Havingreviewedthestatesmotioninlightofthepetitionersbriefandtherecordasawhole,weconcludethatthemotioniswelltakenandshouldbegranted.Indismissingthepetition,thetrialcourtfoundthatthepetitionerhadfailedtoshowuponthefaceofthejudgmentortherecordoftheproceedingsuponwhichthejudgmentwasrenderedthattheconvictingcourtwaswithoutjurisdictionorauthoritytosentencethepetitionerorthatthepetitionerssentenceofimprisonmentorotherrestrainthasexpired.SeeStatev.Archer,851S.W.2d157(Tenn.1993).  Weagreewiththetrialcourtsruling.Theconvictingcourtinthiscasehadjurisdictionoverboththesubjectmatterandperson,andnothingintherecordbeforeusdemonstratesthattheconvictingcourtsactionswereunauthorized.Norhasthepetitionershownthathissentencehasexpired.Contrarytothepetitioner'sargument,theTennesseeCriminalSentencingReformActof1989,whichrepealedthestatuteunderwhichthepetitionerwasconvictedandsentenced,specificallystatesthat"[t]hisactshallnotaffectrightsanddutiesmatured,penaltiesthatwereincurred,orproceedingsthatwerebegunbeforeitseffectivedate."1989Tenn.Pub.Actsch.591,115.SeealsoStateexrel.Stewartv.McWherter,857S.W.2d875(Tenn.Crim.App.1992);Statev.Russell,866S.W.2d578(Tenn.Crim.App.1991).Therefore,sincethepetitionerisnotchallengingtheappropriatenessofhissentenceatthetimeitwasimposed,hispresentclaimmustfail.  Accordingly,wecannotfindanyerroronthepartofthetrialcourtindismissingthepetition.ItisthereforeORDEREDthatthestatesmotionisgranted.PursuanttoRule20oftheRulesoftheCourtofCriminalAppeals,weaffirmthetrialcourtsdismissalofthepetitionerspetitionforwritofhabeascorpus.
