Fromthisrecord,itappearsthatonFebruary12,1993,theDefendantwasconvictedonhispleasofguiltytoonecountoffelonypossessionofcocaineandonecountoffelonypossessionofmarijuana.Hereceivedaneffectivesentenceofeightyears.Therewasnoappealfromhisconvictionorsentences.Thepostconvictionreliefpetitionunderconsiderationherein,apparentlytheDefendantsfirstpetition,wasfiledonMay9,1996.Thetrialcourtdismissedthepetitionbasedonthestatuteoflimitations.ItisfromtheorderofthetrialcourtdismissingthepetitionthattheDefendantappeals. AtthetimetheDefendantsconvictionsbecamefinal,thestatuteoflimitationsapplicabletopostconvictionproceedingswasthreeyears.Tenn.CodeAnn.4030102(repealed1995).Itisclearthatthepetitioninthecasesubjudicewasfiledaftertheexpirationofthethreeyearstatuteoflimitations. ThenewPostConvictionProcedureActisapplicabletothispetitionandallpetitionsfiledafterMay10,1995.SeeTenn.CodeAnn.4030201etseq.(Supp.1996).ThisActrepealedthethreeyearstatuteoflimitationsandenactedinitsplaceaoneyearstatuteoflimitations.OntheeffectivedateofthisAct,samebeingMay10,1995,therepealedthreeyearstatuteoflimitationshadnotyetrunonthepetitionersrighttofileapetitionforpostconvictionrelief.The1995Actprovides,inpertinentpart,that notwithstandinganyotherprovisionofthisacttothecontrary,anypersonhavingagroundforreliefrecognizedunderthisactshallhaveatleastone(1)yearfromtheeffectivedateofthisacttofileapetitionoramotiontoreopenapetitionunderthisact.1995Tenn.Pub.Actsch.207,3.
