Theappellantcontendsthathepledguiltyonlybecausehisattorneytoldhimhewouldservetwoandonehalfyearsoftheeightyearsentenceofferedinthepleaagreement.Theappellantalsoallegedthathisattorneyfailedtoinvestigatehiscase,failedtodiscusstrialstrategy,failedtofilemotionsonhisbehalf,andfailedtoprepareforhistrial. Anassistantpublicdefender,SherryBrooks,wasappointedtorepresenttheappellantontheoriginalcharges.Atthehearingontheappellantspetition,Ms.Brookstestifiedthatsheinterviewedtheappellantafterhewasarraigned.Ms.Brookstestifiedthattheappellanttoldherthathedidnotwantajurytrial.Headmittedthathecommittedthecrimes.Ms.Brookstestifiedthattheappellantwasadamantaboutpleadingguiltyonarraignmentday.Brookstestifiedthatshereadthroughthestatesfilesonthecharges.Thevictimofeachoffensehadpositivelyidentifiedtheappellantastheperpetrator.Theappellantgaveastatementtothepoliceinwhichheconfessedtotheaggravatedrobbery.Ms.Brookstestifiedthatshediscussedthestatesproofandthestatesofferwiththeappellant.Thereafter,theappellantpledguilty. TheappellanttestifiedthathepledguiltybecauseMs.Brookstoldhimthathewouldserveapproximatelytwoandonehalfyearsofhissentence.Hetestifiedthathethoughtthatthiswasagooddealsohepledguilty.TheBoardofParolesdeniedtheappellantparolebecausehewasinvolvedinfightswhileservinghissentenceinprison.TheappellanttestifiedthatMs.Brooksfailedtodiscusshiscase,hisstatement,andtrialstrategywithhim.TheappellantadmittedthathetoldthejudgeatthepleahearingthatMs.Brookshaddiscussedhiscasewithhimandthatheunderstoodhisconstitutionalrights.TheappellanttestifiedthatheansweredthetrialcourtsquestionsaffirmativelybecauseMs.Brookstoldhimtoagreewitheverythingthatthecourtsaid. Ms.Brookstestifiedthatshenevertoldtheappellantthathewouldbereleasedintwoandonehalfyears.Ms.Brooksdeniedinstructingtheappellanttoagreewitheverythingthatthejudgesaid. Theappellanttestifiedthatifthetrialcourtgrantedhispetitionforpostconvictionrelief,thenhewouldgototrial.Hetestifiedthatifhisstatementwassuppressedthatavictoryattrialonthetheftcharge wouldbeguaranteed.Theappellantdidnotestablishwhyhisstatementwaslikelytobesuppressed.Hemadenoshowingastohowhewaslikelytobefoundnotguiltyontheaggravatedrobberycount.Ms.Brookstestifiedthattheappellantwouldhavebeenconvictedofbothoffenses,evenifthestatementhadbeensuppressedbecausethevictimshadidentifiedtheappellantastheperpetrator.̀ Thetrialcourtdeniedtheappellantspetition.Thecourtfoundthattheappellantenteredhispleasvoluntarily.Thecourtnotedthatthetrialcourtcarefullyexplainedtotheappellanthisconstitutionalrightsbeforeacceptinghisguiltypleas.Thecourtfoundthattheappellantfailedtoestablishthathisattorneyhadrenderedineffectiveassistanceofcounsel.   X  Inorderforthepetitionertobegrantedreliefongroundsofineffectiveassistanceofcounsel,heorshemustestablishthattheadvicegivenortheservicesrenderedwasnotwithinthe"rangeofcompetencedemandedofattorneysincriminalcases"andthat,butforcounsel'sdeficientperformance,theresultofhistrialwouldhavebeendifferent.Stricklandv.Washington,466U.S.668(1984);Baxterv.Rose,523S.W.2d930,936(Tenn.1975).Thistwopartstandard,asitappliestoguiltypleas,ismetwhenthepetitionerestablishesthat,butforhiscounsel'serror,hewouldnothavepleadedguiltyandwouldhaveinsistedontrial.Hillv.Lockhart,474U.S.52,59(1985). Theburdenisonthepetitionertoshowthattheevidencepreponderatesagainstthefindingsofthetrialjudge.Clennyv.State,576S.W.2d12,14(Tenn.Crim.App.1978).Otherwise,thefindingsmadebythetrialcourtareconclusive.Gravesv.State,512S.W.2d603,604(Tenn.Crim.App.1973) Theappellanthasfailedtoshowthattheevidencepreponderatesagainstthetrialcourtsfindings.Theappellantsprimaryargumentisthathepledguiltybecausehisattorneytoldhimthathewouldonlyservetwoandonehalfyears.Theappellant,however,admittedthatheunderstoodthathissentencewaseightyearswitha30%releaseeligibilitydate.Ms.Brooksdeniedthatshetoldtheappellantthathewouldbereleasedintwoandonehalfyears.Thecourtfoundhertestimonycredible. Therecordsupportsthecourtsfindingthattheappellantfailedtoshowthathereceivedineffectiveassistanceofcounsel.Ms.Brookstestifiedthattheevidenceinthestatesfileswouldhavemostlikelyledtoconvictionsonbothoffenses.Shetestifiedthattheappellantwasadamantaboutpleadingguiltyonarraignmentday.Wefindherrepresentationappropriateandeffective.
