àIn€November,€1994,€the€Appellant€was€charged€with€two€counts€ofÏaggravated€assault€involving€an€attack€upon€œMs.›€Teresa€McCord,€the€AppellantððsÏsister.€€Mr.€Lane€applied€for€pretrial€diversion€pursuant€to€œTennessee€›CodeÏAnnotated€Section€40„35„101,€òòetóó€òòseqóó.€€This€application€was€denied€and€anÐ &.Æ$% Ðinterlocutory€appeal€to€this€Court€was€granted.€€òòState€v.€Laneóó,€Williamson€County,€Ð 0¶&' ÐNo.€01C01„9506„CC„00213€(Tenn.€Crim.€App.€Sept.€5,€1996).€€TheÏcircumstances€surrounding€the€charges€against€the€Appellant€are€summarizedÏin€that€opinion:Ìâ âÐ Ö7v./ ÐÓÓà ` àOn€September€29,€1994,€the€defendant€resided€in€a€trailer€located€uponÏâ âproperty€owned€by€his€sister,€Teresa€McCord,€who€is€listed€in€the€indictment€asÏthe€victim€of€the€alleged€offense.€€The€defendant,€now€32€years€of€age,€is€theÏcustodian€of€his€two€minor€children;€at€the€time€of€the€charges,€he€shared€hisÏresidence€with€his€mother.€€The€defendant€had€been€employed€for€the€lastÏseveral€years€in€security€at€Baptist€Hospital€in€ñ0ñnashvilleñ0ññ0ñNashvilleñ0ñ.€€Although€not€a€highÏschool€graduate,€he€has€an€employment€history€that€includes€work€as€aÏdispatcher€in€the€Fairview€Police€Department€and€work€in€traffic€control€inÏNashville.€€The€defendant€is€licensed€to€carry€a€firearm.€€He€has€no€prior€criminalÏrecord.ÌÌà ` àAn€altercation€occurred€after€the€victim,€who€lived€next€door,€swore€out€anÏunlawful€detainer€warrant€against€the€defendant.€€After€being€notified€of€the€actionÏby€local€œñ0ñauthoriesñ0ññ0ñauthoriñ0ññ6ññ0ñzñ0ññ6ññ0ññ0ññ7ñtiñ7ññ0ñesñ0ñ,›€the€defendant€had€one€or€more€telephone€conversations€withÏthe€victim€about€how€long€he€could€maintain€his€trailer€on€her€property.ÌÌà àLater,€the€defendant€and€the€victim€argued.€€While€the€facts€are€contested,Ïthe€victim€claimed€that€the€defendant€attacked€her€in€her€own€front€year,€struckÏher€in€the€œfacñ8ñtñ8ññ9ñeñ9ñ,›€and€punched€his€finger€into€her€eyes€until€she€was€helpless.€€TheÏvictim,€who€suffered€serious€injuries€to€her€eyes,€was€hospitalized.€€PhotographsÏin€the€record€substantiate€the€severity€of€her€injuries.€€The€defendant€claimed€thatÏthe€victim€initiated€the€altercation.€€He€asserted€that€his€sister€grabbed€him€by€theÏthroat,€cutting€off€his€air€supply,€and€that€he€panicked,€swinging€wildly,€until€sheÏreleased€her€hold.€€òòLaneóó,€Slip€Op.€at€pp.€4„5.Ð ` àAt€the€hearing€on€the€request€for€judicial€diversion€the€Appellant€presentedÏtestimony€concerning€his€good€work€history,€and€his€care€for€his€ailing€€mother.€Ð Ð9p02 ÐHe€admitted€he€was€the€ñ0ñagressorñ0ññ0ñaggressorñ0ñ€in€the€attack€on€his€sister€and€stated€he€wasÏñ0ñremorsefulandñ0ññ0ñremorseful€andñ0ñ€that€he€had€begun€counseling€for€the€issues€between€him€and€hisÏsister€that€had€led€to€the€assault.€€However,€the€proof€also€showed€that€for€overÏñ0ñtwoyearsñ0ññ0ñtwo€yearsñ0ñ€after€the€assault€the€Appellant€showed€no€remorse,€made€no€ñ0ñattamptñ0ññ0ñattemptñ0ñÏto€pay€restitution€and€actually€blamed€the€victim€for€the€incident.€€Only€after€theÏvictim,€Ms.€McCord€told€the€Appellant€that€she€would€not€press€for€hisÏincarceration€did€he€ð
