OnJuly20,1993,atapproximately12:36a.m.thedefendantwasarrestedbyTrooperBillyGrooms.Groomsfollowedthedefendantforapproximatelythreequarters(3/4)ofamileandobservedthedefendantsvehiclegoontotheroadshoulderacrossthewhiteline,comebackacrossthecenterlineandthenstraddlethecenterline.Uponstoppingthedefendantthetrooperdetectedastrongsmellofalcoholonthedefendantsbreathaswellasslurredspeech.Defendantseyeswerebloodshot,andhewasunsteadyonhisfeettotheextentofstaggeringfromsidetoside. Inadditiontothehorizontalgazenystagmustest,theofficeradministeredtwo(2)otherfieldsobrietytests.Thefirstwastheonelegstandinwhichthedefendantwasunabletofollowdirections.Hewasonlyabletocounttofour(4)ratherthantwentyfive(25)withone(1)legraised.Uponbeingaskedtomakeanotherattempt,thedefendantdeclined. Thewalkandturntestwasalsoadministered.Thedefendantwasunabletokeephisbalanceandsteppedoffthewhiteline.Inwalkingawayfromtheofficer,hemissedhisheeltotoeseven(7)outoften(10)timesandmissedsix(6)outofnine(9)timesuponhisreturnwalk. Thedefendantstatedontwo(2)ormoreoccasionsthathe knewhehadtoomuchtodrinkanddrive.Herefusedthebloodalcoholtestandstatedhewantedtotalktohisattorneyfirst. Theofficerwasoftheopinionthatthedefendantwasimpairedanddrivingundertheinfluenceofanintoxicant. Thedefenseproofconsistedofone(1)witnesswhoobservedthedefendantatapproximately3:00or3:30a.m.andtestifiedthedefendant lookedperfectlyfinetome.Two(2)otherwitnesses,whowerewiththedefendantatabeertavernthrowingdartsjustpriortothearrest,opinedthatthedefendantwasnotundertheinfluenceofanintoxicantwhenheleftthebeertavern.Oneofthesewitnessesnotedthedefendant wasthrowingprettygooddartsinthedarttournamentandmade thefinalfour. Thedefendanttestifiedheboughtonlyfour(4)beersoverthecourseoftheeveningwhileatthebeertavernandconsumedaboutthree(3)ofthosebeers,consideringhedidnotdrinkallofthebeerineachcan.Hedeniedbeingundertheinfluenceofanintoxicantanddeniedthattheofficerrequestedhimtodotheonelegstand.Hefurthercontendedthatheperformedwellontheheeltotoetest.Moreover,hetestifiedthathedidwellonthefingertonosetest,andthattheofficerwasuntruthfulinstatingthatthistestwasneveradministered.Defendantdeniedstatingtotheofficerthathehadtoomuchtodrink.Theessenceofthedefendantstestimonywasthattheofficerwasuntruthfulinhistestimony.̀ Thiswasaclassiccasepittingthecredibilityoftheofficeragainstthecredibilityofthedefendant.Thejuryobviouslyrejectedthedefendantstestimonyandaccreditedthetestimonyoftheofficer.Inconsideringthewholerecord,weareunabletofindthattheoutcomeofthetrialwouldhavebeenanydifferenthadthehorizontalgazenystagmustestimonynotbeenpresented.ThisCourthasfoundharmlesserrorinothercasesinvolvingthisissue.SeeStatev.WilliamF.Hegger,C.C.A.No.01C019607CR00283,DavidsonCounty(Tenn.Crim.App.filedMarch4,1998,atNashville);Statev.MarkSummers,C.C.A.No.03C019606CR00235,HamiltonCounty(Tenn.Crim.App.filedDecember4,1997,atKnoxville);Statev.ClintonDarrellTurner,C.C.A.No.03C019604CC00151,CockeCounty(Tenn.Crim.App.filedJuly9,1997,atKnoxville).
