ÐProgram€and€noted€that€because€the€defendant€had€been€sentenced€to€a€crime€against€the€person,€heÐ `$°" Ðwas€ineligible€according€to€Tennessee€Code€Annotated€Section€40„36„106(a)(2).€Ð P%  # ÐÌà  àThe€trial€court€reviewed€the€sentencing€considerations€set€out€in€Tennessee€Code€AnnotatedÐ 0'€"% ÐSection€40„35„103.€€In€this€regard,€the€trial€court€considered€the€seriousness€of€the€offense,€theÐ  (p#& Ðdefendantððs€potential€for€rehabilitation€or€treatment,€the€required€evaluation€mandated€by€SectionÐ )`$' Ð39„13„705€for€sex€offenders,€and€the€testimony€of€Dr.€Adler.€€The€trial€court€reviewed€TennesseeÐ *P%( ÐCode€Annotated€Section€40„35„114€and€found€two€enhancement€factors:€€ð ð(7)€The€offense€involvedÐ ð*@&) Ða€victim€and€was€committed€to€gratify€the€defendantððs€desire€for€pleasure€or€excitement;ðð€and€ð ð(15)Ð à+0'* ÐThe€defendant€abused€a€position€of€public€or€private€trust,€or€used€a€special€skill€in€a€manner€thatÐ ° Ðsignificantly€facilitated€the€commission€or€the€fulfillment€of€the€offense[.]ðð€€We€agree€that€theseÐ  ð Ðfactors€were€properly€applied.€€As€to€factor€(7),€Dr.€Adler€testified€and€stated€in€his€report€that€theÐ à Ðdefendantððs€strongest€arousal€was€for€adolescent€females,€the€group€which€includes€the€victim.€€Thus,Ð €Ð Ðalthough€this€factor€could€not€be€used€to€enhance€a€sentence€for€sexual€battery€because€it€duplicatedÐ pÀ Ðan€essential€element€of€the€offense,€òòState€v.€Kissingeróó,€922€S.W.2d€482,€489€(Tenn.€1996),€it€wasÐ ` ° Ðproperly€applied€to€the€rape€conviction.€€Factor€(15)€was€properly€applied€because€the€defendant,€asÐ P   Ðthe€boyfriend€of€the€victimððs€mother,€the€father€of€the€victimððs€half„brother,€and€with€all€of€theÐ @  Ðparties€living€under€the€same€roof,€clearly€occupied€a€position€of€private€trust€as€to€the€victim.€Ð 0 € ÐòòKissingeróó,€922€S.W.2d€at€489.€€No€mitigating€factors€were€presented€or€found€by€the€trial€court.€€ItÐ  p  Ðwas€appropriate€for€the€trial€court€to€consider€the€mitigating€and€enhancement€factors€because€theyÐ `  Ðare€relevant€as€a€Section€40„35„103€consideration.€€€òòSeeóó€òòState€v.€Zeoliaóó,€928€S.W.2d€457,€461€(Tenn.Ð P  ÐCrim.€App.€1996).€€The€trial€court€also€considered€the€defendantððs€depression,€alcoholism,€and€priorÐ ð@  Ðrecord,€particularly€the€defendantððs€poor€response€to€past€applications€of€measures€less€restrictiveÐ à0  Ðthan€confinement€when€the€defendant€violated€the€law.€€The€defendantððs€educational€andÐ Ð  Ðemployment€record€and€the€degree€of€support€from€family€and€friends€were€taken€into€considerationÐ À Ðby€the€trial€court.€€Based€upon€all€of€this,€the€trial€court€denied€probation€to€the€defendant.Ð ° ÐÌà  àOur€review€of€the€entire€record€indicates€that€the€trial€court€met€the€requirements€of€òòAshbyóó,Ð à Ðin€that€it€considered€sentencing€principles€and€all€relevant€facts€and€circumstances.€€Our€review,Ð €Ð Ðtherefore,€presumes€that€the€trial€court€correctly€denied€probation.€€The€defendant€bears€the€burdenÐ pÀ Ðof€showing€that€the€determination€of€the€trial€court€was€improper.€€òòAshbyóó,€823€S.W.2d€at€169.Ð `° ÐÌà  àThe€defendant€does€not€challenge€the€trial€courtððs€determination€that€he€is€ineligible€for€theÐ @ Ðstatutory€presumption€of€favorable€candidacy€for€probation€or€the€application€of€the€enhancementÐ 0€ Ðfactors.€€€The€defendant€asserts€instead€that€the€trial€court€failed€to€make€specific€findings€concerningÐ  p Ðthe€considerations€for€sentences€involving€confinement€as€set€out€in€Section€40„35„103(1)€and€(5),Ð ` Ðand€therefore€improperly€based€confinement€on€these€considerations.Ð P ÐÌà  àSubsection€(1)€states:Ð à0 ÐÌÓ-°°‚X" ‡XÐ ÜÜ‹Xü!-Óà8  àà8` Ð Ð à(1)à8" ` x` xàSentences€involving€confinement€should€be€based€on€theÐ À! Ðfollowing€considerations:а" " ¶" ¶ ÐÌà8  àà8` Ð Ð àà8" ` x` xà(A)€Confinement€is€necessary€to€protect€society€byÐ $à" Ðrestraining€a€defendant€who€has€a€long€history€of€criminalÐ €%Ð # Ðconduct;Ðp&À!$" ¶" ¶ ÐÌà8  àà8` Ð Ð àà8" ` x` xà(B)€Confinement€is€necessary€to€avoid€depreciating€theÐ P( #& Ðseriousness€of€the€offense€or€confinement€is€particularlyÐ @)$' Ðsuited€to€provide€an€effective€deterrence€to€others€likelyÐ 0*€%( Ðto€commit€similar€offenses;€orÐ +p&)" ¶" ¶ ÐÐ ,`'* Ðà8  àà8` Ð Ð àà8" ` x` xà(C)€Measures€less€restrictive€than€confinement€haveÐ ° Ðfrequently€or€recently€been€applied€unsuccessfully€to€theÐ  ð Ðdefendant[.]Ðà" ¶" ¶ ÐÌà  àSubsection€(5)€states:Ð pÀ ÐÌà8  àà8` Ð Ð àThe€potential€or€lack€of€potential€for€the€rehabilitation€or€treatment€ofÐ P   Ðthe€defendant€should€be€considered€in€determining€the€sentenceÐ @  Ðalternative€or€length€of€a€term€to€be€imposed.€€The€length€of€a€term€ofÐ 0 € Ðprobation€may€reflect€the€length€of€a€treatment€or€rehabilitationÐ  p  Ðprogram€in€which€participation€is€a€condition€of€the€sentence[.]Ð` ` x` x ÐÌà  àThe€record€shows€that€the€trial€court€specifically€stated€that€the€defendant€had€no€record€ofÐ ð@  Ðfelonies€and€that€his€record€of€misdemeanor€violations€did€not€merit€the€characterization€of€ð ða€longÐ à0  Ðhistory€of€criminal€conduct.ðð€€As€to€subsection€(B),€the€trial€court€did€rely€on€the€seriousness€of€theÐ Ð  Ðcrime€and€noted€that€the€defendant,€although€pleading€guilty€to€attempted€rape,€did€in€fact€€penetrateÐ À Ðthe€victim€on€two€or€three€occasions.€€A€trial€court€may€consider€what€the€evidence€shows€actuallyÐ ° Ðhappened€rather€than€be€restricted€to€considering€only€the€crime€to€which€the€defendant€pled€guilty.€Ð  ð ÐòòSeeóó€òòState€v.€Hollingsworthóó,€647€S.W.2d€937,€939€(Tenn.€1983)€(ð ðIt€is€also€proper€for€a€trial€court€toÐ à Ðlook€behind€the€plea€bargain€and€consider€the€true€nature€of€the€offenses€committed.ðð).€€The€denialÐ €Ð Ðof€probation€has€previously€been€justified€solely€on€the€circumstances€of€the€offense€when€they€wereÐ pÀ Ðof€such€a€nature€as€to€outweigh€all€other€factors€which€might€favor€probation.€€òòSeeóó€òòState€v.€Travisóó,Ð `° Ð622€S.W.2d€529,€533€(Tenn.€1981).€€ð ðThus,€even€though€the€defendant€might€possess€full€capabilitiesÐ P  Ðfor€rehabilitative€alternative€sentencing,€the€trial€judge€[is]€entitled€under€the€law€to€exercise€hisÐ @ Ðdiscretion€to€impose€a€period€of€confinement€under€T.C.A.€ðð€40„35„103(1)(B),€provided€the€recordÐ 0€ Ðadequately€supports€the€weight€he€gave€this€particular€sentencing€consideration.ðð€€òòState€v.€Fletcheróó,Ð  p Ð805€S.W.2d€785,€789€(Tenn.€Crim.€App.€1991).€€Here,€the€record€shows€that€the€defendantÐ ` Ðð ðgroomedðð€the€victim€over€a€period€of€months€and€penetrated€her€on€two€or€three€occasions.€Ð P ÐAlthough€the€defendant€implies€consent,€the€record€shows€that€the€victim€finally€went€to€her€mother,Ð ð@ Ðcausing€the€defendantððs€family€to€insist€that€he€move€out€of€the€house.€€Also,€the€defendant€continuedÐ à0 Ðto€have€contact€with€the€victim,€even€after€he€was€placed€on€bond€for€these€offenses.€€We€concludeÐ Ð  Ðthat€the€evidence€adequately€supports€the€weight€the€trial€court€gave€this€factor.Ð À! ÐÌà  àAs€to€subsection€(C),€the€trial€court€reviewed€the€defendantððs€criminal€record,€which€datedÐ  #ð! Ðback€to€1989,€and€noted€that€it€was€not€ð ðpristine.ðð€€The€trial€court€stated€that€the€defendant€had€priorÐ $à" Ðconvictions€consisting€of€public€intoxication,€disorderly€conduct,€driving€without€a€license,€recklessÐ €%Ð # Ðdriving,€DUI,€possession€of€a€deadly€weapon€with€intent€to€go€armed,€and€possession€of€marijuanaÐ p&À!$ Ðð!ð€all€crimes€for€which€the€defendant€had€received€suspended€sentences.€€According€to€the€trial€court,Ð `'°"% Ðthe€defendant€ð ðhas€experiences€before€the€Court,€has€previously€been€placed€on€probation€on€moreÐ P( #& Ðthan€one€occasion.€€Those€would€be€negative€factors€also.ðð€€The€record€also€shows€that,€whileÐ @)$' Ðreleased€on€bond€for€the€present€offenses,€the€defendant€was€charged€with€DUI,€second€offense,€andÐ 0*€%( Ðleaving€the€scene€of€an€accident.€€Ð  +p&) ÐÐ ,`'* Ðà  àFinally,€the€defendant€contends€that€the€trial€court€should€have€found€that€he€had€potentialÐ ° Ðfor€rehabilitation€and€treatment.€€On€this€issue,€the€trial€court€pointed€to€the€lack€of€empathy€for€theÐ  ð Ðvictim€and€victim€blaming€exhibited€by€the€defendant.€€A€defendantððs€failure€to€accept€responsibilityÐ à Ðfor€his€crimes€is€germane€to€his€potential€for€rehabilitation.€€òòZeoliaóó,€928€S.W.2d€at€463.€€The€trialÐ €Ð Ðcourt€also€noted€the€defendantððs€continued€abuse€of€alcohol,€even€after€completing€an€intensiveÐ pÀ Ðoutpatient€alcohol€treatment€program€on€March€11,€1999.€€The€defendant€admitted€to€an€episode€withÐ ` ° Ðalcohol€in€April€1999.€€The€defendant€also€stated€at€the€hearing,€ð ðNow€as€far€as€the€allegations€went,Ð P   Ðthat€was€why€I€made€an€Alford€plea,€because€the€allegations€werenððt€even€close€to€being€true€butÐ @  Ðthere€was€inappropriate€contact€on€my€behalf.ðð€€Later,€the€defendant,€in€evaluating€the€costs€of€thisÐ 0 € Ðoffense,€focused€almost€exclusively€on€himself,€stating€that€ð ðitððs€just€cost€me€everything.ðð€€AlthoughÐ  p  Ðthe€trial€court€gave€a€great€deal€of€weight€to€Dr.€Adlerððs€testimony€concerning€the€defendantððsÐ `  Ðamenability€to€treatment,€the€court€noted€that€Dr.€Adlerððs€testimony€only€established€that€theÐ P  Ðdefendantððs€chances€of€reoffending€were€moderate€to€low€with€treatment.€€The€record€indicates€thatÐ ð@  Ðthe€trial€court€appropriately€weighed€the€defendantððs€potential€for€rehabilitation€or€treatment.€Ð à0  ÐAccordingly,€there€is€substantial€evidence€to€support€the€trial€courtððs€denial€of€probation.Ð Ð  ÐÌò òÓ  ÓCONCLUSIONó óÐ ° ÐÌÓ×lÓà  àIt€is€clear€from€our€review€of€the€entire€record€that€the€trial€court€considered€the€relevantÐ à Ðprinciples€of€the€Criminal€Sentencing€Reform€Act€of€1989€and€all€relevant€facts€and€circumstancesÐ €Ð Ðof€this€case.€€Our€òòde€novoóó€review€has,€therefore,€been€conducted€with€a€presumption€that€theÐ pÀ Ðdeterminations€of€the€trial€court€are€correct.€€We€conclude€that€the€defendant€has€failed€to€meet€hisÐ `° Ðburden€of€showing€that€the€sentence€was€improper€and,€accordingly,€affirm€the€judgment€of€the€trialÐ P  Ðcourt.Ð @ ÐÌÌÌà  àà ` àà " àà  àà h àà À àà  à_______________________________________€Ð P Ðà  àà ` àà " àà  àà h àà À àà  àALAN€E.€GLENN,€JUDGE
