Мexposure.𛀀HereceivedathreeyearsentenceinTexaswhichwasorderedtobeservedon communitysupervision.  ` OnMarch10,1998,afterconductinganevidentiaryhearingontheprobationviolationwarrant,thetrialcourtfoundthattheDefendantwasinviolationofthetermsofhisprobation.ThecourtorderedtheprobationrevokedandthebalanceoftheDefendantssentenceservedintheDepartmentofCorrection.ItisfromtheorderofthetrialcourtdirectingthatthebalanceoftheDefendantssentencebeservedinconfinementthattheDefendantappeals. ` Whenaprobationrevocationischallenged,theappellatecourtshavealimitedscopeofreview.Foranappellatecourttobewarrantedinfindingatrialjudgeerredindeterminingthataviolationhasoccurred,therecordmustcontainnosubstantialevidencetosupporttheconclusionofthetrialjudge.Statev. "0 Harkins,811S.W.2d79,82(Tenn.1991).Iftheviolationissosupportedbythe $  record,thejudgmentofthetrialcourtrevokingprobationwillnotbedisturbedonappealunlessitappearsthatthetrialcourtactedarbitrarilyorotherwiseabuseditsdiscretion.Statev.Williamson,619S.W.2d145,146(Tenn.Crim.App. P* " 1981). ` Whenatrialjudgegrantsasuspendedsentence,thatjudgedemonstratesacertainamountofconfidencethattheDefendantwillleadalawfullife.WhentheDefendantssubsequentactionsviolatethatconfidence,certainlythetrialjudgeagainexercisesdiscretionindeterminingwhetherthesuspendedsentenceshouldberevoked.Davenportv.State,381S.W.2d276,279(Tenn.1964);Thompsonv. 7.0 State,279S.W.2d261,262(Tenn.1955).TheDefendantssubsequentactions 9p02 mayindicatethattheinitialdecisiontosuspendthesentencewasamistake.Allprobationersaredeemedtobeonnoticethattheymaynotengageinunlawfulactivityorotherwiseconductthemselvesinconsistentlywithgoodcitizenshipiftheyaregrantedprobationinsteadofincarceration.Robertsv.State,546 0 S.W.2d264,265(Tenn.Crim.App.1976). ` TheDefendantconcedesthathisfelonyconvictioninTexasconstitutesaviolationofthetermsofhisTennesseeprobation.Heargues,however,thatthetrialjudgeabusedhisdiscretionbyorderingthebalanceoftheDefendantseightyearsentencetobeservedintheDepartmentofCorrection.HearguesthatthisϜCourtshouldremandthecaseanddirectthetrialjudgetoplacetheDefendantbackonprobation. ` Atrialcourtisvestedwiththestatutoryauthorityto revoketheprobationandsuspensionofsentenceandcausethedefendanttocommencetheexecutionofthejudgmentasoriginallyentered.Tenn.CodeAnn.4035311(d).Furthermore,whenprobationisrevoked, theoriginaljudgmentsorenderedbythetrialjudgeshallbeinfullforceandeffectfromthedateoftherevocationofsuchsuspension.Tenn.CodeAnn.4035310.Thetrialjudgeretainsthediscretionaryauthoritytoorderthedefendanttoservetheoriginalsentence.SeeStatev.Duke,902S.W.2d424,427(Tenn.Crim.App.1995).  0&(  ` TheDefendant,whowasalreadyonprobationforafelony,committedanotherfelony.Underthesecircumstances,theDefendantsargumentthatheisentitledtoasecondgrantofprobationisnotparticularlypersuasive.ThetestimonygivenbythiseDefendantatthehisrevocationhearingdemonstrateslittle, 9p02 ifany,assurancethathewouldbeunlikelytoviolatehisprobationagainwereheallowedtocontinuetoservehissentenceonprobation.Thiswasobviouslyalsotheconclusionofthetrialjudge.Basedonourreviewofthisrecord,wecannotconcludethatthetrialjudgeerredorabusedhisdiscretioninorderingthatthebalanceoftheDefendantssentencetobeservedintheDepartmentofCorrection. ` Thejudgmentofthetrialcourtisaffirmed. `  `     h   ____________________________________ `     h   DAVIDH.WELLES,JUDGECONCUR:___________________________________PAULG.SUMMERS,JUDGE___________________________________JOEG.RILEY,JUDGE
