ÐShe€advised€the€Defendant€that€she€was€going€to€press€charges,€but€DefendantÏapologized€and€promised€to€never€do€it€again.€€Ìâ âÌà ` àThe€presentence€report€reflects€that€the€Defendant€told€the€police€he€wasÏdriving€his€girlfriend,€stepbrother€and€stepsister€around€while€he€was€drinking.€ÏDefendant€admitted€that€ð ðdrinking€and€driving€was€something€that€I€was€accustomedÏto€doingðð€due€to€his€drinking€problem.€€At€the€time€of€the€accident€he€was€drivingÏapproximately€sixty„five€(65)€miles€per€hour€when€he€saw€that€he€was€going€to€runÏinto€a€tree€and€tried€to€cut€his€vehicle€to€the€left.€€The€Defendantððs€stepsister€wasÏkilled€due€to€the€accident.€€Defendant€testified€that€the€victimððs€mother€correctlyÏdescribed€that€one€(1)€month€prior€to€the€victimððs€death,€the€Defendant€had€herÏchildren€out€drinking€and€driving€until€3:30€a.m.€€ÌÌà ` àThe€presentence€report€and€the€probation€officer€who€testified€at€theÏsentencing€hearing€both€indicated€that€Defendant€was€employed€at€the€time€of€theÏsentencing€hearing€and€had€begun€going€to€AA€meetings€and€Pathfinders,€aÏdrug/alcohol€rehabilitation€facility.€€Defendant€was€described€by€a€supervisor€at€hisÏplace€of€employment€as€ð ðan€acceptable€employee.ðð€€Defendantððs€sponsor€at€AAÏdescribed€Defendant€as€ð ðinvolvedðð€in€the€program€for€ten€(10)€weeks€prior€to€theÏsentencing€hearing,€but€not€ð ðactively.ðð€€During€Defendantððs€testimony,€he€admitted€Ïthat€he€missed€a€full€month€of€AA€meetings€from€April€8,€1997€until€May€6,€1997,€andÏalso€missed€the€meetings€from€May€22,€1997€through€June€12,€1997.€€ÌÌà ` àPrior€to€this€offense,€Defendant€had€twice€been€arrested€for€DUI.€€He€was€firstÏarrested€for€DUI€on€September€1,€1995,€and€was€convicted€of€DUI€on€October€16,Ð  :À00 Ð1995.€€Defendant€was€sentenced€to€eleven€(11)€months,€twenty„nine€(29)€days,€allÏsuspended€except€for€forty„eight€(48)€hours.€€The€second€arrest€for€DUI€occurred€onÏJune€10,€1996,€while€Defendant€was€on€probation€from€his€first€DUI€conviction,€andÏresulted€in€a€conviction€for€reckless€driving€on€œññAugustñññ‘ñJuneñ‘ñ›€19,€1996.€€The€reckless€drivingÏconviction€concluded€with€a€sentence€of€six€(6)€months,€with€all€except€forty„eightÏ(48)€hours€suspended.€€During€his€testimony,€Defendant€conceded€that€he€neverÏsought€help€for€his€drinking€problem€following€either€of€these€convictions,€and€thatÏhe€continued€to€drink€and€drive.€€This€offense€of€vehicular€homicide€was€committedÏon€November€8,€1996,€only€three€(3)€months€after€Defendantððs€last€conviction.€€AÏviolation€of€probation€was€pending€in€General€Sessions€Court€at€the€time€of€theÏsentencing€hearing.€€ÌÌà ` àOther€proof€at€the€sentencing€hearing€included€testimony€that€Defendant€wasÏin€a€bowling€alley€on€July€4,€1997,€just€prior€to€the€sentencing€hearing€for€hisÏvehicular€homicide€conviction.€€While€at€the€bowling€alley,€Defendant€tried€toÏpersuade€a€waitress€to€serve€alcoholic€beverages€to€his€girlfriend,€who€was€not€ofÏage€to€legally€consume€alcoholic€beverages.ÌÌà ` àWith€two€(2)€prior€DUI€arrests€in€the€two€(2)€years€preceding€this€offense,€theÏneed€to€protect€society€by€restraining€this€Defendant€with€a€historyñ‹ñ›ñ‹ñ€of€criminalÏconduct€is€obvious.€€By€his€own€admission,€Defendant€has€continued€to€drink€andÏdrive€following€his€previous€convictions.€€As€the€trial€court€noted,€drinking€and€drivingÏis€a€serious€problem€in€our€society€and€confinement€is€particularly€appropriate€toÏeffectively€deter€the€Defendant.€€€ñ‹ñœñ‹ñDefendantñ‹ñ›ñ‹ñ€did€not€seek€any€help€for€his€alcoholÏproblem€until€as€late€as€February€1997,€and€between€the€time€of€February€until€theÐ
