionally,€Gonzalez€gave€the€officers€theÐ F'–"& Ðmoney€that€remained€from€his€share€of€the€robbery€proceeds.€€Gonzalez€was€subsequentlyÐ /(#' Ðadjudicated€delinquent€in€the€juvenile€court€for€committing€facilitation€of€aggravated€robbery.Ð )h$( ÐÌà  àRebecca€Jackson€testified€at€trial€that€as€she€was€leaving€work€on€October€18,€1999,€sheÐ ê*:&* Ðheard€someone€say,€ð ð[G]et€on€the€fððing€floor.ðð€€Jackson€testified€that€she€hid€underneath€a€sink.€Ð Ó+#'+ ÐWhile€underneath€the€sink,€Jackson€heard€ð ðpeople€whimpering€and€carrying€on.ðð€€When€Arnold€andÐ ° ÐParks€went€to€the€cash€registers€at€the€front€counter,€Jackson€was€able€to€sneak€out€the€back€door.€Ð ™é ÐOnce€outside,€Jackson€observed€a€vehicle€approaching€the€drive„thru€lane.€€Hiding€in€nearby€bushes,Ð ‚Ò Ðshe€told€the€driver€that€the€restaurant€was€being€robbed€and€asked€him€to€call€police.€€The€driverÐ k» Ðcalled€the€police€on€his€cellular€telephone,€told€Jackson€to€remain€hidden,€and€then€proceeded€to€theÐ T¤ Ðdrive„thru€window.€€Shortly€thereafter,€Jackson€got€into€her€vehicle€and€drove€to€the€front€of€theÐ =  Ðrestaurant.€€The€perpetrators€had€already€fled.Ð & v ÐÌà  àJackson€testified€that€she€was€unable€to€see€if€the€perpetrators€had€weapons.€€However,€sheÐ ø H Ðoverheard€ð ðone€of€the€little€girlsðð€say,€ð ð[P]lease€donððt€shoot€me,€please€donððt€shoot€me.ðð€€JacksonÐ á 1  Ðrelated,€ð ðAt€that€point€in€time€my€life€could€have€been€taken,€but€now€that€I€look€back€on€it€.€.€.€myÐ Ê   Ðco„workers,€their€lives€were€more€in€danger€.€.€.€than€mine€was.ððÔ#†¼Ø9»XX—w;B#ÔÔ‡X—wX»¼Ø9ÔÐ ³  ÐÌà  àIn€its€case„in„chief,€the€State€called€Tyrell€Arnold€as€a€witness,€but€he€refused€to€testify.€€TheÐ …Õ  Ðtrial€court€then€permitted€the€State€to€introduce€Arnoldððs€testimony€from€the€first€trial.€€At€the€firstÐ n¾  Ðtrial,€Arnold€testified€that€one€afternoon€he€and€the€appellant€agreed€to€commit€a€robbery.€€TheyÐ W§  Ðchose€Fazoliððs€Restaurant€because€it€was€located€near€Gonzalezððs€apartment€complex.€€AccordingÐ @ Ðto€Arnold,€the€appellant€was€initially€hesitant,€but€ð ðafter€he€thought€about€it€for€a€little€bit€he€saidÐ )y Ðokay,€letððs€do€it.ðð€€Thereafter,€Arnold€and€the€appellant€drove€to€Gonzalezððs€apartment€where€theyÐ b Ðchanged€clothes€and€waited€until€thirty€minutes€before€the€restaurant€closed.€€Gonzalez€provided€theÐ ûK Ðappellant€with€a€BB€gun€which€was€placed€into€a€duffle€bag.Ð ä4 ÐÌà  àWhen€the€appellant€and€Arnold€arrived€at€the€restaurant,€no€customers€were€present,€and€theÐ ¶ Ðemployees€were€in€the€ð ðback€kitchenðð€preparing€to€close.€€Arnold€told€the€appellant€to€watch€theÐ Ÿï Ðdoors€while€he€went€into€the€kitchen.€€In€the€kitchen,€Arnold€pointed€the€prop€gun€at€the€employeesÐ ˆØ Ðand€ordered€them€to€get€on€the€floor.€€He€then€told€the€restaurant€manager€to€open€the€cash€registersÐ qÁ Ðand€the€safe.€€The€appellant€held€the€bag€containing€the€BB€gun€until€Ô#†¼Ø9»XX—w€K#ÔÔ‡X—wX»¼Ø9ÔArnold€asked€for€the€bag€inÐ Zª Ðwhich€to€put€the€money.€€After€placing€the€money€into€the€duffle€bag,€Arnold€and€the€appellant€ranÐ C“ Ðfrom€the€restaurant€to€Gonzalezððs€apartment.€€Once€inside€the€apartment,€they€divided€approximatelyÐ ,| Ð$1,400€taken€from€the€restaurant.€€Arnold€testified€that€the€appellantððs€role€in€the€robbery€was€toÐ e Ðwatch€the€doors€and€notify€Arnold€if€anyone€entered€the€restaurant.€€According€to€Arnold,€theÐ þN Ðappellant€agreed€to€ð ðplay€that€role.ðð€€On€cross„examination,€Arnold€conceded€that€during€the€robberyÐ ç 7 Ðhe€never€saw€the€appellant€holding€a€gun.Ð Ð!   ÐÌà  àIn€October€1999,€Lieutenant€Joseph€Scott€was€a€sergeant€with€the€Memphis€PoliceÐ ¢#ò" ÐDepartmentððs€Robbery€Division.€€After€the€instant€offenses€were€committed,€Lieutenant€Scott€wentÐ ‹$Û# Ðto€the€home€of€the€appellantððs€parents€to€recover€property€the€appellant€claimed€to€have€purchasedÐ t%Ä $ Ðwith€his€share€of€the€robbery€proceeds.€€When€Lieutenant€Scott€arrived€at€the€house,€the€appellantððsÐ ]&­!% Ðparents€consented€to€a€search€of€the€appellantððs€bedroom.€€In€the€bedroom,€Lieutenant€ScottÐ F'–"& Ðdiscovered€a€pair€of€new€tennis€shoes€and€a€box€which€had€contained€a€pair€of€boots.€€LieutenantÐ /(#' ÐScott€discovered€$253€in€a€pillowcase€in€the€appellantððs€closet.€€Lieutenant€Scott€testified€that€heÐ )h$( Ðalso€went€to€Gonzalezððs€apartment€and€spoke€with€Gonzalez€and€his€mother.€€Gonzalez€informedÐ *Q%) ÐLieutenant€Scott€that€the€guns€used€in€the€robbery€were€in€a€dumpster€behind€the€apartments.€Ð ê*:&* ÐGonzalez€also€gave€Lieutenant€Scott€the€duffle€bag€used€in€the€robbery.Ð Ó+#'+ Їà  àAt€trial,€the€appellant€testified€that€he€met€Arnold€after€moving€to€Memphis€when€he€wasÐ ° Ðthirteen€years€old.€€Initially,€the€appellant€believed€that€Arnold€was€ð ðlarger€than€life,ðð€and€he€wantedÐ ™é Ðto€emulate€Arnold.€€However,€months€prior€to€the€robbery,€the€appellant€learned€that€Arnold€hadÐ ‚Ò Ðcommitted€several€robberies€in€Arkansas€in€order€to€sustain€his€drug€addiction.Ð k» ÐÌà  àThe€appellant€testified€that€in€October€1999,€he€was€living€with€Arnold.€€On€the€day€of€theÐ =  Ðrobbery,€he€and€Arnold€visited€Gonzalez€at€his€apartment.€€The€appellant€testified€that€upon€arrivingÐ & v Ðat€the€apartment,€Gonzalez€informed€him€of€Arnoldððs€plan€to€commit€a€robbery.€€Gonzalez€explainedÐ  _ Ðthat€Arnold€needed€money€to€hire€an€attorney€to€represent€him€in€pending€criminal€cases.€Ð ø H ÐEventually,€the€appellant€agreed€to€participate€in€the€robbery.€€The€appellant€testified€that€ArnoldÐ á 1  Ðhad€chosen€to€rob€Fazoliððs€Restaurant€because€it€was€located€across€the€street€from€GonzalezððsÐ Ê   Ðapartment.Ð ³  ÐÌà  àExpressing€concern€about€the€robbery,€the€appellant€suggested€that€they€go€ð ðlook€aroundððÐ …Õ  Ðthe€restaurant.€€Arnold€agreed,€and€he€and€the€appellant€walked€across€the€street,€taking€the€duffleÐ n¾  Ðbag.€€When€they€arrived€at€the€restaurant,€the€appellant€informed€Arnold€that€he€recognized€two€ofÐ W§  Ðthe€employees€working€that€evening.€€After€placing€an€order€and€sitting€at€a€table,€Arnold€said,Ð @ Ðð ð[L]etððs€just€do€it€right€now.ðð€€The€appellant€told€Arnold€he€was€ð ðnutsðð€and€stood€to€leave.€€TheÐ )y Ðappellant€testified€that€as€he€turned€his€back,€he€heard€Arnold€tell€the€employees€to€ð ðget€on€theÐ b Ðground.ððÐ ûK ÐÌà  àThe€appellant€testified€that€when€he€realized€Arnold€was€robbing€the€restaurant,€he€ð ðfroze.ðð€Ð Í ÐHe€was€unable€to€speak€and€nodded€at€Arnold€in€an€attempt€to€tell€him€ð ðno.ðð€€The€appellant€claimedÐ ¶ Ðthat€in€hindsight,€he€wished€he€had€tackled€Arnold.€€After€Arnold€had€taken€the€money,€he€ran€pastÐ Ÿï Ðthe€appellant,€slapped€the€appellantððs€arm,€and€said,€ð ð[R]un.ðð€€The€appellant€and€Arnold€ran€toÐ ˆØ ÐGonzalezððs€apartment,€where,€according€to€the€appellant,€Arnold€and€Gonzalez€counted€the€moneyÐ qÁ Ðwhile€he€and€his€girlfriend€sat€in€the€living€room.€€The€appellant€testified€that€Arnold€placed€aÐ Zª Ðportion€of€the€money€into€a€pillowcase€and€shoved€the€pillowcase€at€him,€saying,€ð ð[Y]ou€keep€yourÐ C“ Ðf***ing€mouth€shut€or€youððll€be€sorry.ðð€€Thereafter,€the€appellant,€his€girlfriend,€Arnold,€andÐ ,| ÐGonzalez€went€to€play€pool.Ð e ÐÌà  àThe€appellant€claimed€that€he€never€solicited€Arnold€to€commit€the€robbery,€nor€did€heÐ ç 7 Ðprovide€aid€or€promote€the€robbery.€€The€appellant€testified€that€at€the€time€of€the€robbery€he€wasÐ Ð!   Ðfrightened€of€Arnold.Ô#†¼Ø9»XX—wÃQ#ÔÔ‡X—wX»¼Ø9Ô€The€appellant€denied€being€ð ða€lookoutðð€during€the€robbery.€€He€further€deniedÐ ¹" !
