~ ~ ~ 229,235 $" (Tenn.1986).@, A.  0*%(  ` Thedefendantcontendsthetrialcourterredbyinappropriatelyusingnonstatutoryenhancingfactorsinsentencingthedefendantandimposedasentence~ ~ to| o| ~ ~ harshforthecircumstances.AtthesentencinghearingheldonJune9,1997,thetrialcourtappliedoneenhancementfactorfindingthatthedefendanthadapriorcriminalhistory.Thetrialcourtfoundnoapplicablemitigatingfactors.Thepresentencereportreflectstwo(2)convictionsforattempttocommitthefelonyofburglaryin1968andaconvictionofburglaryin1969,alongwithadisorderly 0948 conductconvictionin1967.Thepresentencereportalsoindicatedthattherewasa1966convictionforpetitlarceny.Althoughtheconvictionsoccurredinthe1960's,thefindingofthetrialcourt~ ~ wasthat~ ~ thedefendanthadaprevioushistoryofcriminalconvictionsorcriminalbehaviorinadditiontothosenecessarytoestablishtheappropriaterangewasproper.Thereisnoevidencethatthetrialjudgeusednonstatutoryenhancingfactorsinarrivingattheappropriatesentence. ` Althoughthetrialcourtmadenospecific~ ~ comments~ ~ regardingmitigatingfactors,itisobviousfromtherecordthatthetrialcourt~ ~ } } found~ ~ noapplicablemitigatingfactors.Appellantcontendsinhisbriefthathewasnota~ ~ principal~ ~ actorintheoffenseinquestion.ThiscontentionisnotamitigatingfactorunlessitwouldhaveappliedtoTenn.CodeAnn.4035113(4)indicatingthatthedefendantplayedaminorroleinthecommissionoftheoffense.Therecorddoesnotsupportthiscontention. ` Accordingtothepresentencereport,theappellantindicatedthathewasamarijuanauseratthetimeofhisarrest.Heindicatedinthepresentencereportthathewasnolongeramarijuanauser.However,athissentencinghearingheindicatedthathehadusedmarijuanaoverthememorialdayweekendwhichdatewasbetweenthedateoftheguiltypleaandthesentencinghearing.Thetrialcourtsentencedtheappellanttopaya$5,000.00fineandtoservetwo(2)years.Thetrial~ ~ court~ ~ suspendedthesentencetosix(6)monthsandplacedtheappellantonprobationforthebalanceofthesentence.Baseduponadenovoreviewofthe -@), record,thisCourtisoftheopinionthatthesentenceimposedbythetrialcourtwasappropriate.Thecredibilityoftheappellantregardinghisuseofmarijuanawascertainly~ ~ poor.~ ~ Lackofcandorbyanaccusedcanresultinthedenialofanalternativesentence.Inthiscase,however,thetrialcourtimposedanalternativesentence.Thetrialcourtcouldhavedeniedanalternativesentenceduetotheappellant'slackofcandor.Instead,thecourtimposedalenientsentence.The
