DistrictAttorneyGeneral       GREGNEWMAN       Asst.DistrictAttorneyGeneral       P.O.Box526       Blountville,TN376170526 OPINIONFILED:________________AFFIRMEDANDREMANDEDCURWOODWITT,JUDGE @ OPINION   Thedefendant,GeraldScottLong,appealsthemannerofserviceofhisconcurrentelevenmonth,29daysentencesforhismisdemeanorconvictionsofcasualexchangeandrecklessendangerment.ThelengthofLong'ssentenceswereagreeduponaspartofaguiltypleasettlement,andthemannerofservicewasleftfordeterminationbytheSullivanCountyCriminalCourt.Followingahearing,thecourtdeniedalternativesentencingandorderedLongtoservehissentencesinthecountyjail. 0   ׀Inthisdirectappeal,Longclaimsheshouldhavereceivedprobationorsomeotherformofalternativesentencing.Followingareviewoftherecord,weaffirmthejudgmentofthetrialcourtinsofarassentencingisconcerned.However,weremandthismattertothetrialcourtforcorrectionofanerroronthejudgmentformincaseS37,948.@ I   Indeterminingwhetherthetrialcourthasproperlysentencedanindividual,thiscourtengagesinadenovoreviewoftherecordwithapresumptionthatthetrialcourt'sdeterminationswerecorrect.Tenn.CodeAnn.4035401(d)(1997).Thispresumptionis"conditionedupontheaffirmativeshowingintherecordthatthetrialcourtconsideredthesentencingprinciplesandallrelevantfactsandcircumstances.Statev.Ashby,823S.W.2d166,169(Tenn.1991).Inconductingourdenovoreview,wemustconsidertheevidenceatsentencing,thepresentencereport,thesentencingprinciples,theargumentsofcounsel,thestatementsofthedefendant,thenatureandcharacteristicsoftheoffense,anymitigatingandenhancementfactors,andthedefendantsamenabilitytorehabilitation.Tenn.CodeAnn.4035210(b),4035103(5)(1997);Ashby,823S.W.2dat168.Onappeal,theappellanthastheburdenofshowingthatthesentenceimposedisimproper.Tenn.CodeAnn.4035401(d),SentencingComm'nComments(1997);Ashby,823S.W.2dat169.  Wefindthatthetrialcourtsentencedthedefendantinaccordwiththestatutoryframework;therefore,itsdeterminationisentitledtothepresumptionofcorrectness.  Atthesentencinghearing,theentiretyoftheevidenceconsistedofthepresentencereportandastipulationofthedefendant'sworkhistory.Therecordreflectsthatthedefendantisa27yearoldsinglefatheroftwochildren.Therecorddoesnotreflectwhetherheisthecustodialparentofeitherofhischildren.Hehadbeenemployeduntilhelosthisjobasaresultofbeingindictedfortheinstantoffenses.Thereafter,hebecameselfemployed.Hehasalengthyhistoryofwhatthetrialcourtcharacterizedas"petty"offensesspanningthetwelveyearspriortotheinstantoffenses.Notably,hehasbeengivenpastchancestorehabilitatehimselfthroughprobation,drugtreatment,shockincarceration,andthelike,yethehascontinuedtodisregardthelaw.Thedefendant'scriminalhistoryisnotablefornumerouspreviousspeedingconvictions,arecklessendangermentconvictionandarecklessdrivingconviction.Accordingtotheofficer'sstatementinthepresentencereport,theinstantrecklessendangermentchargearosefromdangerousdrivingandexcessivespeed.Thedefendantlefttheroadway,almosthittingtelephonepoles.Hedisregardedtrafficcontrols.Theofficerpursuedthedefendantatspeedsreaching113milesperhourandultimatelydiscontinuedthepursuitduetothedefendant'sdangerousactions.Thedefendant'scriminalhistoryalsoincludedaviolentoffense.TwoofficersfromthepolicedepartmentopposedprobationforthedefendantbecausetheybelievedthedefendantwasamajordrugdealerinKingsportandbecausethedefendantwasnottruthfulafterhisarrest.Oneoftheofficersalsoreportedthatthedefendantwasnotcooperativeafterhisarrest.  Infindingthedefendantanunsuitablecandidateforalternativesentencing,thetrialcourtrelieduponhispastcriminalhistoryandthefailureoflessrestrictiveandrehabilitationorientedsentencingimposedforprioroffenses.SeeTenn.CodeAnn.4035103(1)(A),(1)(C),(5)(1997).Thecourtfoundtheseconsiderationsweightyincomparisontofavorableevidenceofthedefendant'sgoodworkhistory.Moreover,thecourtapparentlyconsideredthedefendant'sconcernthatheneededtobeabletorunhisbusinessessothathecouldsupporthischildrenbecausethecourtimposed0%servicepriortoeligibilityforworkrelease.  Inattemptingtomeethisappellateburden,Longconclusorilyarguesthatthe"denialofprobationmakesnosenseandisinconsistentwiththeoverallpolicy"oftheSentencingAct.Hefurtherclaimsthatthe"proofsummarizedbycounselandtheobjectivecriteria...favors,ifnotpresumes,agrantingofprobationoralternativesentencinginthiscase."Heoffersnospecificspertinenttohiscasetosupportthesearguments.Further,heclaimsthatadenialofprobationshouldbereverseduponashowingthatthedefendantisnotafirstpriorityforincarcerationunderCodesection4035102(5),hasnotbeenthesubjectoffailedrehabilitativemeasures,isnotaviolentcriminal,andshowspotentialforrehabilitation;however,therecorddemonstratesthatthisdefendantisnotsuchanindividual.Simplyput,weareunpersuadedbythedefendant'sarguments.Hehasfailedtocarryhisburdenofshowingthatthemannerofserviceimposedbythetrialcourtisimproper.SeeTenn.CodeAnn.4035401(d),SentencingComm'nComments(1997);Ashby,823S.W.2dat169.@ II   Ourreviewoftherecordhasrevealedanirregularityonthejudgmentformforthecasualexchangeconviction,casenumberS37,948.TheconvictionisclassifiedonthejudgmentformasaClassCmisdemeanor;however,casualexchangeisaClassAmisdemeanorunlessaggravatingcircumstancesarepresenttoelevateittofelonyclassification.SeeTenn.CodeAnn.3917418(1997).Thisirregularitymustbecorrectedbythetrialcourt.
