Afterareviewoftherecord,weaffirmthedecisionofthetrialcourt. Thetrialcourtdismissedtheappellantspetitionforfailuretostateagroundforwhichhabeasreliefwasavailable.Theappellantasserts,relyingexclusivelyuponfederalhabeascorpuslaw,thatthe defectiveindictmentagainsthimeffectivelydeniedthetrialcourtthejurisdictiontoenterajudgmentagainsthim,thereby,renderinghisconvictionsvoid.Werejectthisargumentbytheappellant.InTennessee,habeascorpusreliefisonlyavailablewhenaconvictionisvoidbecausetheconvictingcourtwaswithoutjurisdictionorauthoritytosentenceadefendant,orthatadefendant'ssentencehasexpiredandheisbeingillegallyrestrained.Archerv.State,851S.W.2d157,164(Tenn.1993).Itiswellestablishedthatallegationsconcerningthesufficiencyoftheindictmentarenotthepropersubjectofstatehabeascorpusrelief.SeeHaggardv.State,475S.W.2d186,187(Tenn.Crim.App.1971);Brownv.State,445S.W.2d669,674(Tenn.Crim.App.1969);Barberv.State,No.01C019408CR00281(Tenn.Crim.App.atNashville,Feb.23,1995).Clearly,theappellantisattemptingtoexpandthescopeofhabeascorpusinTennesseetothatwhichappliesinthefederalcourts.See28U.S.C.S.2241etseq.However,wearenotobligatedtoincorporatefederalhabeaslimitsandlawsintoourstateprocedure.Turksv.State,No.02C019502CR00035(Tenn.Crim.App.atJackson,Jan.3,1997).Thisargumentiswithoutmerit. Moreover,wefindthesubstanceoftheappellantsclaimtobewithoutmerit.Theappellant,inhisapplicationforwritofhabeascorpus,allegesthatthejudgmentsenteredagainsthimfortheoffensesofrapeofachild,aggravatedrape,andaggravatedsexualbatteryarevoidbecausetheindictmentfailstoallegethemensreaoftheoffensescharged.Inorderforanindictmenttosatisfybothconstitutionalandstatutoryguidelines,itmustcontainthematerialelementsoftheoffenseandmustsufficientlyapprisetheaccusedoftheoffenseheiscalledupontodefend.Statev.Tate,912S.W.2d785,789(Tenn.Crim.App.1995);seealsoTenn.CodeAnn.4013202(1990);Statev.Perkinson,867S.W.2d1,5(Tenn.Crim.App.1992).Norequisitementalstateisincludedinthedefinitionoftheseoffenses.SeeTenn.CodeAnn.3913522(1994Supp.);Tenn.CodeAnn.3913502(1994Supp.);Tenn.CodeAnn.3913504(1994Supp.).Whenthelegislaturefailstodefineaspecificmentalstateinthedefinitionofanoffense,permittingproofofeitherintent,knowledge,orrecklessness,Tenn.CodeAnn.3911301(c)(1991),anallegationofcriminalconductwillprovidetheaccusedconstitutionallyadequatenoticeofthefactsconstitutingtheoffense.Moreover,sinceunderthesecircumstances,theaccused'smentalstateisnotamaterialelementoftheoffenseandneednotbeincludedintheindictment,theappellantschallengeisnotjurisdictionalinnature,i.e.,adefectthatrenderstheindictmentvoid.Statev.Dison,No.03C019602CC00051(Tenn.Crim.App.atKnoxville,Jan.31,1997)(citationsomitted).Otherpanelsofthiscourthaveupheldthevalidityofindictmentsundersimilarchallenges.See,e.g.,Slaglev.State,No.03C019704CR00145(Tenn.Crim.App.atKnoxville,June25,1997);Statev.Vann,No.03C019602CC00066(Tenn.Crim.App.atKnoxville,June10,1997);Statev.James,No.01C019601CR00016(Tenn.Crim.App.atNashville,Mar.27,1997);Statev.Burrell,No.03C019404CR00157(Tenn.Crim.App.atKnoxville,Feb.11,1997).
