OnMay3,1995,thepetitionerfiledapetitionforpostconvictionrelief,alleging,interalia,thathiscounselwasineffectiveforfailingtotimelyseekreviewbytheTennesseeSupremeCourt.Atthepostconvictionhearing,thepetitionertestifiedthatafterhisconvictionhadbeenaffirmedbytheCourtofCriminalAppeals,heneverspokewithMr.RogersorreceivedanyadviceorinformationonhowtofileaproseappealorretainanotherattorneytofileanappealtotheTennesseeSupremeCourt.Mr.Rogersalsotestified.Hedidnotrecalladvisingthepetitionerofhisoptiontoappealto  the  SupremeCourtandadmitteditjust fellbetweenthetracksandthecracks.ThepostconvictioncourtfoundthatthepetitionerscounselwasineffectiveforfailingtonotifythepetitionerofhisoptiontoseekreviewbytheTennesseeSupremeCourt.Thepostconvictioncourtdeniedreliefontheothergroundsallegedinthepetitionerspetition,findingthemtobewithoutmerit.
