Initially,thestatesoughtthedeathpenalty.Twoattorneysrepresentedthepetitioner.Onewasretainedandtheotherappointed.InthepetitionforpostconvictionrelieffiledDecember11,1995,andamendedbyappointedcounselthreemonthslater,thepetitionercontended,amongotherthings,thattrialcounselwasineffectiveinthathisAlfordpleahadnotbeenknowinglyand /%* voluntarilyentered.Thepetitionerclaimedthathistrialcounselhadfailedtoadequatelyinvestigatehiscompetencyandhadfailedtoextendtohimtheopportunitytopursueajurytrial.Thepetitioneralsocontendedthatthetrialcourtfailedtoadequatelyadvisethepetitionerofhisconstitutionalrightsbeforetheguiltypleawasenteredandcomplainedabouthistrialcounsel'sadviceonapost 8.4 sentencingmotiontowithdrawtheguiltypleas.<<66<<66<<<<7X`XX X`  Attheevidentiaryhearing,thepetitionertestifiedthathisattorneys  failedtoconductanyinvestigationandwerehesitanttoproceedtotrial.Heclaimedthattheybelievedhewouldbeexecutedifheinsistedonatrialandgaveadviceto"copout."Thepetitionerinsistedthathewasconfusedaboutthepleasofguiltandwasundertheimpressionthathewouldreceiveajurytrialaftertheguiltypleahearing.Herememberedfilingamotionto7<7widhdraw7<<withdraw<7hisguiltypleaandclaimedhewasadvisedtopresenttheissueinapostconvictionpetition.  AttorneyDougLove,whowasretainedtorepresentthepetitionerattrial,testifiedthattheguiltypleaswereinthebestinterestofthepetitioner.Hedeniedadvisingthepetitionerthathecouldpleadguiltyandreceiveajurytriallaterandrecalled"[he]toldmemanytimesthathedidnotwanttogoinfrontofajury[andt]hereisnoquestioninmymindaboutthatatall."Hestatedthattherewasnolegalbasisforthepetitioner'smotiontowithdrawhispleasofguilt,thattheproofagainstthepetitionerwasstrong,andthatthepetitionerdidnotwanttofaceatrial.  AttorneyPatrickMcNally,whowasappointedtoassistinthe7<7represention7<<representation<7ofthepetitionerattrial,agreedthatthestate'sproofagainstthepetitionerwasstrong.Hetestifiedthatoneormorecodefendantshadbeenwillingtotestifyagainstthepetitionerandthatthevictim'sjewelryandthemurderweaponhadbeenrecoveredfromthepetitioner'sapartment.Itwashisopinionthatthestatecouldhaveprovedthreeaggravatingcircumstances.McNallytestifiedthatthepetitionerwasnotmentallyretarded,hadbeendeterminedcompetenttostandtrial, @8.2 andwasbotheligibleforandlikelytoreceivethedeathpenalty.HerecalledtalkingatlengthwiththepetitioneraboutenteringguiltypleasandrememberedthatAttorneyLoveunsuccessfullyarguedthemotiontowithdrawtheguiltypleas.# X`XXX`#7<<     Thetrialcourtconcludedthatthepetitionerwascompetentatthetimeofhispleaandfullyunderstoodtheentireproceedings.Thepetitionerhadundergoneapsychologicalexaminationbyexpertsbeforehisguiltypleaandwasdeemedcompetenttostandtrial.Thetrialcourtruledthattrialcounselhadnotbeendeficientbyfailing"topresshisrequestedmotiontowithdrawhisguiltyplea"anddeterminedthatthemotionwouldnothavebeengrantedevenifithadbeentimelyfiledandaggressivelypursued.  =AsthepetitioninthiscasewasfiledafterMay10,1995,thepetitionerhastheburdenofprovingallegationsbyclearandconvincingevidence.t==Inthisappeal,thepetitionermaintainsthathewasnotfullyawareofthedirectconsequencesofhisplea.Morespecifically,hecontendsthathe=F  AsthepetitioninthiscasewasfiledafterMay10,1995,thepetitionerhastheburdenofprovingallegationsbyclearandconvincingevidence.Tenn.CodeAnn.4030210(f).FG  AsthepetitioninthiscasewasfiledafterMay10,1995,thepetitionerhastheburdenofprovingallegationsbyclearandconvincingevidence.Tenn.CodeAnn.4030210(f).Gwasnotproperlyadvisedbythetrialjudgeofthemandatoryminimumandmaximumpenalties.Thepetitionerinsiststhathistrialcounselwasdeficientformisleadingthepetitionerintobelievingthatthecasewouldproceedtoajurytrial.̜JJHHKKH  AsthepetitioninthiscasewasfiledafterMay10,1995,thepetitionerhastheburdenofprovingallegationsbyclearandconvincingevidence.Tenn.CodeAnn.4030210(f).HI   D Inapostconvictionproceeding,the 0`'* petitionerhastheburdenofprovingallegationsbyapreponderanceoftheevidence.Clennyv.State,576S.W.2d12,14(Tenn.Crim.App.1978).IThefindingsmadebythetrialcourtareconclusiveonKKappealunlesstheevidencepreponderatesagainstthosefindings.Butlerv.State, 0`'* 789S.W.2d898(Tenn.1990).  InBoykinv.Alabama,395U.S.238(1969),theSupremeCourt `6-0 requiredthattherecordaffirmativelyshowthateachdefendantknowingly, @8.2 voluntarilyandunderstandinglyenteredhispleasofguilt.Therecordmustdemonstratethatthedefendantunderstoodthathewaivedhisprivilegeagainstcompulsoryselfincrimination,hisrighttoatrialbyjury,andhisrighttoconfronthis 8.4 55accusers.Id.at<<24377.<<<<Mostimportantly,55thepleamustrepresent"avoluntaryand `  intelligentchoiceamongthealternativecoursesofactionopentothedefendant."NorthCarolinav.Alford,400U.S.25(1970);55<<<<State55v.Mackey,553S.W.2d337   (Tenn.1977).  Inourview,therecordestablishesthatthepleaswereknowinglyandvoluntarilymade.Thepetitionerhasalsofailedtodemonstratethathewasincompetenttostandtrialorthathewasunawareormisinformedofhisrighttoajury.Inshort,hehasfailedtomeethisburdenofproof.  Inorderforthepetitionertobegrantedreliefongroundsofineffectivecounsel,hemustestablishthattheadvicegivenortheservicesrendered55were55notwithintherangeofcompetencedemandedofattorneysincriminalcasesandthat,butforhiscounsel'sdeficientperformance,theresultofhistrialwouldhavebeendifferent.Baxterv.Rose,523S.W.2d930(Tenn.1975);Stricklandv.Washington, "( 466U.S.668(1984).Thistwopartstandard,asitappliestoguiltypleas,ismetwhenthepetitionerestablishesthat,butforhiscounsel'serrors,hewouldnothavepledguiltyandwouldhaveinsistedonatrial.Hillv.Lockhart,474U.S.52(1985). '" Thetranscriptoftheguiltypleaestablishesthatthepetitionerwasadequatelyadvisedofeachofhisrights.Therecorddoesnotsupportthepetitioner'scontentionthathewastrickedintopleadingguiltybyhisattorneysonthepromisethattherewouldeventuallybeajurytrial.
