Zª ÐÌÔ#bdcdÔà  àNo€testimony€was€presented€at€the€sentencing€hearing.€€The€record€indicated€that€the€defendantÐ &v ÐÔ#ddbdÔhad€prior€felony€convictions€for€aggravated€assault,€attempted€robbery,€possession€of€marijuana€withÐ  \ Ðintent€to€sell,€possession€of€cocaine€with€intent€to€sell,€and€reckless€endangerment€with€a€deadlyÐ òB Ðweapon.€€Further,€the€defendant€had€over€fifteen€misdemeanor€convictions€and€had€previouslyÐ Ø( Ðviolated€probation.€€The€federal€Presentence€Investigation€Report,׃×Ý ƒ#ÃÝòòÚ  Ú2Ú  ÚóóÝ  Ý×  ×€which€is€a€part€of€the€record,Ð ¾ Ðindicates€he€was€adjudicated€as€a€juvenile€for€possession€of€cocaine€with€intent€to€deliver.€€TheÐ ¤ô Ðdefendant€submitted€a€psychological€evaluation€report€indicating€he€was€mildly€mentally€retarded,Ð Š Ú Ðsuffered€from€depression,€and€had€significant€problems€with€substance€abuse.Ð p!À  ÐÌà  àThe€trial€court€applied€the€following€enhancement€factors€to€both€sentences:€enhancementÐ <#Œ" Ðfactor€(1),€the€defendant€has€a€previous€history€of€criminal€convictions€or€criminal€behavior€inÐ "$r# Ðaddition€to€those€necessary€to€establish€the€appropriate€range;€enhancement€factor€(8),€the€defendantÐ %X $ Ðhas€a€previous€history€of€unwillingness€to€comply€with€conditions€of€a€sentence€involving€releaseÐ î%>!% Ðin€the€community;€and€enhancement€factor€(20),€the€defendant€was€adjudicated€to€have€committedÐ Ô&$"& Ðâ âa€delinquent€act€or€acts€as€a€juvenile€that€would€constitute€a€felony€if€committed€by€an€adult.€€òòSeeóóÐ º' #' ÐÔ#cdddÔTenn.€Code€Ann.€ðð€40„35„114òòóó(1),€(8),€(20)€(1997).׃×Ý ƒ#ÃÝòòÚ  Ú3Ú  ÚóóÝ  Ý×  ×€€It€applied€enhancement€factor€(10),€the€defendantÐ ° Ðâ âÔ#ddcdÔhad€no€hesitation€about€committing€a€crime€when€the€risk€to€human€life€was€high;׃K×Ý ƒ#ÃÝòòÚ  Ú4Ú  ÚóóÝ  Ý×  ×€and€enhancementÐ –æ Ðfactor€(11),€the€felony€resulted€in€bodily€injury€and€the€defendant€has€previously€been€convicted€ofÐ |Ì Ða€felony€that€resulted€in€death€or€bodily€injury,׃•×Ý ƒ#ÃÝòòÚ  Ú5Ú  ÚóóÝ  Ý×  ×€to€the€especially€aggravated€robbery€sentence.€òò€SeeÐ b² Ðid.€óóðð€40„35„114(10),€(11).€€Although€the€defendant€contends€the€trial€court€applied€these€two€factorsÐ H˜ Ðto€the€theft€conviction€also,€the€trial€courtððs€findings€do€not€indicate€this€was€the€courtððs€intent.€€ItÐ . ~ Ðapplied€enhancement€factor€(9),€the€defendant€possessed€a€firearm€during€the€commission€of€theÐ  d Ðoffense,€to€the€sentence€for€theft€over€$10,000.€€òòSee€id.€óóðð€40„35„114(9).€€Further,€it€found€that€theÐ ú J Ðdefendantððs€mild€mental€retardation€had€limited€application€as€a€mitigating€factor.€€òòSee€id.€óóðð€40„35„Ð à 0 Ð113(8).òòóóÐ Æ   ÐÌà  àThe€defendant€argues€the€trial€court€erred€in€applying€enhancement€factor€(9)€to€the€theftÐ ’â  Ðsentence.€€He€also€maintains€the€trial€court€erred€in€not€applying€mitigating€factors€and€in€imposingÐ xÈ  Ðconsecutive€sentencing.€€€òòóóòòóóÐ ^®  Ðò òÌC.€€Enhancement/Mitigating€FactorsÐ *z  Ðó óÌà  àThe€defendant€maintains€the€trial€court€misapplied€enhancement€factor€(9)€to€the€defendantððsÐ öF Ðtheft€sentence.€€The€statute€merely€requires€that€ð ðthe€defendant€possessedðð€a€firearm€duringÐ Ü, Ðcommission€of€the€offense.€€òòId.óó€ðð€40„35„114(9).€€We€conclude€the€proof€in€the€record€supports€theÐ Â Ðapplication€of€this€factor€because€the€defendant€was€carrying€a€loaded€weapon€at€the€time€he€wasÐ ¨ø Ðexercising€control€over€the€stolen€truck.Ð ŽÞ ÐÌà  àThe€defendant€also€argues€that€the€trial€court€erred€in€not€applying€mitigating€factor€(3),Ð Zª Ðsubstantial€grounds€exist€tending€to€excuse€or€justify€the€defendantððs€criminal€conduct;€mitigatingÐ @ Ðfactor€(8),€the€defendant€was€suffering€from€a€mental€condition€that€significantly€reduced€hisÐ &v Ðculpability€for€the€offense;€and€mitigating€factor€(12),€the€defendant€acted€under€the€duress€or€underÐ  \ Ðthe€domination€of€another€person.€€òòSee€id.€óóðð€40„35„113(3),€(8),€(12).€òòóó€The€trial€court€did€applyÐ òB Ðmitigating€factor€(8)€based€on€proof€the€defendant€suffered€from€mild€mental€retardation.€€However,Ð Ø( Ðthe€trial€court€gave€this€factor€little€weight.€€The€defendant€claims€the€other€mitigating€factors€applyÐ ¾ Ðbecause€the€defendant€told€police€he€committed€the€robbery€at€the€request€of€other€people.€€TheÐ ¤ô Ðrecord€supports€the€trial€courtððs€determination€the€defendantððs€mental€deficiencies€are€the€onlyÐ Š Ú Ðapplicable€mitigating€proof.€€Further,€the€trial€court€did€not€err€in€giving€it€little€weight€nor€in€failingÐ p!À  Ðto€reduce€the€sentences€because€of€this€slight€mitigator.Ð V"¦!
