Nashville,TN372430493       DAVIDCROCKETT        DistrictAttorneyGeneral       Route19,Box99       JohnsonCity,TN37601                  OPINIONFILED:____________________ AFFIRMED JOHNH.PEAY,Judge    @ OPINION   ThepetitionerfiledhispetitionforwritofhabeascorpusonAugust6,1996,allegingthathis1973convictionsforrapeandcrimeagainstnaturemustbesetasidepursuanttothisCourtsopinioninStatev.RogerDaleHill,Sr.,No.01C019508CC00267,WayneCounty(Tenn.Crim.App.filedJune20,1996,atNashville).Specifically,heclaimsthattheindictmentcharginghimwiththecrimefailstoallegetheessentialelementofhismensreaandhisconvictionmustthereforebesetaside.Asanalternativegroundforrelief,heallegesthatthedistrictattorneygeneralfailedtosignboththecountsofthetwocountindictment.Thecourtbelowsummarilydeniedthepetitiononthegroundsthatitfailedtostateabasisforrelief.Thepetitionerappeals.Weaffirmthejudgmentbelow.  Therapechargeagainstthepetitionerprovidesthathe unlawfully,maliciouslyandfeloniouslydidhavecarnalknowledgeof[thevictim]afemale,forciblyandagainstherwill.Thechargeofcrimeagainstnatureprovidesthathe unlawfully,andfeloniouslydidcommitacrimeagainstnatureinandupon[thevictim];thatistosay,thatthesaid[defendant]didmake,forceandcompel[thevictim]toperformanactofcunnilingusupon[another]female.InHill,acasedealingwithapost1989criminaloffense,theindictmentallegedmerelythatthedefendanthad unlawfullysexuallypenetrate[d][thevictim]apersonlessthanthirteen(13)yearsofage.ThisCourtfoundthattheuseoftheword unlawfullywasnotsufficienttoallegethedefendantsmensrea,anessentialelementoftheoffense.Accordingly,theindictmentwasfoundfatallydefective.  TheStatecontendsthatHillisinappositetothiscasebecausethepetitionerscrimeswerecommittedin1973andthereforethestatutesrelieduponinHillhavenoapplication.WefinditunnecessarytodeterminewhetherHillhasanyapplicationtopre1989offenses.Hillisdistinguishablefromthepresentcasebasedonthelanguageoftheindictments.  ThewordingoftheindictmentinthepetitionerscaseissignificantlydifferentfromtheoneinHill.Inadditiontoallegingthatthepetitionersoffensewascommitted unlawfully,therapechargeprovidesthatthepetitionercommittedtheoffense maliciously, feloniously,and forciblyagainst[thevictims]will.Similarly,thecrimeagainstnaturechargeprovidesthattheoffensewascommitted feloniouslyandwiththeuseofforceandcompulsion.  AsnotedbytheState,JudgeTiptonofthisCourthaspreviouslyconsideredallegationssimilartothoseofthepetitionersinwhichthedefendanthadbeenchargedwith unlawfullyandfeloniouslysexuallypenetrat[ing][thevictim]byuseofforceorcoercion.SeeCharlesGatesv.State,No.03C019510CC00313,BradleyCounty(Tenn.Crim.App.OrderfiledAug.16,1996,atKnoxville).Inthatcase,JudgeTiptonruledasfollows: 8 Historically,thewordfeloniouslyhasmeant[p]roceedingfromanevilheartorpurpose;donewithadeliberateintentionofcommittingacrime.Asoursupremecourthaspreviouslynoted,onemeaningattachedtothewordis: Inalegalsense,donewiththeintenttocommitacrime.Certainly,thesementalstatesthatarenecessarilyinherentinthewordfeloniously,asrecognizedinTennesseeforthebetterpartofthiscentury,wouldincludearecklessmensrea,assuchexistsinthepresentlaw. 8 Anindictmentisnolessvalidforfailingtoallegetheoffenseinthewordsofthestatuteifitallegestheequivalenttothoseterms.Thus,theindictment,inchargingaggravatedrape,wasandisjurisdictionallysufficienttosupporttheentryofajudgmentofconvictionforrape....Id.(citationsomitted).SeealsoStatev.JohnHawsBurrell,No.03C019404CR00157,AndersonCounty(Tenn.Crim.App.filedFeb.11,1997,atKnoxville)(inwhichapanelofthisCourtadoptedwithapprovalJudgeTiptonsconclusionthattheterm feloniouslynecessarilyimpliesthemensreaofintentional,knowingorreckless).Thesamereasoningappliesinthiscase:thewordingofthechargeswassufficienttoallegeanymensr%  eaelementrequiredunderthecriminalstatutesviolated.Thisissueiswithoutmerit.
