Later,theappellantwasconvictedoffirstdegreemurderandattemptedfirstdegreemurder.Forthoseoffenses,hewassentencedtolifeimprisonmentandsixtyyears,respectively.Baseduponhissixpreviousrobberyandattemptedrobberyconvictions,theappellantwassentencedasacareeroffender.SeeTenn.CodeAnn.4035108(1990Repl.).Inanefforttoridhimselfofhiscareeroffenderstatus,theappellantfiledthispostconvictionreliefpetition.Inhispostconvictionpetition,theappellantallegedthathehadreceivedtheineffectiveassistanceofcounselinthathistrialcounselhadinadequatelyinvestigatedthechargesagainsthim,hadfailedtointerviewwitnesses,wasnotpreparedfortrial,andhadfailedtofileproperpretrialmotions.Attheevidentiaryhearing,however,theappellantstestimonycenteredonhiscomplaintthathistrialcounselhadfailedtoadvisehimthatifhepledguiltytothethreerobberiesandtwoattemptedrobberies,hewouldthereafterbeconsideredacareeroffenderandrequiredtoservesixtypercentofanewsentenceforanysubsequentfelonyconviction.Significantly,however,theappellantdidnottestify,norallegeinhispetition,thathadhebeensoadvised,hewouldnothavepledguiltyandwouldhaveinsistedongoingtotrial.Theappellantfailedtodemonstratehowanydefectinhiscounselsadvicecausedhimprejudiceintheproceedings. Theappellantsformerattorneytestifiedattheevidentiaryhearingthathespecificallyadvisedtheappellant,priortohisguiltypleas,thatiftheappellantreceivedanysubsequentcriminalconvictions,thentheguiltypleaswouldbeusedagainsthim.Hetestifiedthathetoldtheappellant, [t]hiswillbeusedtoenhanceanysentenceyoumaygetinthefuture.Headmitted,however,thathedidnotspecificallyadvisetheappellantthathewouldbesentencedforfuturefelonyconvictionsasacareeroffender. Inpostconvictionreliefproceedingsthepetitionerhastheburdenofprovingtheallegationsinhispetitionbyapreponderanceoftheevidence.McBeev.State,655S.W.2d191,195(Tenn.Crim.App.1983).Furthermore,thefactualfindingsofthetrialcourt areconclusiveonappealunlesstheevidencepreponderatesagainstthejudgment.Statev.Buford,666S.W.2d473,475(Tenn.Crim.App.1983). InreviewingtheappellantsSixthAmendmentclaimofineffectiveassistanceofcounsel,thisCourtmustdeterminewhethertheadvicegivenorservicesrenderedbytheattorneywerewithintherangeofcompetencedemandedofattorneysincriminalcases.Baxterv.Rose,523S.W.2d930,936(Tenn.1975).Toprevailonaclaimofineffectiveassistanceofcounsel,apetitioner mustshowthatcounselsrepresentationfellbelowanobjectivestandardofreasonablenessandthatthisperformanceprejudicedthedefense.Stricklandv.Washington,466U.S.668,68788,692,694,104S.Ct.2052,2064,206768,80L.Ed.2d674(1984);Bestv.State,708S.W.2d421,422(Tenn.Crim.App.1985).Inthiscase,tosatisfytherequirementofprejudice,theappellantwouldhavehadtodemonstrateareasonableprobabilitythat,butforcounselserrors,hewouldnothavepledguiltyandwouldhaveinsistedongoingtotrial.SeeHillv.Lockhart,474U.S.52,59,106S.Ct.366,370,88L.Ed.2d203(1985);Bankstonv.State,815S.W.2d213,215(Tenn.Crim.App.1991). Theappellantspetitionforpostconvictionrelieffailsfortworeasons.First,theonlyissuetheappellantraisesonappealishisclaimthathistrialcounselwasineffectiveforfailingtoadvisehimonhiscareeroffenderstatusasaresultofhisguiltypleas.However,thatclaimofineffectivenesswasnotraisedintheappellantspetitionseekingpostconvictionrelief.Postconvictionpetitionsareheardupontheissuesraisedbythepleadings,andnoreliefcanbegrantedupongroundsnotraisedtherein.Statev.Smith,814S.W.2d45,49(Tenn.1990);Longv.State,510S.W.2d83,85(Tenn.Crim.App.1974);Millerv.State,508S.W.2d804,806(Tenn.Crim.App.1973).Althoughthepetitionfiledinthiscaseallegedthattheappellantstrialcounselhadbeenineffective,thepetitiondidnotallegethathewasineffectiveforfailingtoadvisetheappellantregardinghiseligibilityforcareeroffenderstatusshouldhepleadguiltytotherobberyoffenses.Therefore,thatclaimofineffectivenesswasnotraisedbythepleadings. Secondly,evenassuming,arguendo,thatappellantstrialcounselwassomehowineffectiveforfailingtoadvisetheappellantthathewouldbeconsideredacareeroffenderforanysubsequentfelonyconvictions,theappellantfailedtotestifythathadhebeengiventhatadvice,hewouldnothaveenteredhisguiltypleas.Therefore,therecordonappealinthiscasedoesnotshowthattheappellantsufferedanyprejudicetowarrantpostconvictionrelief.
