Appellantwasindictedforfirstdegreepremeditatedmurderandfelonymurderforthe1992robberyandmurderofMichaelYeary.Aspartofapleaagreement,theappellantpledguiltytoseconddegreemurder.Healsoconsentedtoanamendmenttotheindictmenttoincludeachargeofespeciallyaggravatedrobbery,towhichhealsopledguilty. &   ׀Theagreementrecommendedasentenceoftwentyfive(25)yearsoneachcounttobeservedconsecutivelyforaneffectivesentenceoffifty(50)yearsasaRangeIoffender.OnApril5,1993,thetrialcourtacceptedthepleaagreementandsentencedappellantaccordingly. OnFebruary7,1996, '   ׀appellantfiledaprosepetitionforpostconvictionreliefallegingtheineffectiveassistanceofcounselandthathispleawascoerced.Aftertheappointmentofcounsel,thepetitionwasamendedtoincludetwofactuallyspecificgrounds.Theamendedpetitionallegedthatappellantsguiltypleaontheamendedoffenseofespeciallyaggravatedrobberywascoercedbecausethetrialcourtfailedtoadequatelyadvisetheappellantaboutwaiveroftherighttoagrandjuryproceedingonthatcharge.Furthermore,thepetitionallegedthatcounselwasineffectiveforfailingtoobjecttothetrialcourtsinadequateexplanationofthatright. Priortothesubmissionofproofattheevidentiaryhearing,theStatemovedfordismissalofthepetition,assertingthatappellantsclaimsrelatingtotheamendmentoftheindictmentdidnotallegeaconstitutionalviolationandthattheremainingclaimswerenotsupportedbytherequisitefactualallegations.SeeTenn.CodeAnn.4030206(d)(Supp.1996).Afterhearingtheargumentsofcounsel,thetrialcourtdismissedappellantspetitionandlaterenteredawrittenorderofdismissal. Areviewoftherecordindicatesthatthetrialcourtdidnoterrinfailingtoholdanevidentiaryhearing.Thetranscriptoftheguiltypleahearingclearlyreflectsthatthetrialcourtfullyexplainedandadvisedtheappellantabouthisrighttograndjuryreviewoftheespeciallyaggravatedrobberycharge.Thetranscriptfromthathearingindicatesthatthetrialcourtexplainedtherightofgrandjuryreviewtotheappellantonthreeseparateoccasionsduringthehearing,thatcounselexplainedittoappellantinopencourt,andthatappellantconferredwithhiscounselprivatelyonseveraloccasions.Neartheconclusionoftheguiltypleahearing,thecourtmadeafinalexplanationtoensuretheappellantsunderstanding.Appellantsaffirmativeresponsestothetrialcourtsquestionsindicatedanunequivocalwaiveroftherighttograndjuryreviewinexchangeforthepleaagreement. Theremaininggroundsofineffectiveassistanceofcounselandcoercionwerenotsupportedbytherequisitefactualbasisandwereproperlydismissed.Tenn.CodeAnn.4030206(d)(Supp.1996).Althoughappellanthadthebenefitofcounsel,theoriginalgroundsforreliefwerenotamendedtoincludeparticularfactualallegations.Moreover,thetrialcourtnotedthatanytestimonytheappellantcouldofferatahearingwouldbecontradictorytohispreviousstatementsattheguiltypleahearingand,therefore,insufficienttosustainhisallegationsbyclearandconvincingevidence.SeeTenn.CodeAnn.4030210(f)(Supp.1996).Weagree.
