ThejudgmentofthetrialcourtisAFFIRMED.  FACTS    Thestatesproofshowedthefollowing.Thevictim,NealLovelace,isanattorneywhorepresentedtheexwifeofthedefendantssonindivorceproceedings.PursuanttoLovelacesadvice,thedefendantsdaughterinlawpreparedtoremovesomeitemsfromthemaritalhome.ThedefendantwenttoLovelacesofficeto clarifytoLovelacethatheownedthehouseandallofitscontents.WhenLovelacessecretaryadvisedthedefendantthatLovelacewouldnotspeakwithhim,thedefendantstatedinathreateningtone, [w]ell,ifhewonttalktomehere,Illcatchhimoutonthecorner. Ten(10)daysafterthedefendantvisitedLovelacesoffice,LovelaceencounteredthedefendantwhileLovelacewaswalkingwithanotherattorney,JerrySmith.Smithgreetedthedefendant,butLovelaceremainedsilent.AfterLovelacehadpassed,thedefendantapproachedLovelacefrombehindandstated, Imgoingtogetyou,youcurlyheadedm_____f_____.Lovelaceturned,notedthedefendanthadafistclenchedandhisteethgritted,andaskedifthedefendantwasthreateninghim.Lovelacetestifiedatthispointhewasinfearofimminentbodilyharmfromthedefendant.ThedefendantsreplytoLovelacewasthathewasnotthreateninghim,butthatitwouldnotbedifficultto whipyoura__. Thedefendantofferedadifferentversionoftheencounter.HedenieddoublinghisfistanddeniedthreateningLovelace.  SUFFICIENCYOFTHEEVIDENCE    InTennessee,greatweightisgiventotheresultreachedbythejuryinacriminaltrial.Ajuryverdictaccreditsthestate'switnessesandresolvesallconflictsinfavorofthestate.Statev.Bigbee,885S.W.2d797,803(Tenn.1994);Statev.Harris,839S.W.2d54,75(Tenn.1992).Onappeal,thestateisentitledtothestrongestlegitimateviewoftheevidenceandallreasonableinferenceswhichmaybedrawntherefrom.Id.;Statev.Cabbage,571S.W.2d832,835(Tenn.1978).Moreover,aguiltyverdictremovesthepresumptionofinnocencewhichtheappellantenjoyedattrialandraisesapresumptionofguiltonappeal.Statev.Grace,493S.W.2d474,476(Tenn.1973).Theappellanthastheburdenofovercomingthispresumptionofguilt.Id. Wheresufficiencyoftheevidenceischallenged,therelevantquestionforanappellatecourtiswhether,afterviewingtheevidenceinthelightmostfavorabletotheprosecution,anyrationaltrieroffactcouldhavefoundtheessentialelementsofthecrimeorcrimesbeyondareasonabledoubt.Tenn.R.App.P.13(e);Jacksonv.Virginia,443U.S.307,319,99S.Ct.2781,2789,61L.Ed.2d560(1979);Statev.Abrams,935S.W.2d399,401(Tenn.1996).Theweightandcredibilityofthewitnesses'testimonyaremattersentrustedexclusivelytothejuryasthetriersoffact.Statev.Sheffield,676S.W.2d542,547(Tenn.1984);Statev.Brewer,932S.W.2d1,19(Tenn.Crim.App.1996). Thedefendantwasconvictedofassaultwhichrequiresapersonto [i]ntentionallyorknowinglycauseanothertoreasonablyfearimminentbodilyinjury....Tenn.CodeAnn.3913101(a)(2).Lovelacetestifiedthatthroughthedefendantsthreateningspeechandgestures,hefeltthathewasabouttobeattackedbythedefendant.ThejuryobviouslyaccreditedthetestimonyofLovelaceoverthatofthedefendantwhoofferedadifferentversionoftheencounter.TheelementsofassaultwereestablishedbyLovelacestestimony. Thisissueiswithoutmerit.  IMPROPERCLOSINGARGUMENT    ThedefendantcontendstheprosecutingattorneyimproperlyarguedtothejuryinhisclosingargumentthatLovelacecouldlosehislicensetopracticelawifhecommittedperjury.Thedefendantfailedtoobjecttothisargumentattrial;therefore,theissueiswaived.Tenn.R.App.P.36(a).Wefurtherfindtheargumentdoesnotrisetothelevelofplainerror.Tenn.R.Crim.P.52(b). Thisissueiswithoutmerit.  SENTENCING   Thedefendantarguesthetrialcourterredinsentencinghimbecauseiterroneouslyconsideredconvictionsoverten(10)yearsoldinsteadofsolelyrelyinguponthepresentencereport.Hearguesthisandtheuncorroboratedtestimonyofhisenemiescausedthetrialcourttoerroneouslysentencehimtoninety(90)daysincarceration. Atthesentencinghearingnumerouswitnessestestifiedastopriorassaultscommittedbythedefendant.Theseincidentsdidnotresultinanyconvictions.Inaddition,thedefendanthada1970petitlarcenyconvictionand1968convictionsforassaultandbatteryandaweaponsviolation. ThisCourtsreviewofthesentenceimposedbythetrialcourtisdenovowithapresumptionofcorrectness.Tenn.CodeAnn.4035401(d).Thispresumptionisconditioneduponanaffirmativeshowingintherecordthatthetrialjudgeconsideredthesentencingprinciplesandallrelevantfactsandcircumstances.Statev.Ashby,823S.W.2d166,169(Tenn.1991).Ifthetrialcourtfailstocomplywiththestatutorydirectives,thereisnopresumptionofcorrectnessandourreviewisdenovo.Statev.Poole,945S.W.2d93,96(Tenn.1997). Thetrialcourtmadeexhaustivefindingsrelatingtothesentencingprinciples.Thecourtnotedthatthedefendantwaspresumedeligibleforalternativesentencing,andthathiscrimewasnotparticularlyegregious.However,thecourtalsonotedthedefendanthadanextensivehistoryofassaultivebehaviorandthatrehabilitationdidnotseemlikely.Inadditiontothedefendantspriorhistory,thetrialcourtobservedthatthedefendantexhibitedalackofcontritionandcredibility,insistingeverywitnessthattestifiedagainsthimlied. Criminalconductnotresultinginconvictionsmaybeconsideredinsentencing.Statev.Carico,___S.W.2d___(Tenn.1997);Statev.Butler,900S.W.2d305,312(Tenn.Crim.App.1994).Furthermore,thetrialcourtmayproperlyconsiderpriorconvictionsasanenhancementfactorregardlessoftheirage.Tenn.CodeAnn.4035114(1);Statev.HoytEdwardCarroll,C.C.A.No.03C019607CC00254,HawkinsCounty(Tenn.Crim.App.filedAugust12,1997,atKnoxville),perm.toapp.denied(Tenn.March2,1998).Theweighttobegivensuchconvictionsiswithinthediscretionofthetrialcourt.StatevBoggs,932S.W.2d467,475(Tenn.Crim.App.1996). Thedefendantreceivedthebenefitofalternativesentencing.Theburdenisonthedefendanttoestablishsuitabilityfortotalprobation.Boggs,932S.W.2dat477.Thedefendantslackofcredibilitymayproperlybeconsideredasitreflectsupononespotentialforrehabilitation.Statev.Dowdy,894S.W.2d301,306(Tenn.Crim.App.1994).Wegivegreatdeferencetothetrialcourtwhowasinapositiontojudgetheappearanceanddemeanorofthedefendant.Thedefendanthasfailedtomeethisburdenofestablishingentitlementtototalprobation. Ourreviewoftherecordindicatesthetrialcourtproperlyconsideredthesentencingprinciplesandallrelevantfactsandcircumstances.Thesentenceimposedisentitledtoapresumptionofcorrectness.Weseenoreasontomodifyit.
