Thetwogirlsadvisedhimno.[Thedefendant]thenwalkedtonearbybushesand  pulledhispantsdownpasthiskneesandexposedhimself.Thegirlsthenturned  aroundquicklyandwalkedhome. X  SheadvisedthathedrivesawhiteCadillacwithagreentop.Hedrivesbychildren D! intheneighborhoodmasturbatinginhisvehicle. 0"   XC X58      8  IntheearlyweeksofMarch2002,13yr.old[E.H.]andherfriend[J.R.],13yrs. $X" old,and[D.S.],13yrs.oldweresittingonthefrontporchat29053rdAvenuewhen $D # theynoticedawhiteCadillacwithagreentopslowlydrivingbythehouseand  circlingtheblock.Thevehiclethendroveoff.Lateronintheeveningwhenitwas  dark,[E.H.]and[J.R.]walked[D.S.]home,27464thAvenue.Theythensawthe  whiteCadillacparkedon4thAvenue.[Thedefendantstepped]outofthevehicle t wearingwhatappearedtobepajamapants.Hispeniswasinhishandandhewas ` masturbating.Thegirlsraninside[D.S.]sresidenceand[thedefendant]droveoff. L      8  IntheearlyweeksofMarch2002,[M.F.]andherfriend[T.D.]werewalkinghome $ t forthebusstopat330012thAvenue.Theywerethenapproachedby[thedefendant]  ` drivingawhiteCadillacwithagreentop.[He]droveuptothegirlscloseenoughso  L  theycouldobservehimmasturbating.Hethenaskedthemiftheywantedtomake  8  anymoney.Bothgirlsadvisedhimnoandran.[Thedefendant]followedbehind $  them.Bothranhomeandadvisedtheirparents.    8      8  [Thedefendant]wasstoppedat1103RockwayDr.forabrokenrighttaillightand   aninvestigationwasadministeredonthedriverandvehicle.Whiletalkingtothe   defendantapistolcouldbeseeninthefrontdriver[]sseatfloorboard,directlyunder p thedriver.Thedefendantsaidhehadpurchasedthe.380fromafriend.Hewas \ arrestedandtransportedto601WalnutSt.H   8      8  OnTuesday03122002[]OfficerSuttonwasapproachedbytwoFranklinMiddle  p Schoolstudentswhoadvised[him]thaton031102,[thedefendant]drivingawhite  \ Cadillacwithagreenragtopapproachedthemandsomeotherfriends.Thesuspect H wasinvolvedinanargumentwithtwopartiesfromthegroup.Thesuspectthenwent 4 tohiscarandretrievedhisgun.Thegroupranfromthesuspect.[O]nechild,[A.M.]   saidthesuspectpointedthegundirectlyatherandthencontinuedtolookfortherest   ofthegroup.Asecondchild,[K.T.]ranwhenshesawhimgotothecar.[K.T.]  saidthesuspectgotinhiscarandbegantochasethemthroughEmmaWheeler  Home.Both[K.T.]and[A.M.]madeithomebeforehewasabletofindthem.The  girlsstatedthattheydseenthesuspectseveraltimesbeforedrivingandwalking l throughtheneighborhood.Bothstudentsidd(sic)thesuspectfromaphotoand X  describedthesuspectshandgunasalargesilvergun.D! '#& 4035103(2);Statev.Batey,35S.W.3d585,58889(Tenn.Crim.App.2000).Indeed, (#' individualizedpunishmentistheessenceofalternativesentencing.Statev.Dowdy,894S.W.2d )$(  301,305(Tenn.Crim.App.1994).Insummary,sentencingmustbedeterminedonacasebycase |*%) basis,tailoringeachsentencetothatparticulardefendantbaseduponthefactsofthatcaseandthe  circumstancesofthatdefendant.Statev.Moss,727S.W.2d229,235(Tenn.1986).#X^XX X^3#     ThedefendantpledguiltyasaRangeIstandardoffendertonothinghigherthanClassC t felonies.Therefore,heisconsideredtobeafavorablecandidateforalternativesentencing. ` Additionally,becausehissentenceiseightyearsorless,hemustbeautomaticallyconsideredfor L  probation.Thetrialcourtdeniedthedefendantanyformofalternativesentence.Thetrialcourt 8  foundthatincarcerationisappropriatebecause [thedefendant]isathreattothesafetyofthe $ t public.Weagreewiththetrialcourt.  `     Thepresentencereportreflectsthatthedefendantwastwentysevenyearsold,unmarried,  8  andhadfatheredonechild.Thereportindicatesthatthedefendantcompletedhighschoolandhas $  anaboveaverageemploymenthistory.However,thereisanunaccountedforgapinhisemployment   history.Thedefendantadmitstousingmarijuanaandthedrugecstacyonoccasion.Hestatedthat   hewasundertheinfluenceofmarijuanaatthetimetheseoffenseswerecommitted.Thedefendant   haspriorconvictionsforcocainepossessionandassault.Thedefendanthadnotbeenoffprobation   verylongwhentheseoffenseswerecommitted.Thedefendantsconductthreatenednumerous p victims,andadeadlyweaponwasinvolved.Hisconductinvolvinghisexposureandtheagesofhis \ victimsmakethisconductabhorrentandreprehensible.Thedefendantisanobviousthreattosociety H consideringthecircumstancesandthenatureoftheoffensescommitted.Denialofanyformof 4 alternativesentenceisappropriateinthiscase.  p    @ Conclusion H      Basedontheforegoingreasonsandtherecordasawhole,thejudgmentsofthetrialcourtare   affirmed.      `     h     ___________________________________ X     `     h     JOHNEVERETTWILLIAMS,JUDGE
