àOn€January€23,€1981,€the€petitioner€pled€guilty€to€aggravated€rape,€armedÏrobbery,€and€second„degree€murder.€€He€was€then€sentenced€to€three€concurrent€fortyÏyear€sentences.€€On€May€2,€1986,€this€Court€granted€the€petitioner€post„conviction€reliefÏand€vacated€the€guilty€plea€on€a€finding€that€the€trial€court€had€failed€to€fully€comply€withÏrequired€procedure€in€a€determination€of€whether€the€guilty€plea€was€made€knowingly€andÏvoluntarily.€€òòState€v.€Jordanóó,€No.€85„265„111(Tenn.€Crim.€App.€at€Nashville,€May€2,€1986).Ð ¦F  ÐÌà œ àà ô àOn€September€23,€1986,€the€petitioner€again€pled€guilty€to€aggravated€rape,Ïarmed€robbery,€and€second„degree€murder€and€was€sentenced€to€three€concurrent€thirty„¼five€year€sentences€pursuant€to€a€plea€bargain€agreement.€€On€May€5,€1996,€theÏpetitioner€filed€a€second€post„conviction€petition€alleging€ineffective€assistance€of€counselÏand€ex€post€facto€application€of€a€sentencing€law.€€The€petition€further€alleged€that€theÏpetitionerððs€plea€to€second„degree€murder€was€not€knowing€and€his€plea€to€aggravatedÏrape€was€involuntary€and€unknowing.€€The€petitioner€amended€this€petition€on€DecemberÏ11,€1996,€alleging€ineffective€assistance€of€counsel€on€the€grounds€that€petitionerððsÏcounsel€failed€to€inform€him€that€he€could€choose€between€two€different€sentencing€lawsÏand€further€alleging€that€the€State€failed€to€file€notice€of€its€intent€to€seek€enhancementÏof€the€punishment€.€€œIn›€œDecember€of›€œ1996,›€the€petitioner€filed€a€œpetition€for€writ›€œof›€habeasÏcorpus€alleging€that€the€indictments€for€aggravated€rape,€murder,€and€armed€robberyÏwere€fatally€defective€and€obtained€upon€void€and€defective€affidavits€of€complaints€andÏwarrants.€€Lastly,€on€March€24,€1997,€the€petitioner€filed€a€motion€to€amend€and€add€toÏhis€original€petition€for€post„conviction€relief.€€This€motion€moved€to€strike€and€expungeÏfrom€the€original€petition€the€grounds€of€ineffective€assistance€of€counsel€and€œofÏunknowing›€and€œinvoluntary›€guilty€plea.€€The€motion€also€added€the€allegation€that€theÏpetitionerððs€sentence€is€void€on€the€grounds€that€the€State€did€not€abide€by€the€terms€ofÐ F:æ04 Ðthe€plea€agreement.€€Upon€the€Stateððs€motion,€the€trial€court€dismissed€petitionerððsÐ :¾06 Ðpetition€for€post„conviction€relief€and€writ€of€habeas€corpus.€€The€petitioner€now€appealsÏand€argues€that€the€trial€court€erred€when€it€dismissed€his€petition€for€post„convictionÏrelief€and€writ€of€habeas€corpus.€€We€disagree€and€affirm€the€judgment€of€the€courtÏbelow.ÌÌà àWhen€petitioner€pled€guilty€on€September€23,€1986,€a€three€year€statute€ofÏlimitations€was€in€effect€regarding€post„conviction€petitions.€€T.C.A.€ðð€40„30„102€(repealedÏ1995).€€This€statute€of€limitations€started€to€run€when€the€judgment€against€the€petitionerÏbecame€final€in€October€of€1986.€€òòState€v.€Mooreóó,€814€S.W.2d€381,€382€(Tenn.€Crim.Ð À` ÐApp.€1991).€€As€the€petitionerððs€post„conviction€petition€was€filed€after€October€1989,€theÏstatute€of€limitations€had€run€and€his€petition€is€barred.€€ÌÌà œ àà ô àPetitioner€argues€that€his€petition€is€not€barred€by€the€statute€of€limitationsÏbecause€it€is€a€motion€to€reopen€his€prior€post„conviction€petition€filed€on€August€17,Ï1984.€€This€argument€is€without€merit.€€A€petitioner€may€file€a€motion€to€reopen€the€firstÏpost„conviction€petition€but€only€in€the€limited€circumstances€set€out€in€€T.C.A.€ðð€40„30„¼217€(1997).€€€The€petitioner€has€alleged€nothing€that€would€bring€his€petition€within€thoseÏlimited€circumstances€entitling€him€to€reopen€his€first€petition€for€post„conviction€relief.ÌÌà œ àà ô àPetitioner€also€appeals€the€trial€courtððs€denial€of€his€writ€of€habeas€corpusÏin€which€petitioner€alleges€the€indictments€were€fatally€defective.€€This€argument€isÏwithout€merit€as€it€has€been€waived.€€It€is€the€duty€of€the€appellant€to€prepare€a€record€thatÏconveys€a€fair,€accurate€and€complete€account€of€what€transcribed€in€the€trial€court€withÏrespect€to€the€issues€which€form€the€basis€of€the€appeal.€€Tenn.€R.€App.€P.€24(b).€€InÏaddition,€this€Court€has€held€that€an€appellate€court€cannot€consider€an€issue€which€is€notÏpreserved€in€the€record€for€review.€€òòState€v.€Banesóó,€874€S.W.2d€73,€82€(Tenn.€Crim.€App.Ð àFurthermore,€œeven€if›€the€indictments€had€been€included€in€the€œrecord,›€theÏpetitionerððs€arguments€would€still€fail.€€Habeas€corpus€relief€is€only€available€when€aÏconviction€is€void€because€the€convicting€court€was€without€jurisdiction€or€authority€toÏsentence€the€petitioner€or€petitionerððs€sentence€has€expired.€€òòArcher€v.€Stateóó,€851€S.W.2dÐ Ð157,€164€(Tenn.€1993).€€Petitioner€contends€the€indictments€are€fatally€defective€becauseÏthey€did€not€contain€the€requisite€mens€rea€depriving€the€trial€court€of€jurisdiction.€ÏAlthough€this€is€a€proper€basis€for€a€writ€of€habeas€corpus,€the€petitioner€has€allegedÏnothing€that€would€entitle€him€to€habeas€corpus€relief.€€ÌÌà àIn€determining€whether€an€indictment€is€sufficient,€it€must€first€beÏdetermined€whether€the€crime€occurred€under€the€old€or€the€new€criminal€code.€€In€theÏpresent€case€the€petitionerððs€offense€occurred€in€1981,€well€before€the€enactment€of€theÏnew€criminal€code€on€November€1,€1989.œ×ƒ×Ý Ð1970).€€Therefore,€petitionerððs€contention€that€the€evidence€was€insufficient€to€support€aÏconviction€for€aggravated€rape€is€not€a€proper€basis€for€post„conviction€relief.Ìà œ àà ô àÌà œ àà ô àThe€petitioner€further€contends€that€the€indictment€charging€petitioner€withÏaggravated€rape€failed€to€recite€explicitly€the€facts€which€constituted€the€alleged€crime.€ÏAccording€to€the€petitioner,€this€failure€renders€the€indictment€fatally€defective.€€ThisÏcontention€is€without€merit.€€The€indictment€charging€petitioner€with€aggravated€rapeÏstated€the€facts€constituting€aggravated€rape€in€ordinary€language€such€that€a€person€ofÏcommon€understanding€would€know€the€crime€charged€and€with€enough€certainty€toÏenable€a€court€to€pronounce€proper€judgment€upon€conviction.€€As€such,€the€indictmentÏwas€sufficient€under€the€applicable€statutory€standard.€€œñøñòòñøññùñSeeóóñùññùññøñóóñøñ›ñùññ÷ñòòSeeóó,ñ÷ñ›€T.C.A.€œððñúñ€ñúñ40„1802›€(nowÐ
