Inhishabeascorpuspetition,thePetitionerallegesthattheindictmentfailedtospecifythemensreafortheoffenseofaggravatedrapeandthus,hisconvictionwasvoid.Wenotethattherecorddoesnotcontainacopyofthejudgmentform,whichpreventsusfromadequatelyreviewinghisclaimforrelief.However,hehasstatedinhispetitionthathewasconvictedofaggravatedrapeandsentencedonApril6,1994,totwentyyearsincarceration.ThePetitionerfiledapetitionforawritofhabeascorpusonSeptember10,1996.TheStatesubmittedamotiontodismissthepetitiononSeptember18,1996.ThePetitionerrequestedawritofmandamusfromthisCourttocompeltheCircuitCourtofBledsoeCountytoissueitsdecisiononthepetition,whichapanelofthisCourtdeniedinanorderdatedDecember6,1996.ThetrialcourtenteredanorderonDecember17,1996,denyingthepetition.ThePetitionernowappeals. Anindictmentorpresentmentmustprovidenoticeoftheoffensecharged,anadequatebasisfortheentryofaproperjudgment,andsuitableprotectionagainstdoublejeopardy.Statev.Trusty,919S.W.2d305,310(Tenn.1996);Statev.Byrd,820S.W.2d739,741(Tenn.1991);Statev.Lindsay,637S.W.2d886,890(Tenn.Crim.App.1982).Theindictment muststatethefactsinordinaryandconciselanguageinamannerthatwouldenableapersonofcommonunderstandingtoknowwhatisintended,andwithadegreeofcertaintywhichwouldenablethecourtuponconviction,topronouncetheproperjudgment.Wardenv.State,381S.W.2d244,245(Tenn.1964);Tenn.CodeAnn.4013202. Alawfulaccusationisanessentialjurisdictionalelement,thus,aprosecutioncannotproceedwithoutanindictmentthatsufficientlyinformstheaccusedoftheessentialelementsoftheoffense.Statev.Perkinson,867S.W.2d1,5(Tenn.Crim.App.1992);Statev.Morgan,598S.W.2d796,797Tenn.Crim.App.1979).Ajudgmentbasedonanindictmentthatdoesnotallegealltheessentialelementsoftheoffenseisanullity.Wardenv.State,381S.W.2dat245;McCrackenv.State,489S.W.2d48,53(Tenn.Crim.App.1972).Furthermore,theTennesseeCodeprovidesthat"[i]fthedefinitionofanoffensewithinthistitledoesnotplainlydispensewithamentalelement,intent,knowledge,orrecklessnesssufficestoestablishtheculpablementalstate."Tenn.CodeAnn.3911301(c).̜ ThePetitionercitesarecentdecisionofapanelofthisCourtthatheldanindictmentinvalidwhichchargedtheoffenseofaggravatedrapeinlanguageϜsimilartothatinthecasesubjudice.SeeStatev.RogerDaleHill,C.C.A.No.01C019508CC00267,WayneCounty(Tenn.Crim.App.,Nashville,June20,Ϝ1996),revd,___S.W.2d___(Tenn.1997).Heassertsthattheindictmentonlyallegesthathe unlawfully,withforceorcoercion,didsexuallypenetratethevictim.Hearguesthattheindictmentfailstoassertareckless,knowingorintentionalmentalstateasrequiredbyTennesseeCodeAnnotatedsection3911301(c).Theindictmentreadsasfollows: `   ` X` XTheGRANDJURORSOFCOFFEECounty,Tennessee,dulyempaneledandsworn,upontheiroath,presentthatTIMOTHYWAYNEJOHNSONonthe___dayofAUGUST,1993,inCOFFEECOUNTY,Tennessee,andbeforethereturnofthisindictment,unlawfully,withforceorcoercion,didsexuallypenetrateMELANIEDICKINSON,inviolationofT.C.A.3913502,whilearmedwithaweaponoranarticleusedorfashionedinamannertoleadthesaidMELANIEDICKINSONreasonablytobelieveittobeaweapon,andagainstthepeaceanddignityoftheStateofTennessee.     ` X OursupremecourtrecentlyprovidedguidanceonthisissueinitsopinionreversingHill: 4   foroffenseswhichneitherexpresslyrequirenorplainlydispensewiththerequirementforaculpablementalstate,anindictmentwhichfailstoallegesuchmentalstatewillbesufficienttosupportprosecutionandconvictionforthatoffensesolongas `   (1)thelanguageoftheindictmentissufficienttomeettheconstitutionalrequirementsofnoticetotheaccusedofthechargeagainstwhichtheaccusedmustdefend,adequatebasisforentryofaproperjudgment,andprotectionfromdoublejeopardy;(2)theformoftheindictmentmeetstherequirementsofTenn.CodeAnn.4013202;and(3)thementalstatecanbelogicallyinferredfromtheconductalleged.    Hill,___S.W.2d___(Tenn.1997). Here,theindictmentclearlysatisfiestheconstitutionalnoticerequirements.TherewasadequatenoticethattheDefendantwaschargedwiththestatutoryoffenseofaggravatedrapeascodifiedinTennesseeCodeAnnotatedsectionϜ3913502(a)(1),whichcontainstheessentialelementsoftheoffense.Heretoo,Ϝissufficientinformationbywhichthetrialjudgecouldpronouncejudgmentfortheoffenseofaggravatedrape.Finally,theDefendantisadequatelyprotectedagainstasecondprosecutionforanoffenseofaggravatedrapeofthevictimoccurringduringAugust,1993. Regardingthesecondrequirement,itisalsoapparentthattheindictmentwasdraftedsuchthatapersonofordinaryintelligencecouldunderstandwithwhatoffensehewascharged.TheindictmentalsosufficientlystatedthefactualcircumstancesbyallegingtheidentityofthevictimandwhatspecificactofforciblesexualpenetrationtheDefendantwascalledtodefendagainst.Likewise,thethirdrequirement,thatthementalstatebelogicallyinferredfromtheindictment,hasbeensatisfied.Theallegationof forceor coercioncontemplatesamentalstate.AsdefinedintheCode, [f]orcemeanscompulsionbytheuseofphysicalpowerorviolenceandshallbebroadlyconstruedtoaccomplishthepurposesofthistitle.Tenn.CodeAnn.3911106(a)(12).Forceimpliesthatthepowerisdirectedtowardanendandwithouttheconsentofthevictim.Lundyv.State,521S.W.2d591,594(Tenn.Crim.App.1974).Likewise, coercion"means"threatofkidnaping,extortion,forceorviolencetobeperformedimmediatelyorinthefutureortheuseofparental,custodial,orofficialauthorityoverachildlessthanfifteen(15)yearsofage."Tenn.CodeAnn.3913501(1).Thus,theelementsofthechargedoffenseimplythattheDefendantpossessedthenecessaryawarenessofhisactionsthatwouldsatisfyproofofaculpablementalstateundersection3911301(c).Sexualpenetrationbyforceorcoercionnecessarilyimpliesthesexualpenetrationwouldoccurintentionallyorknowingly.Therefore,weconcludethattheindictmentinthiscaseadequatelyinformedtheDefendantofthechargesagainsthimanddoesnotsupporthisclaimforhabeascorpusrelief. Accordingly,weaffirmthejudgmentofthetrialcourtdismissingthepetition.
