ItappearsthatonJune30,1994,thepetitionerpledguiltytoonecountofvehicularhomicideandfourcountsofrecklessendangermentwithaweapon.Noappealwastaken.Thereafter,onOctober7,1997,thepetitionerfiledapetitionforpostconvictionrelief.Thetrialcourtdismissedthepetitionwithoutahearinguponafindingthatthepetitionwasbarredbytheoneyearstatuteoflimitation.Thepetitionerthenfiledanapplicationforinterlocutoryappeal,whichwasalsodenied.However,thetrialcourtwaivedthefilingofatimelynoticeofappealandallowedadelayedappeal.  Initially,wenotethatpursuanttoT.R.A.P.4(a),motionstowaivethenoticeofappealdocumentshallbereviewedbythisCourttodeterminewhethersuchawaiverisintheinterestofjustice,andwefindthatitisintheinterestofjusticethattherequirementbewaivedinthiscase.SeeStatev.Scales,767S.W.2d157(Tenn.1989).  Regardless,wefindthatthepetitionforpostconvictionreliefisbarredbythestatuteoflimitation.PursuanttoT.C.A.4030206(a),apetitionermustpetitionforpostconvictionreliefwithinoneyearofthedateofthefinalactionofthehigheststateappellatecourttowhichanappealwastaken.TheCompilersNotestoT.C.A.4030201statesthatthe1995PostConvictionActgovernsallpetitionsforpostconvictionrelieffiledafterMay10,1995.Moreover,theCompilersNotesindicatethat anypersonhavinggroundforreliefrecognizedunderthispartshallhaveatleastone(1)yearfromMay10,1995,tofileapetitionoramotiontoreopenapetitionunderthispart.  UnderT.C.A.4030202(b),acourtdoesnothavejurisdictiontoconsiderapetitionforpostconvictionreliefifitwasfiledoutsidetheoneyearstatuteoflimitationunless(1)theclaiminthepetitionisbaseduponafinalrulingofanappellatecourtestablishingaconstitutionalrightthatwasnotrecognizedasexistingatthetimeoftrial,ifretrospectiveapplicationofthatrightisrequired;(2)theclaiminthepetitionisbaseduponnewscientificevidenceestablishingthatsuchpetitionerisactuallyinnocentoftheoffenseoroffensesforwhichthepetitionerwasconvicted;or(3)theclaiminthepetitionseeksrelieffromasentencethatwasenhancedbecauseofapreviousconvictionandsuchconvictioninthecaseinwhichtheclaimisassertedwasnotaguiltypleawithanagreedsentence,andthepreviousconvictionhassubsequentlybeenheldtobeinvalid.  Inthepresentcase,thepetitionerfiledhispetitionforpostconvictionreliefonOctober7,1996.Accordingly,thepetitionisgovernedbythe1995PostConvictionAct,andthepetitionwasfiledoutsidethestatuteoflimitationsetforthinT.C.A.4030202(a).Moreover,thepetitionerhasfailedtoshowthatanyofhisclaimsfallwithinoneoftheexceptionssetforthinT.C.A.4030202(b).Instead,thepetitionersubmitsthatourSupremeCourtsopinion%&inCarterv.State,952S.W.2d417(Tenn.1997),hasbeenmisconstruedtomeanthattherightofthosepetitionerswhooriginallyfellunderthethreeyearstatuteoflimitationtofileapostconvictionpetitionexpiredonMay10,1996.Thisargumentiswithoutmerit.
