Ðà  àà ` àThe€indictment€against€Lawrence€charges€him€with€the€possession€of€.07€grams€ofÐ <#Œ" Ðcrack€cocaine€with€the€intent€to€sell.€€The€.07€grams€refers€to€the€amount€of€crack€cocaine€that€policeÐ "$r# Ðdiscovered€in€a€medicine€bottle€in€Dukesðð€kitchen€cabinet.׃×Ý ƒ#ÃÝòòÚ  Ú3Ú  ÚóóÝ  Ý×  ×€€Lawrence€argues€that€there€wasÐ %X $ Ðinsufficient€evidence€produced€at€trial€to€link€him€to€the€crack€cocaine€located€in€a€medicine€bottleÐ î%>!% Ðin€the€kitchen.€€We€agree.€€Ð Ô&$"& Ðâ âÐ º' #' Ðà  àà ` àLawrence€was€only€a€visitor€at€Dukesðð€residence;€he€did€not€live€there.€€Moreover,Ð ° Ðâ âLawrence€was€in€the€bathroom€when€the€drugs€were€found€in€the€kitchen.€€The€Stateððs€theory€at€trialÐ –æ Ðwas€that€Hatton€sold€drugs€out€of€the€kitchen,€while€Lawrence€sold€drugs€out€of€the€bathroom.Ð |Ì ÐAdditionally,€Dukes€testified€that,€although€the€medicine€bottle€was€his,€he€did€not€own€the€crackÐ b² Ðcocaine€contained€in€the€medicine€bottle.€€However,€although€Lawrence€had€often€sold€crack€cocaineÐ H˜ Ðat€Dukesðð€residence,€there€was€no€proof€that€he€knew€the€crack€cocaine€was€in€the€medicine€bottleÐ . ~ Ðin€the€kitchen€cabinet€or€that€he€had€any€connection€with€the€medicine€bottle.€€òòSeeóó€òòState€v.€Jacksonóó,Ð  d ÐNo.€M1998„00035„CCA„R3„CD,€2000€WL€549295,€at€*11€(Tenn.€Crim.€App.€at€Nashville,€May€5,Ð ú J Ð2000).€€We€are€unable€to€say€that€these€facts€exclude€every€other€hypothesis€except€for€LawrenceððsÐ à 0 Ðguilt.€€òòCrawfordóó,€470€S.W.2d€at€612.€€Therefore,€the€evidence€is€insufficient€as€a€matter€of€law€toÐ Æ   Ðsustain€Lawrenceððs€conviction€of€the€possession€of€.07€grams€of€crack€cocaine€with€intent€to€sell.€Ð ¬ ü  ÐòòSeeóó€òòState€v.€Transouóó,€928€S.W.2d€949,€956€(Tenn.€Crim.€App.€1996).Ð ’â  ÐÌà@__%ìàb.€€HattonˆÐ ^®  Ðà  àà ` àHatton€also€argues€that€there€was€insufficient€evidence€to€convict€him€of€possessionÐ D”  Ðof€.07€grams€of€crack€cocaine€with€intent€to€sell.€€We€disagree.€€The€Stateððs€theory€at€trial€was€thatÐ *z  ÐHatton€conducted€all€of€his€drug€deals€in€the€kitchen.€€Additionally,€Hatton€was€found€in€the€kitchenÐ ` Ðwithin€armððs€reach€of€the€cabinet€containing€the€medicine€bottle€with€the€crack€cocaine€inside.€Ð öF ÐMoreover,€there€was€an€empty€vial€containing€possible€crack€cocaine€residue€discovered€near€HattonÐ Ü, Ðin€the€kitchen.€€This€court€has€repeatedly€stated€that€mere€proximity€is€not€enough€to€find€an€accusedÐ Â Ðin€constructive€possession€of€drugs.€€òòSeeóó€òòState€v.€Jonesóó,€No.€02C01„9601„CC„00030,€1996€WLÐ ¨ø Ð629199,€at€*3€(Tenn.€Crim.€App.€at€Jackson,€October€31,€1996)(finding€that,€where€the€only€evidenceÐ ŽÞ Ðof€defendantððs€possession€of€drugs€was€his€proximity€to€their€location,€that€evidence€was€insufficientÐ tÄ Ðto€establish€constructive€possession).€€However,€the€State€proved€more€than€Hattonððs€proximity€toÐ Zª Ðthe€crack€cocaine€in€the€medicine€bottle.€€Summers€testified€that€Hatton€regularly€sold€crack€cocaineÐ @ Ðin€Dukesðð€kitchen.€€òòóóFurthermore,€Hattonððs€presence€in€the€kitchen€where€he€conducted€all€of€his€drugÐ &v Ðsales€indicated€his€ability€to€reduce€the€crack€cocaine€in€the€medicine€bottle€to€actual€possession.€Ð  \ ÐòòSeeóó€òòBrownóó,€823€S.W.2d€at€579.€Additionally,€there€was€no€evidence€at€trial€that€Hatton€possessedÐ òB Ðany€drug€paraphernalia€for€his€personal€use€of€the€crack€cocaine.€€òòSeeóó€òòState€v.€Brownóó,€915€S.W.2dÐ Ø( Ð3,€8€(Tenn.€Crim.€App.€1995).€This€issue€is€without€merit.Ð ¾ ÐÌà@..ìà2.€€Possession€of€Drug€Paraphernaliaà@@ìì*ìàˆÐ Š Ú Ðà  àà ` àIn€order€to€convict€the€appellants€of€possession€of€drug€paraphernalia,€the€StateÐ p!À  Ðneeded€to€prove€that€the€appellants€used€or€possessed€with€intent€to€use€drug€paraphernalia€to€Ð V"¦!
