OnJune7,1989,theUnitedStatesDistrictCourtfortheWesternDistrictofTennesseegrantedPetitionerspetitionforhabeascorpusreliefastohis1984habitualcriminalconviction.Hislifesentenceasahabitualcriminalwasvacatedandhewasresentencedbythetrialcourttotwofifteen(15)yearsentencestobeservedconcurrentlyforthetwoarmedrobberyconvictions.ThiscourtaffirmedthetrialcourtsjudgmentonFebruary27,1991. OnMay1,1996,PetitionerfiledthispetitionforpostconvictionreliefwiththeShelbyCountytrialcourt.Thetrialcourtsubsequentlydismissedthepetitionbecauseitwasfiledoutsidethestatuteoflimitationsandfailedtostateaclaimuponwhichreliefcouldbegranted. Therecordsupportsthetrialcourtsfindingthatthepetitionistimebarred.InJuly1986,theTennesseeLegislatureenactedathreeyearstatuteoflimitationsonpostconvictionpetitions.Tenn.CodeAnn.4030102(repealed1995);seealsoPassarellav.State,891S.W.2d619,624(Tenn.Crim.App.),perm.toappealdenied,(Tenn.Nov.28,1994).PetitionersconvictionsandsentencewereeffectiveonJanuary21,1986whentheSupremeCourtdeniedhisapplicationforpermissiontoappeal.Thiswouldbethe finalactionofthehigheststateappellatecourt....Tenn.CodeAnn.4030102(repealed1995).Underthe1986statute,PetitionerhadthreeyearsfromJuly1,1986,tofileacognizableclaimforpostconvictionreliefofthe1984convictions.Tenn.CodeAnn.4030102(repealed1995).Therefore,inordertoprevail,PetitionermusthavefiledapetitionbyJuly1,1989totolltherunningofthestatute.Furthermore,evenifthisCourtsaffirmanceofPetitionersresentencingonFebruary27,1991isdeemedtobethefinalactionofthiscase,PetitionerwouldhavehadtofilehispetitionbyFebruary27,1994.PetitionerdidnotfilehispetitionforpostconvictionreliefuntilMay1,1996,wellpastthethreeyearstatuteoflimitationsundereitherview.Thus,thePetitionerisbarredfromseekingpostconvictionreliefforthe1984convictions. TheTennesseeSupremeCourtrecentlyrejectedPetitionersargumentthatthenewPostConvictionProcedureAct,effectiveMay10,1995,grantsanadditionaloneyearperiod,untilMay10,1996,tofileapostconvictionpetition.Carterv.State,__S.W.2d__,No.03S019612CR00117,MonroeCounty,(Tenn.,atKnoxville,Sept.8,1997);seealsoTenn.CodeAnn.4030201etseq.(Supp.1996).Inthatcase,oursupremecourtheldthatthenewact isnotintendedtoreviveclaimsthatwerebarredbythepreviousstatuteoflimitations.Weagreewiththeviewthatthestatutewasintendedtorestrictthetimeandopportunitytoseekpostconvictionrelief.Clearly,thispurposeisnotservedbyastatutoryconstructionthatallowsadditionaltimeandopportunityforpetitionerswhoseclaimsarealreadybarredbythepriorstatuteoflimitations.Carter,__S.W.2d__,No.03S019612CR00117,slipop.at7.Therefore, petitionersforwhomthestatuteoflimitationsexpiredpriortotheeffectivedateofthenewAct,i.e.,May10,1995,donothaveanadditionalyearinwhichtofilepetitionsforpostconvictionrelief.Id.at2. IfPetitionerhadanyclaimshewishedtopresentinapostconvictioncauseofaction,theyexpiredonJuly1,1989forthe1984convictions,orinthealternative,onFebruary27,1994.Aftereitherofthosedates,Petitionernolongerhadaclaimundereithertheoldorthenewact.Undertheauthoritycitedabove,the1995Actwillnotreviveaclaimwhichisalreadytimebarred. Evenifthepetitionwasnotbarredbythestatuteoflimitations,thesoleϛsubstantiveissuepresentedbyPetitionerwouldbewithoutmerit.Inthepresentpetition,Petitionerarguesthatthe reasonabledoubtjuryinstructiongivenbythetrialcourtviolatedhisconstitutionalrightsundertheFifth,Sixth,Eighth,andFourteenthAmendmentstotheUnitedStatesConstitution.OurcourtshaverepeatedlyheldthatthejuryinstructionchallengedbyPetitionerisavalidinstructiononreasonabledoubt.Nicholsv.State,877S.W.2d722,734(Tenn.1994);Statev.Sexton,917S.W.2d263,266(Tenn.Crim.App.1995);Pettyjohnv.State,885S.W.2d364,366(Tenn.Crim.App.1994);Statev.Hallock,875S.W.2d285,294(Tenn.Crim.App.1993).
