Whenanaccusedchallengesthelength,range,orthemannerofserviceofasentence,thiscourthasadutytoconductadenovoreviewofthesentencewithapresumptionthatthedeterminationsmadebythetrialcourtarecorrect.Tenn.CodeAnn.4035401(d).Thispresumptionis"conditionedupontheaffirmativeshowingintherecordthatthetrialcourtconsideredthesentencingprinciplesandallrelevantfactsandcircumstances."Statev.Ashby,823S.W.2d166,169(Tenn.1991). Inconductingadenovoreviewofasentence,thiscourtmustconsider:(a)theevidence,ifany,receivedatthetrialandthesentencinghearing;(b)thepresentencereport;(c)theprinciplesofsentencingandargumentsastosentencingalternatives;(d)thenatureandcharacteristicsofthecriminalconductinvolved;(e)anystatutorymitigatingorenhancementfactors;(f)anystatementthatthedefendantmadeonhisownbehalf;and(g)thepotentialorlackofpotentialforrehabilitationortreatment.Tenn.CodeAnn.#X#Ԁ4035102,103,and210;seeStatev.Smith,735S.W.2d859,863(Tenn.Crim.App.1987). Ifourreviewreflectsthatthetrialcourtfollowedthestatutorysentencingprocedure,imposedalawfulsentenceafterhavinggivendueconsiderationandproperweighttothefactorsandprincipalssetoutunderthesentencinglaw,andthatthetrialcourt'sfindingsoffactareadequatelysupportedbytherecord,thenwemaynotmodifythesentenceevenifwewouldhavepreferredadifferentresult.Statev.Fletcher,805S.W.2d785,789(Tenn.Crim.App.1991).  VoluntarymanslaughterisaClassCfelonyandaRangeIsentenceisnotlessthanthree(3)yearsnormorethansix(6)years.Tenn.CodeAnn.3913211(b)and4035112(a)(3).ThepresumptivesentenceforaClassCfelonyistheminimumintherangeiftherearenoenhancementormitigatingfactors.Tenn.CodeAnn.4035210(c).Shouldthetrialcourtfindmitigatingandenhancementfactors,itmuststartattheminimumsentenceintherangeandenhancethesentencebaseduponanyapplicableenhancementfactors,thenreducethesentencebaseduponanyappropriatemitigatingfactors.Tenn.CodeAnn.4035210(e).Inapplyingafiveyearsentence,thetrialcourtinthiscaseusedthefollowingtwoenhancementfactors:(1)thevictimwastreatedwithexceptionalcruelty;and(2)Defendantusedadeadlyweapontocommittheoffense.SeeTenn.CodeAnn.4035114(5)and(9).Thetrialcourtalsofoundthefollowingtwomiscellaneousmitigatingfactorsapplicable:(1)nopriorfelonyconviction;and(2)arelativelygoodworkrecord.SeeTenn.CodeAnn.4035113(13). TheweightgiventoeachfactoriswithinthetrialcourtsdiscretionprovidedthattherecordsupportsitsfindingsanditcomplieswiththeSentencingAct.SeeStatev.Marshall,870S.W.2d532,541(Tenn.Crim.App.1993),perm.toappealdenied(Tenn.1993).Thetrialcourt,however,shouldmakespecificfindingsontherecordwhichindicatehisapplicationofthesentencingprinciples.Tenn.CodeAnn.4035209and210. Withregardtotheenhancementandmitigatingfactors,thisCourtmustdefertothefindingsofthetrialjudgesincenotranscriptofthetrialproceedingsiscontainedintherecord.ThereisnoproofbeforethisCourtastothenatureofthiscrimeorhowitwascommitted.Weareneitherawareofthespecificfactsthatledthetrialjudgetofindthatthecrimewasespeciallycruel,norareweawareofwhattypeofweaponthisDefendantusedinthecommissionofthecrime.ThisCourtmustmakedecisionsbasedonmatterswithintherecordandnotoutsideoftherecord.Whenapartyseeksappellatereviewthereisadutytopreparearecordwhichconveysafair,accurateandcompleteaccountofwhattranspiredwithrespecttotheissuesformingthebasisoftheappeal.Iftherecordisincomplete,thisCourtisprecludedfromconsideringtheissuesraised.Wemustconclusivelypresumethatthedeterminationofthetrialcourtwascorrectregardingtheweighttobeaffordedboththeenhancementfactorsandmitigatingfactors.Statev.Locust,914S.W.2d554,557(Tenn.Crim.App.1995);seealsoStatev.Matthews,805S.W.2d776,784(Tenn.Crim.App.1990).  InreviewingthesentencingconsiderationsofTennesseeCodeAnnotatedsection4035103,thetrialcourtfoundthatinthiscaseconfinementwasnecessarytoavoiddepreciatingtheseriousnessof thisparticularhomicide.Itisclearthatthetrialcourtmadeitsdecisionbasedontheparticularfactssurroundingthisparticularcrime.Again,sincetherecordonappealdoesnotincludethetrialtranscriptandisforthatreasonincomplete,thisCourtmustconclusivelypresumethatthejudgmentofthetrialcourtiscorrect.
