B.8 WhetherMs.Lawsonwasdeniedeffectiveassistanceofcounsel,inthatdespiteherdiminishedmentalcapacityatthetimessurroundinghercasepreparationandentryofherguiltyplea,defensecounseldidnotmovetheCourtforamentalevaluation.   OnDecember6,1995,thetrialcourtconductedanevidentiaryhearingonthepetition.Therecordofthepleaofguiltywasfiledintheproceedingandthepetitionerandherconvictingtrialcounseltestified. Thepetitionertestifiedshewassufferingfrommentalandemotionalproblemswhenshewasinjailpriortoandatthetimeoftheentryofherpleawhichmadeherunabletounderstandtheproceedingsandvoluntarilywaiveherrightstotrial.Thepetitionerfurthertestifiedherattorneywasincompetentfornotseekingamentalevaluationofherpriortothehearing.Inadditiontothis,thepetitionertestifiedsheoverdosedondrugswhileinjailandthatshewasondrugsatthetimeshepledguilty. Trialcounseltestifiedhedidnotobserveanythingtomakehimbelievethepetitionerwassufferingfromanymental,emotional,ordrugrelatedconditionthatrenderedherincapableofunderstandingwhatshewasdoingwhenshepledguilty. CounseltestifiedtheevidenceofpetitionersguiltofrapewasverystrongandthepleawhichwasnegotiatedwiththeStatewasdonewithherknowledge,consent,andparticipation. Theburdenisuponthepetitionertoprovetheallegationsinthepetitionbyapreponderanceoftheevidence.McBeev.State(655S.W.2d191(Tenn.Crim.App.1983).Thetrialjudgefoundthepetitionerhadfailedtodoso.Thefindingsofthetrialjudgeareconclusiveonappealunlesstheevidencepreponderatesagainstitsjudgment.Statev.Buford,666S.W.2d473(Tenn.Crim.App.1983).
