Ðwas€the€apparent€victim€of€a€drowning.€€Whitson€stated€that€a€helicopter€was€requested,€but€by€theÐ À  Ðtime€the€paramedics€arrived€at€the€scene,€the€victim,€a€three„year„old€girl,€had€regainedÐ ¬ü  Ðconsciousness,€and€the€helicopter€was€canceled.€€Whitson€later€observed€a€paramedic€carrying€theÐ ˜è ðon€three€separate€occasions€within€a€short€period€ofÐ H˜ Ðtime,ðð€the€child€told€her€that€ð ðKennyðð€had€hurt€her.€Ð 4„ ÐÌà  àWhitson€observed€that€the€victim€ð ðhad€tufts€of€hair€pulled€out€in€three€.€.€.€placesðð€and€that€Ð  \ Ðone€larger€patch€of€hair€was€missing€from€the€back€of€her€head.€€Whitson€opined€that€someone€hadÐ øH Ðpulled€out€the€childððs€hair.€€Whitson€also€observed€ð ðmultiple€bruises€all€over€[the€victimððs]€ear€space,Ð ä4 Ðon€the€soft€parts€of€her€ears,€down€her€neck.€€She€had€a€very€distinct€imprint€of€a€hand€that€was€acrossÐ Ð  Ðthe€front€of€her€face€.€.€.€the€size€of€an€adult€[hand].ðð€€Whitson€testified€that€ð ðthe€rest€of€[the€victimððs]Ð ¼  Ðbody€was€covered€with€bruises€that€were€too€numerous€to€count.ðð€€Whitson€elaborated€that€ð ðthereÐ ¨ø Ðwas€not€a€part€of€that€childððs€body€that€you€could€lay€a€fifty€cent€piece€on€that€would€not€touch€aÐ ”ä Ðbruise,€and€they€were€in€various€stages€of€healing.€€She€had€a€large€fresh€swollen€.€.€.€hematoma€onÐ €Ð Ðher€forehead,€€just€yellow,€green€brown€bruises€all€over.ðð€€Whitson€also€observed€two€areas€ð ðthatÐ l¼ Ðwere€blistered€and€were€consistent€with€cigarette€burns.ðð€€Whitson€identified€photographs€of€theÐ X ¨ Ðvictim€taken€at€the€hospital.€€She€stated€that€it€looked€as€if€one€of€the€bruises€ð ðmight€have€come€fromÐ D!” Ðbeing€kicked.ðð€€Whitson€testified€that€in€her€experience€she€had€seen€only€one€other€child€as€badlyÐ 0"€  Ðbruised€as€this€child,€and€that€child€was€not€alive.€Ð #l! ÐÌà  àOn€cross„examination,€Whitson€testified€that€on€the€night€of€the€incident,€the€victimððsÐ ô$D # Ðgrandfather€told€her€that€the€victim€had€a€bleeding€or€bruising€disorder.€€Whitson€testified€that€sheÐ à%0!$ Ðexamined€the€victimððs€old€hospital€records,€which€indicated€that€a€panel€of€tests€had€been€run€on€theÐ Ì&"% Ðvictim,€but€no€bleeding€or€bruising€disorders€had€been€discovered.€€Whitson€acknowledged€that€someÐ ¸'#& Ðdisorders,€such€as€hemophilia,€and€some€medications,€such€as€those€given€to€induce€thinning€of€theÐ ¤(ô#' Ðblood,€may€cause€bruising.€€She€also€stated€that€there€could€be€other€causes€of€bleeding€disorders€ofÐ )à$( Ðwhich€she€was€not€aware.€€Whitson€testified€that€she€asked€the€victim€if€someone€had€hurt€her,€andÐ ° Ðthe€victim€responded€by€repeating€the€name,€ð ðKenny.ðð€€Whitson€stated€that€the€victim€also€ð ðclinchedÐ œì Ðher€fists€and€.€.€.€made€beating€motions€at€herself.ðð€€When€asked€if€the€victim€could€have€interpretedÐ ˆØ Ðthe€Defendantððs€attempts€to€perform€CPR€on€her€as€being€attempts€to€hurt€her,€Whitson€testified€thatÐ tÄ Ðthe€victim€would€have€been€unconscious€and€would€not€have€been€able€to€identify€the€personÐ `° Ðperforming€CPR€on€her.€€Finally,€Whitson€opined€that€the€bruising€she€saw€on€the€victim€was€notÐ L œ Ðcaused€by€a€bruising€disease€or€by€someone€performing€CPR,€but€was,€rather,€ð ðthe€textbook€patternÐ 8 ˆ Ðfor€long„term€consistent€child€abuse.ðð€Ð $ t ÐÌà  àDr.€Robert€Treece,€a€practicing€pediatrician,€testified€that€on€the€day€of€the€hearing€heÐ ü L  Ðexamined€the€victim€and€found€no€bruising.€€He€testified€that€he€had€reviewed€the€victimððs€medicalÐ è 8  Ðrecords.€€He€stated€that€in€June€1999,€a€panel€of€tests€were€run€on€the€victim,€and€all€of€the€victimððsÐ Ô$  Ðresults€were€within€normal€ranges.€€During€his€testimony,€Dr.€Treece€reviewed€the€photographs€takenÐ À  Ðat€the€emergency€room€on€September€19,€1999€and€testified€that€the€bruising€on€the€victim€was€notÐ ¬ü  Ðconsistent€with€falling.€€Although€Dr.€Treece€testified€that€toddlers€often€have€bruises€on€their€legsÐ ˜è  Ðand€knees,€he€opined€that€the€bruises€in€the€photographs€could€only€have€been€caused€by€physicalÐ „Ô  Ðabuse.€€Ð pÀ ÐÌà  àOn€cross„examination,€Dr.€Treece€testified€that€some€bleeding€problems€that€can€causeÐ H˜ Ðbruising€have€a€genetic€basis.€€Dr.€Treece€testified€that€some€medications€can€cause€bleedingÐ 4„ Ðproblems,€and€consequently,€bruising.€€Dr.€Treece€stated€that€antibiotics€such€as€penicillin€andÐ  p Ðamoxicillin€were€not€likely€to€cause€bruising,€although€they€could€cause€mucosal€bleeding.€€Dr.Ð  \ ÐTreece€stated€that€a€vitamin€deficiency€or€a€clotting€disorder€could€cause€bruising.€€He€did€not€knowÐ øH Ðif€the€victim€had€been€tested€for€a€vitamin€K€deficiency.€€Ð ä4 ÐÌà  àDr.€Treece€testified€that€it€would€be€ð ðpretty€far€fetched€to€link€.€.€.€lice€treatments€and€aÐ ¼  Ðvitamin€deficiency€together€to€cause€hair€loss.ðð€€Dr.€Treece€stated€that€he€did€not€know€if€multipleÐ ¨ø Ðapplications€of€lice€medication€would€cause€hair€loss.€€He€acknowledged€that€there€could€be€manyÐ ”ä Ðcauses€of€alopecia€(hair€loss)€other€than€trauma,€including€stress€and€hypothyroidism.€€He€testifiedÐ €Ð Ðthat€he€had€never€seen€a€child€suffer€hair€loss€as€a€result€of€stress.€€Ô#†X AXXX A#ÔÔ‡X AXXX AÔDr.€Treece€testified€that€a€severeÐ l¼ Ðtinea€fungal€infection€of€the€scalp€could€cause€hair€loss€in€specific€areas,€but€patches€of€hair€loss€areÐ X ¨ Ðð ðusually€more€consistent€with€the€hair€being€pulled€out.ðð€€Dr.€Treece€noted€that€although€theÐ D!” ÐDefendant€had€a€low€potassium€level€in€June€1999,€he€did€not€believe€that€the€victimððs€bruises€wereÐ 0"€  Ðcaused€by€a€potassium€deficiency.€€Ð #l! Ðtestified€that€he€was€in€the€kitchen€when€he€heard€Jasmine€Green€tell€the€victim€to€get€out€of€theÐ $X" Ðbathtub.€€According€to€the€Defendant,€he€went€into€the€bathroom€and€saw€the€victim€ð ðlaying€there.ðð€Ð ô$D # ÐÌà  àThe€Defendant€testified€that€the€victim€was€turning€blue.€€He€stated€that€he€pushed€JasmineÐ Ì&"% ÐGreen€out€of€the€way€and€got€the€victim€out€of€the€bathtub.€€The€Defendant€reported€that€the€victimÐ ¸'#& Ðwas€ð ðreally€clammy.ðð€€He€stated€that€as€he€was€moving€the€victim,€her€body€hit€the€bathroom€door.€Ð ¤(ô#' ÐThe€Defendant€testified€that€he€checked€the€victim€for€a€pulse€and€then€began€CPR.€€He€specified,Ð )à$( Ðð ðI€was€patting€her,€beating€on€her€back.ðð€€The€Defendant€recalled€that€he€yelled,€ð ðCall€911.€€CallÐ |*Ì%) ÐRay.ðð€€He€stated€that€he€put€his€hand€in€the€victimððs€mouth€so€she€could€not€bite€her€tongue.€€TheÐ h+¸&* ÐDefendant€then€noticed€the€victim€take€a€couple€of€deep€breaths.€€He€testified€that€when€RaymondÐ ° ÐGreen€arrived,€Green€held€the€victimððs€head,€and€the€Defendant€held€her€body€because€she€wasÐ œì Ðð ðjerking.ðð€€He€testified€that€the€victim€had€vomited,€and€he€recalled€that€she€had€reflux.€€TheÐ ˆØ ÐDefendant€testified€that€when€the€victim€ð ðcame€around,ðð€she€began€screaming.€€Ð tÄ ÐÌà  àThe€Defendant€testified€that€on€the€day€after€the€victim€went€into€the€hospitalÔ#†X AXXX A-‚#ÔÔ‡X AXXX AÔ,€Sgt.€Frayer€andÐ L œ ÐRita€Parris€came€to€his€home€and€took€photographs€of€the€bathroom.€€Then€the€Defendant€agreed€toÐ 8 ˆ Ðgo€to€ð ðthe€courthouseðð€where€he€was€shown€other€photographs.€€The€Defendant€testified€that€he€toldÐ $ t ÐSgt.€Frayer€what€he€knew€about€the€pictures€that€he€was€shown.€€The€court€questioned€the€DefendantÐ  ` Ðabout€the€amount€of€time€that€the€victim€spent€at€his€house,€but€the€Defendant€denied€that€he€actuallyÐ ü L  Ðkept€the€child€full„time.€€He€stated€that€she€came€to€his€house€four€or€five€days€a€week,€but€only€spentÐ è 8  Ðthe€night€two€or€three€times€a€week.€Ð Ô$  ÐÌà  àThe€Defendant€testified€that€ð ðwhen€youððd€pick€[the€victim]€up,€sheððd€bruise.ðð€€Ô#†X AXXX A%#ÔÔ‡X AXXX AÔThe€Defendant€Ð ¬ü  Ðadmitted€that€he€put€the€hand€print€on€the€victimððs€forehead.€€Ô#†X AXXX A#ÔÔ‡X AXXX AÔHe€recalled€that€she€had€come€from€herÐ ˜è  Ðparentððs€home€and€was€upset.€€The€Defendant€testified€that€the€victim€yelled,€ð ðI€hate€you.€€I€hateÐ „Ô  Ðyou.ðð€€He€stated€that€the€victim€then€ð ðthrew€herself€through€one€of€[his]€bedroom€walls€which€[was]Ð pÀ Ð.€.€.€covered€.€.€.€in€styrofoam.ðð€€He€stated€that€the€victim€ð ðjust€went€crazyðð€and€that€ð ðshe€keptÐ \¬ Ðthrowing€herself€against€walls€and€throwing€herself€on€the€floor.ðð€€The€Defendant€testified€that€heÐ H˜ Ðfinally€had€to€ð ðjust€basically€hold€her€down€cause€she€was€actually€hurting€herself.ðð€€Ð 4„ ÐÌà  àThe€Defendant€testified€that€his€only€prior€conviction€was€for€driving€on€a€suspended€license.€Ð  \ ÐHe€testified€that€he€is€the€sole€provider€for€Jasmine€Green€and€their€son.€€He€reported€that€he€andÐ øH ÐJasmine€Green€planned€to€marry€but€were€financially€unable€to€do€so€at€that€time.€€He€also€testifiedÐ ä4 Ðas€to€his€employment€record.€€The€Defendant€testified€that€he€worked€steadily€even€though€he€hadÐ Ð  Ðto€change€jobs€for€various€reasons,€including€reasons€related€to€these€charges.€€The€employmentÐ ¼  Ðproblems€related€to€these€charges€included€missing€work€for€court€appearances€and€his€convictionÐ ¨ø Ðprohibiting€him€from€selling€alcohol€as€part€of€his€duties€while€working€at€a€gas€station.€€TheÐ ”ä ÐDefendant€anticipated€losing€his€current€job€because€of€excessive€time€spent€in€court€appearances,Ð €Ð Ðbut€he€stated€that€he€already€had€an€offer€for€another€job€where€he€had€previously€worked.Ð l¼ ÐÌà  àThe€trial€court€inquired€as€to€why€the€Defendant€indicated€in€his€statement€that€a€doctor€hadÐ D!” Ðtold€him€to€use€Epsom€salts€on€the€victim€to€help€with€bruising€when€he€could€not€have€taken€theÐ 0"€  Ðvictim€to€a€doctor€because€the€Defendant€did€not€have€custody€of€the€victim.€€The€DefendantÐ #l!
