àThe€defendant€was€involved€in€an€accident€several€years€prior€to€theÏcommission€of€the€crimes€in€question.€€He€suffered€an€injury€to€his€spinal€cord€and€isÏnow€paralyzed€from€his€chest€down€to€his€feet.€€He€has€no€feeling€in€this€portion€of€hisÏbody.€€He€is€confined€to€a€wheelchair.Ìà àDuring€the€summer€of€1995,€the€defendant€visited€Highland€Park€practicallyÏevery€day.€€He€met€several€of€the€children€who€attended€a€supervised€camp€at€theÏpark.€€There€were€two€people€who€supervised€the€children.Ìà àIn€July€of€1995€the€defendant€was€visiting€the€park.€€He€asked€C.M.€and€A.Y.,× ƒ2 ××  ×Ïtwo€very€young€girls,€to€show€him€the€genital€area€of€their€respective€bodies.€€Both€C.M.Ïand€A.Y.€complied€with€the€defendantððs€request.€€The€defendant€then€touched€theÏgenital€area€of€both€girls.Ìà àThe€defendant€testified€in€support€of€his€defense.€€He€related€he€was€at€a€benchÏwith€several€children€when€A.Y.€revealed€the€genital€area€of€her€body€while€sitting€onÏthe€bench.€€According€to€the€defendant,€C.M.€was€behind€a€tree€revealing€the€genitalÏarea€of€her€body.€€He€stated€€he€left€the€bench€area€and€went€towards€a€stage,€andÏthen€towards€a€pavilion€where€the€supervisors€congregated.€€He€blamed€a€young€boy,ÏG.L.S.,€for€what€occurred.€€He€testified€G.L.S.€ð ðinstigated€what€happened€out€there€inÏthe€park.ðð€€He€denied€asking€the€girls€to€reveal€the€genital€area€of€their€bodies,€and€heÏdenied€touching€either€victim.ÌÌò òÓ  ÓI.ó óÌÓ  ÓÌà àThe€defendant€contends€the€evidence€contained€in€the€record€will€not€support€aÏfinding€by€a€rational€trier€of€fact€finding€that€he€was€guilty€of€the€offenses€in€questionÏbeyond€a€reasonable€doubt.€€He€argues€ð ðthe€inconsistencies€in€the€stories€of€the€minorÏvictims,€when€considered€in€conjunction€with€the€locations€described€in€the€proof€andÏthe€numerous€people€in€the€area,€make€it€highly€improbable,€if€not€impossible€for€theÏoffenses€€to€have€occurred.ðð€€In€short,€the€defendant€wants€this€œ›œCourt›€to€redetermineÏthe€credibility€of€the€young€victims.Ìà ðA€guilty€verdict€by€the€jury,€approved€byÏthe€trial€judge,€accredits€the€testimony€of€the€witnesses€for€the€State€and€resolves€allÏconflicts€in€favor€of€the€State.ðð€€In€other€words,€this€œ›œCourt›€cannot€redetermine€theÏcredibility€of€the€youthful€witnesses.€€The€issues€of€credibility€and€believability€wereÏdetermined€by€the€jury.Ìà ÒMR.€THOMPSON:€Now€we€had€one€child€in€here€who€mightÏbe€a€doubt,€but€weððve€got€three€children€who€say€itÏhappened€to€them,€and€weððve€got€another€child,€a€fourthÏchild,€it€didnððt€happen€to€him,€[GLS],€but€he€saw€it€happen€toÏone€of€the€children.€€I€submit€to€you€in€taking€this€case€in€itsÏtotality,€that€your€verdict€should€be€guilty€as€charged.€€ÌÌMR.€MOSIER:€Your€Honor€please,€I€want€to€object€to€thatÏline€of€argument.ÌÌTHE€COURT:€All€right,€note€your€exception.ÌÌMR.€THOMPSON:€Because€each€of€these€children,€byÏstating€what€happened,€corroborate€each€other.ÌÌÌÒ  ÒÒ  ÒÒ  ÒÒ X ÒÓÓThis€is€the€only€part€of€the€stateððs€summation€contained€in€the€record.€€The€balance€ofÏthe€summation€was€not€transcribed.Ìà àAs€a€general€rule,€this€œCourt›€is€to€consider€the€context€of€a€statement€by€anÏassistant€district€attorney€general€in€the€context€of€the€entire€summation.€€The€œCourt›Ïcannot€do€this€in€this€case€because€the€vast€majority€of€the€stateððs€summation€was€notÏtranscribed.€€Nevertheless,€the€trial€court€did€not€abuse€its€discretion€by€overruling€theÏdefendantððs€argument€to€this€portion€of€the€stateððs€summation.€€The€two€victims€wereÏtogether€most€of€the€time.€€They€were€together€when€the€defendant€asked€them€toÏshow€him€their€respective€genital€areas.€G.L.S.€saw€the€defendant€touching€the€genitalÏarea€of€C.M.€€Thus,€the€testimony€of€the€three€children€supports€the€stateððs€theory.€€ÍFurthermore,€the€testimony€of€each€victim€corroborated€the€testimony€given€by€theÏother€victim.€€As€the€assistant€district€attorney€general€stated,€he€was€simply€suggesting€Ïthe€testimony€of€corroboration€given€by€the€witnesses€should€be€considered€along€withÏthe€testimony€of€each€victim.€€The€assistant€district€attorney€general€was€not€attemptingÏto€have€the€jury€consider€all€three€crimes€in€determining€the€guilt€of€the€defendant€inÏeach€individual€case.€€Thus,€the€trial€court€did€not€abuse€its€discretion€by€overruling€theÏdefendantððs€objection.Ìà àThis€issue€is€without€merit.ÌÌò òÓ  ÓIV.ó óÌÓ  ÓÌ€à àThe€defendant€contends€the€trial€court€did€not€comply€with€the€provisions€of€theÏCriminal€Sentencing€Reform€Act€of€1989.€€The€State€of€Tennessee€states€ð
