ƒ' ××  ×€female€œstudents›€at€œa€localÏuniversity.›× ƒ( ×× ƒ. ××  ×Ìà àDefense€attorney€Mark€Fishburn€also€testified€at€the€hearing.€€He€testifiedÏthat€he€was€appointed€to€represent€petitioner€and€received€full€discovery€fromÏthe€state€as€part€of€an€ð ðopen€fileðð€policy,€including€the€statements€of€both€victims.€ÏHe€was€aware€of€the€overwhelming€evidence€against€petitioner,€includingÏpetitionerððs€own€statement€implicating€himself.€€He€was€concerned€that€thereÏwas€no€viable€defense€in€this€case€in€light€of€petitionerððs€claims€that€the€victimsÍconsented€to€having€sexual€relations€with€him.€€He€recalled€speaking€to€theÏpetitioner€at€length€concerning€òòState€v.€Anthonyóó€and€its€effect€on€petitionerððsÏaggravated€kidnapping€charges€if€he€were€convicted€after€a€trial.€€At€that€time,ÏòòAnthonyóó€was€pending€appeal€in€the€Tennessee€Supreme€Court.€€He€testifiedÏthat€the€state€would€offer€a€plea€agreement€only€if€petitioner€agreed€to€pleadÏguilty€to€the€aggravated€kidnapping€of€A.€R.Ìà àò òòòSTATE€V.€ANTHONYó óóóÌÌà àIn€his€first€issue,€petitioner€claims€that€trial€counsel€was€ineffective€forÏallowing€him€to€plead€guilty€to€aggravated€kidnapping.€€He€asserts€that€theÏaggravated€kidnapping€was€ð ðessentially€incidentalðð€to€the€burglary€and€theÏrapes,€and€his€conviction€for€aggravated€kidnapping€violates€due€process€underÍthe€principles€of€òòState€v.€Anthonyóó,€òòsupraóó.€€He€maintains€that€had€he€knownÏabout€the€implications€of€òòAnthonyóó€prior€to€his€pleading€guilty,€he€would€not€haveÏpled€guilty€to€aggravated€kidnapping.Ìà àIn€òòState€v.€Anthonyóó,€the€Supreme€Court€held€that€when€kidnapping€isÏð ðessentially€incidentalðð€to€another€offense,€due€process€prohibits€a€conviction€forÏkidnapping.€€òòIdóó.€at€306„307.€€The€test€to€be€applied€is€whether,€under€the€facts€ofÏeach€case,€ð ðthe€confinement,€movement€or€detention€is€essentially€incidental€toÏthe€accompanying€felony€and€is€not,€therefore,€sufficient€to€support€a€separateÏconviction€for€kidnapping,€or€whether€it€is€significant€enough,€in€and€of€itself,€toÏwarrant€independent€prosecution€and€is,€therefore,€sufficient€to€support€such€aÏconviction.ðð€€òòIdóó.€at€306.€Ìà àAt€the€time€petitioner€entered€his€guilty€plea,€Fishburn€was€aware€of€theÏoverwhelming€nature€of€the€stateððs€evidence€against€petitioner.€€Petitioner€facedÏthe€possibility€of€thirteen€(13)€convictions,€including€two€(2)€convictions€forÏaggravated€kidnapping.€€Petitioner€also€faced€the€possibility€that€he€would€beÏrequired€to€serve€consecutive€sentences€on€these€convictions.€€€AlthoughÏFishburn€believed€that€one€(1)€of€the€aggravated€kidnapping€charges€wouldÏhave€to€be€merged€with€the€rape€charges,€he€determined€that€the€other€charge,Ïthe€charge€to€which€petitioner€pled,€could€constitutionally€stand.€€Furthermore,Ïthe€plea€agreement€was€contingent€upon€petitioner€pleading€guilty€toÏaggravated€kidnapping.Ìà àAt€the€post„conviction€hearing,€the€trial€court€found€that€the€aggravatedÏkidnapping€conviction€was€not€essentially€incidental€to€the€aggravated€burglaryÍor€the€rape€convictions€under€òòAnthonyóó.€€Considering€this€along€with€theÏforegoing€circumstances€surrounding€petitionerððs€guilty€plea,€the€trial€courtÏconcluded€that€counsel€was€not€deficient€for€allowing€petitioner€to€plead€guilty€toÏaggravated€kidnapping.€€Petitioner€has€not€shown€that€the€evidenceÏpreponderates€against€this€finding.€€This€issue€is€without€merit.ÌÌÌÌà@
