OnMarch15,1994,theappellantwasindictedinWilsonCountyonsixcountsofaggravatedsexualbattery.Subsequently,onJanuary17,1995,theappellantpledguiltytoonecountofaggravatedsexualbatteryandwassentencedasaRangeIstandardoffenderto8yearsintheTennesseeDepartmentofCorrection.OnDecember5,1996,theappellantfiledhispetitionforhabeascorpusrelief.Counselwasappointed,andthepetitionwasamended.AfterahearingonFebruary24,1997,thestatesmotiontodismissthepetitionwasgranted.  Inthisappeal,theappellantcontendsfirstthatT.C.A.3913504(1994Supp.)failedtoadequatelyinformhimofthemeaningof unlawfulsexualcontact,makingthestatuteconstitutionallyvague,however,thistermwasfullydefinedinT.C.A.3913501(6)(1991).Next,theappellantassertsthattheindictmentfailedtoinformhimwithspecificitywhatconductheallegedlyperformedthatwasillegal.Inparticular,hecontendsthattheindictmentdidnotallegewhatunlawfulsexualcontactwascommitted.TheappellantcouldhavefiledamotionforbillofparticularspursuanttoTenn.R.Crim.P.7(c)butdidnot,therebywaivingtheissue.  Finally,theappellantassertsthathispetitionforwritofhabeascorpusshouldbeconsideredasapostconvictionpetition.TheappellantpledguiltyonJanuary17,1995,andthispetitionwasfiledonDecember5,1996.Accordingly,theappellantwouldnotbeentitledtopostconvictionreliefbecausethepetitionwasfiledoutsidethetimeallowedbytheapplicablestatuteoflimitation.Moreover,theappellanthasfailedtoallegeanyoftheenumeratedexceptionssetforthinT.C.A.4030202(b).    Havingreviewedtheappellantsbrief,thestatesmotion,theappellantsresponse,andtheentirerecord,wefindthatthestatesmotioniswelltaken.  ITIS,THEREFORE,ORDEREDthatthestatesmotiontoaffirmthejudgmentofthetrialcourtpursuanttoRule20,TennesseeCourtofCriminalAppealsRulesisgrantedandthejudgmentofthetrialcourtisaffirmed.Theappellantbeingindigent,costsaretaxedtothestate.
