Ðtoward€the€front€door€when€the€shotgun€discharged,€the€shot€hitting€the€door.€€Some€fragmentsÐ <#Œ" Ðapparently€hit€Ms.€Frey€in€the€leg,׃ ×Ý ƒ#ÃÝòòÚ  Ú2Ú  ÚóóÝ  Ý×  ×€but€she€was€able€to€get€out€of€the€apartment€and€call€911.Ð "$r# ÐÌà  àThe€defendant€and€the€victim€were€again€alone.€€According€to€the€defendant,€he€freed€himselfÐ î%>!% Ðby€knocking€the€victim€down.€€The€defendant€pumped€the€shotgun,€chambering€a€shell,€because,Ð Ô&$"& Ðaccording€to€his€testimony,€he€felt€he€might€need€to€protect€himself.€€Holding€the€gun,€he€started€toÐ ° Ðwalk€out€the€front€door€when€the€victim€rushed€him€from€behind€and,€in€the€ensuing€struggle€for€theÐ –æ Ðgun,€a€second€shot€was€fired,€this€time€grazing€the€victimððs€leg€and€causing€him€to€fall€to€the€floor.€Ð |Ì ÐWhile€on€his€knees,€the€victim€grabbed€the€gun€barrel€with€both€hands€and€attempted€to€pull€the€gunÐ b² Ðfrom€the€defendant.€€The€victim€and€the€defendant€continued€to€struggle€for€the€gun€until€the€victim,Ð H˜ Ðin€the€parking€lot€of€the€building€where€the€victim€lived€when€all€three€shots€were€fired.€€She€had€justÐ öF Ðreturned€to€the€complex€in€the€company€of€her€young€nephew,€Lynn€Freyððs€son.€€Her€nephew€gotÐ Ü, Ðout€of€the€vehicle€first€and€immediately€started€up€the€stairs€to€the€victimððs€apartment,€looking€forÐ Â Ðhis€mother.€€After€she€heard€the€first€shot,€she€yelled€for€her€nephew€to€come€to€her,€and€they€gotÐ ¨ø Ðdoor€of€the€victimððs€apartment,€holding€a€shotgun.€€The€victim,€according€to€Ms.€Frey,€was€facingÐ tÄ Ðthe€defendant€and€holding€onto€the€barrel€end€of€the€shotgun€when€the€second€shot€was€fired.€€AfterÐ Zª Ðthis€shot,€the€victim€crumpled€and€twisted,€still€holding€the€gun,€until€he€was€lying€on€his€back€withÐ @ Ðthe€defendant€standing€over€his€head.€€She€described€the€scene€as€one€where€ð ðthe€barrel€of€the€gunÐ &v Ðwas€going€round€and€round€Mr.€Whitworthððs€chest€and€head.ðð€€The€third€shot€was€fired€and€theÐ  \ Ðvictim€went€limp.€€According€to€the€autopsy,€the€victim€sustained€a€superficial€wound€to€his€leftÐ òB Ðthigh€and€died€as€the€result€of€a€single€gunshot€wound€to€the€chest.€€Cocaine€was€detected€in€hisÐ Ø( Ðblood.Ð ¾ ÐÌÐ  Š Ú Ðà@òò&ìàò òòòANALYSISˆÐ ° Ðó óóóÌà@¤ ¤ ìàò òIssue€I.€€Sufficiency€of€the€Evidenceó ó€€€€ˆÐ |Ì ÐÌà  à€€The€defendant€contends€that€the€evidence€was€insufficient€to€convict€him€of€voluntaryÐ H˜ Ðafter€a€day€of€selling€cocaine.€He€drove€to€the€apartment€he€shared€with€his€girlfriend€and€their€twoÐ Ø( Ðchildren€to€retrieve€a€shotgun€that€was€kept€on€a€shelf€in€his€closet.€€He€then€returned€to€the€victimððsÐ ¾ Ðapartment€with€the€loaded€shotgun.€€The€evidence€showed€that€a€struggle€between€the€defendant€andÐ ¤ô Ðthe€victim€ensued.€€Furniture€was€broken€in€the€struggle€that,€at€one€point,€led€to€the€defendantððsÐ Š Ú Ðbeing€pinned€down€by€the€victim.€€The€defendant,€at€240€pounds€and€half€the€age€of€the€victim,€wasÐ p!À  Ðable€to€get€the€upper€hand€and€finally€stood€over€the€victim€as€he€lay€half€in€and€half€out€of€hisÐ V"¦! Ðdoorway.€€We€conclude€that€the€evidence€justified€the€juryððs€determination€that€the€defendantÐ ° Ðintentionally€responded€to€the€provocation€of€the€victim,€which€included€shoving€the€defendant€faceÐ –æ Ðdown€onto€the€sofa,€by€firing€a€shotgun€directly€into€the€victimððs€chest€at€close€range.€€The€evidenceÐ |Ì Ðwas,€therefore,€sufficient€to€convict€the€defendant€of€voluntary€manslaughter,€and€the€StateÐ b² Ðsufficiently€overcame€the€defendantððs€contention€that€the€killing€was€accidental.Ð H˜ ÐÌà@j j ìàò ðcrime€was€committed€under€circumstances€under€whichÐ D”  Ðthe€potential€for€bodily€injury€to€a€victim€was€great.ðð€€During€the€sentencing€hearing,€the€trial€courtÐ *z  Ðstated€that€factor€(16)€applied€because€of€the€potential€for€serious€bodily€injury€to€Lynn€Frey.€€TheÐ ` Ðdefendant€argues€that€the€injury€to€Ms.€Frey€occurred€as€a€result€of€the€first€shotððs€being€fired€andÐ öF Ðnot€as€a€result€of€the€third€and€fatal€shot;€therefore,€she€was€not€present€when€the€ð ðcrime€wasÐ Ü, Ðcommittedðð€because€she€had€left€the€apartment€and€was€removed€from€any€danger.€€The€State€argues,Ð Â Ðon€the€other€hand,€that€although€Ms.€Frey€was€not€present€when€the€fatal€shot€was€fired,€that€is€notÐ ¨ø Ðthe€requirement€of€the€enhancement€factor.€€According€to€the€Stateððs€argument,€factor€(16)€providesÐ ŽÞ Ðthat€the€crime€must€be€committed€òòunder€circumstancesóó€under€which€the€òòpotentialóó€for€bodily€injuryÐ tÄ Ðis€great.€€The€circumstances€of€this€offense,€according€to€the€State,€do€not€just€involve€the€fatal€shot;Ð Zª Ðthey€began€when€the€defendant€arrived€at€the€victimððs€apartment€with€a€loaded€shotgun.€€Ð @ ÐÌà  àFirst,€we€note€that€a€statutory€enhancement€factor€may€not€be€used€to€enhance€a€sentence€ifÐ  \ Ðit€is€an€essential€element€of€the€offense€as€charged.€€However,€enhancement€factor€(16)€deals€withÐ òB Ðpotential€for€injury€in€circumstances€where€persons€other€than€the€victim€of€the€convicted€offenseÐ Ø( Ðare€in€the€area€and€are€subject€to€possible€injury.€€òòSeeóó€òòState€v.€Simsóó,€909€S.W.2d€46,€50€(Tenn.€Crim.Ð ¾ ÐApp.€1995)€(holding€that€factor€(16)€ð ðmay€be€applied€in€situations€where€individuals€other€than€theÐ ¤ô Ðvictim€are€in€the€area€and€are€subject€to€injuryðð).€€Ð Š Ú ÐÌà  àWith€regard€to€the€application€of€enhancement€factor€(16),€the€defendantððs€argument€isÐ V"¦! Ðpersuasive.€€First,€we€note€there€is€no€proof€that€the€defendant€did€not,€as€he€claimed,€bring€theÐ <#Œ" Ðshotgun€to€the€apartment€to€sell€to€the€victim.€€Additionally,€as€to€how€the€victim€and€the€defendantÐ "$r# Ðbecame€entangled€as€they€were€when€first€seen€by€Lynn€Frey,€we€also€have€only€the€defendantððsÐ %X $ Ðversion.€€She€testified€that€the€defendant€was€on€the€sofa€where€the€victim€had€pinned€him,€theÐ î%>!% Ðshotgun€being€between€the€two€of€them€although€the€defendant€said€that€it€was€pinned€beneath€him.€Ð Ô&$"& ÐThus,€it€was€not€obvious€to€her€who€was€the€aggressor€or€who€had€control€of€the€weapon.€€This€wasÐ º' #' Ðthe€position€of€the€parties€when€the€shotgun€discharged,€wounding€Frey.€€We€cannot€say€that€anÐ  (ð#( Ðoffense€was€being€committed€by€the€defendant€at€that€time.€€In€fact,€the€State€theorizes€in€its€briefÐ †)Ö$) Ðthat€the€jury€did€not€believe€that€the€defendant€came€to€the€apartment€to€kill€the€victim€but€wasÐ l*¼%* Ðadequately€provoked€into€doing€so.€€Additionally,€although€the€proof€showed€that€the€defendantÐ R+¢&+ Ðpumped€the€shotgun€after€the€first€and€second€shots,€each€time€causing€a€round€to€be€chambered,Ð 8,ˆ', Ðthere€is€no€proof€that€a€shell€was€not€already€in€the€chamber€when€he€arrived€at€the€apartment.€€Thus,Ð ° Ðthere€is€no€proof€that€the€defendant€chambered€the€round€which€wounded€Lynn€Frey.€€Although€theÐ –æ ÐState€argues€that€the€firing€of€the€first€shot€was€ð ðpart€of€the€circumstances€of€the€offense,ðð€we€do€notÐ |Ì Ðfind€this€reasoning€persuasive.€€For€instance,€if€the€altercation€had€ended€after€the€first€shot€whichÐ b² Ðwounded€Ms.€Frey,€it€is€difficult€to€predict€what€criminal€charges€would€have€resulted€or€againstÐ H˜ Ðwhom.€€Also,€we€note€that€it€was€the€third€shot€which€resulted€in€the€death€of€the€victim,€not€the€first,Ð . ~ Ðwhich€wounded€Ms.€Frey,€or€even€the€second.€€Accordingly,€we€conclude€that€factor€(16)€could€notÐ  d Ðbe€applied€to€the€wounding€of€Ms.€Frey.€€Although€the€trial€court€did€not€consider€whether€thereÐ ú J Ðcould€have€been€danger€to€other€victims,€so€as€to€apply€factor€(16),€we€will€consider€whether€thisÐ à 0 Ðfactor€could€be€applied€because€of€the€children€in€the€area.Ð Æ   ÐÌà  àThere€was€proof€that€the€victimððs€four„year„old€child€was€sleeping€in€a€nearby€bedroom€inÐ ’â  Ðthe€victimððs€apartment€at€the€time€of€the€altercation.€€There€was€also€proof€that€Lynn€Freyððs€youngÐ xÈ  Ðson€was€on€the€stairs€headed€for€the€victimððs€apartment€just€before€the€shotgun€was€fired€the€firstÐ ^®  Ðtime;€that€Bronzetta€Frey€yelled€for€her€nephew€to€run€to€her€so€they€both€might€take€cover;€and€thatÐ D”  Ðanother€young€boy€was€just€outside€the€victimððs€door€at€the€beginning€of€the€encounter.€€We€applyÐ *z  Ðthe€same€reasoning€and€conclude€that€these€two€children€cannot€be€considered€as€factor€(16)Ð ` Ðð ðvictimsðð€because€at€the€time€of€the€first€shot,€the€only€one€which€might€have€threatened€them,€theÐ öF Ðproof€does€not€show€that€the€defendant€was€committing€a€crime.€€Additionally,€we€note€that€the€areaÐ Ü, Ðwas€a€housing€complex€where€individuals€tended€to€congregate€at€all€hours.€€However,€there€was€noÐ Â Ðshowing€that€others€were€endangered.€€Accordingly,€factor€(16)€cannot€be€applied.Ð ¨ø ÐÌà@BBìàò òB.€€Mitigating€FactorsˆÐ tÄ ÐÌà  àó óThe€trial€court€applied€only€one€statutory€mitigating€factor€requested€by€the€defendant:€ð ðTheÐ @ Ðdefendant,€although€guilty€of€the€crime,€committed€the€offense€under€such€unusual€circumstancesÐ &v Ðthat€it€is€unlikely€that€a€sustained€intent€to€violate€the€law€motivated€the€criminal€conduct[.]ðð€€Tenn.Ð  \ ÐCode€Ann.€ðð€40„35„113(11).€€The€trial€court€found€an€ð ðunusual€scenarioðð€on€the€particular€eveningÐ òB Ðof€the€offense€and€concluded€that€it€was€unlikely€that€a€sustained€intent€to€violate€the€law€motivatedÐ Ø( Ðthe€defendantððs€conduct.€€Nevertheless,€the€trial€court€found€that€mitigating€factor€(11),€althoughÐ ¾ Ðpresent,€should€not€be€given€much€weight.Ð ¤ô ÐÌà  àThe€trial€court€declined€to€apply€a€second€mitigating€factor€requested€by€the€defendant:€€ð ðTheÐ p!À  Ðdefendant€acted€under€strong€provocation[.]ðð€òòIdóó.€ðð€40„35„113(2).€€The€defendant€argues€that€€the€juryÐ V"¦!
