TheappellantwasconvictedofAggravatedRapein1987andreceivedasentenceof40years.HisconvictionwasaffirmedbytheCourtoftheCriminalAppealsin1989.Theonlyissueraisedbytheappellantinhisdirectappealwasthatthesentencewasexcessive.SeeStatev.Jefferies,(Tenn.Crim.App.1989,LEXIS38). Theappellantlaterfiledapetitionforpostconvictionreliefclaiming̀ineffectivecounsel.Thetrialcourtdismissedthepetition,andthedismissalwasaffirmedbytheCourtofCriminalAppeals.SeeJefferiesv.State,(No.01C019502CC00044,Tenn.Crim.App.,filedJuly6,1995,atNashville). Inthepresentpetition,theappellantraisesseveralissues.Hecomplainsof(1)animpropersentence;(2)trialirregularities;(3)ineffectiveassistanceofcounsel;and(4)errorsintheindictmentX Asageneralrule,theremedyofhabeascorpusislimitedtocaseswherethejudgmentisvoidorthetermofimprisonmenthasexpired.Passarellav.State,891S.W.2d619,626(Tenn.Crim.App.1994).Theappellantdoesnotclaiminhispetitionthatthejudgmentisvoidorthatthetermofimprisonmenthasexpired.Therefore,thedismissalwasproper.Inaddition,thereareotherreasonswhythedismissalofthepetitionshouldbeaffirmed.  Thefirstissuepresentedforreviewisthattheappellantssentencewasimproperandexcessive.Theappellantcontendsthathisclassificationasamultipleoffenderwasincorrect.Thisissuewasdecidedadverselytotheappellantondirectappeal.Ahabeascorpusproceedingmaynotbeemployedtoraiseandrelitigateissuesdecidedanddisposedofinadirectappeal.Longv.State,510S.W.2d83,87(S.Ct.1974).Furthermore,thereisnoappellatereviewofasentenceinahabeascorpusproceeding.Lowev.State,(No.02C019309CR00198Tenn.Crim.App.,filedOctober19,1994,atJackson). Appellantssecondissueconcernstrialirregularities.Hecontends(1)heandthevictimwerecoachedattrialandactedunderduress;(2)ajurorshouldhavebeendisqualified;and(3)thetrialjudgewasguiltyofmisconduct.Apetitionforwritofhabeascorpusmaynotbeusedtorevieworcorrecterrorsoflaworfactcommittedbythetrialjudgeintheexerciseofitsjurisdiction,anditcannotbeusedasasubstituteforanappeal.Statev.Henderson,640S.W.2d56,57(Tenn.Crim.App.1982).Theseissuesshouldhavebeenraisedondirectappealandmaynotberaisedbyhabeascorpus. Inthethirdissue,hecontendsthathistrialcounselwasineffective.Specifically,appellantstatesthathiscounsel(1)failedtopresentavideotapeofthevictimrecantinghertestimonyand(2)heinstructedtheappellanttolieatperpetratormeetingsandadvisedhimtorepeatthisinformationwhileattrial.Aclaimofineffectivecounselmaynotbelitigatedinahabeascorpusproceeding.Passarella,891S.W.2d,at628.Inaddition,thisissuewasraisedbytheappellantinhispetitionforpostconvictionreliefandwasdecidedadverselytohim.Itmaynotberelitigatedagain.̀  Inthefinalissue,theappellantcomplainsoferrorsintheindictment.Hecontendshisnamewasmisspelledintheindictment,theindictmentwasinconsistentinthatrapewaslistedasthechargeononepageandaggravatedrapeontheother,andthattheindictmentdidnotallegeaculpablementalstate.Theindictmentisnotintherecord,and,therefore,wecannotdeterminewhethertheappellantsfactualassertionsarecorrect.However,eveniftheyare,thisissueiswithoutmerit.Themisspellingoftheappellantsnameoratypographicalerrorintheindictmentwillnotrendertheindictmentvoid.Furthermore,defensesorobjectionsbasedondefectsintheindictmentmustberaisedbymotionpriortotrial.Rule12(b)(2)TRCrP.ThecontentionthattheindictmentdidnotallegeaculpablementalstateisbaseduponthisCourtsdecisioninStatev.RogerDaleHill,(No.O1C019508CC00267(Tenn.Crim.App.),filedJune20,1996,atNashville).ThisdecisionwasreversedbytheSupremeCourtinStatev.Hill,954S.W.2d725(Tenn.1997).
