àAt€approximately€10:00€p.m.€on€September€7,€1993,€Owen€Jimmy€KeefusÏwas€traveling€eastbound€on€Interstate€40,€several€miles€west€of€Exit€126€inÏDecatur€County.€€Keefus€was€driving€his€tractor€trailer€in€the€right€lane€of€I„40ÏEast€when€a€red€pick„up€truck€passed€him€on€the€right€shoulder€traveling€atÏapproximately€75€to€80€miles€per€hour.€€When€the€truck€pulled€in€front€of€him,ÏKeefus€noted€that€the€license€plate€number€on€the€truck€read€ð ðYKK„200.ðð€€TheÏtruck€then€passed€a€U„Haul€which€was€traveling€in€front€of€Keefus€and€proceededÏeastbound€in€the€right€lane.€€€Keefus€also€passed€the€U„Haul,€and€when€he€pulledÏalongside€the€pick„up€in€the€left€lane,€he€saw€the€driverððs€arm€extended€out€of€theÏwindow,€saw€ð ða€flashðð€and€then€heard€something€hitting€his€truck.€€€€Although€heÏdid€not€hear€gunshots,€Keefus€saw€that€the€driver€was€holding€a€small€firearm.€ÏDuring€the€incident,€he€was€able€to€fully€observe€the€person€in€the€pick„up€truckÏâ âand€identified€him€at€trial€as€the€Appellant.€Ð l6 -. Ðà ` àAfter€the€altercation,€Keefus€pulled€his€vehicle€to€the€side€of€the€road€andÏâ âradioed€for€assistance.€€He€observed€marks€on€his€vehicle€resembling€bulletÏholes€which€had€not€been€present€prior€to€this€incident.Ìà ` àShortly€thereafter,€Tennessee€Highway€Patrolman€James€BlackmonÏarrived€at€the€scene.€€Keefus€gave€him€the€vehicleððs€license€plate€number€and€aÏdescription€of€the€vehicle€and€the€driver.€€Upon€his€inquiry€as€to€the€license€plateÏnumber,€Trooper€Blackmon€learned€that€the€pick„up€was€registered€to€theÏAppellant.€€Blackmon€later€spoke€with€Appellant,€who€conceded€that€KeefusððÏdescription€of€the€driver€and€pick„up€was€a€ð ðpretty€closeðð€description€of€him€andÏhis€vehicle.€Ìà ` àAppellant€was€subsequently€indicted€on€one€(1)€count€of€aggravatedÏassault€with€a€deadly€weapon.€€At€trial,€Troopers€Blackmon€and€Roy€KentÏYoquelet€testified€that€the€markings€on€the€victimððs€vehicle€appeared€to€haveÏbeen€caused€by€gunfire.€€Further,€Trooper€Yoquelet€stated€that€he€saw€a€bulletÏlodged€in€the€radiator€of€Keefusðð€vehicle.€Ìà ` àAppellant€presented€an€alibi€defense€at€trial€through€the€testimony€ofÏPatricia€Crum.€€Crum,€a€Mississippi€resident€and€business€associate€of€Appellant,Ïtestified€that€she€was€with€the€Appellant€on€September€7,€1993.€€She€andÏAppellant€had€a€business€meeting€in€Memphis€at€approximately€2:00€p.m.,€andÏAppellant€later€joined€her€and€her€husband€for€dinner€in€Memphis.€€€Crum€testifiedÏthat€after€dinner,€Appellant€followed€her€and€her€husband€to€their€home€inÏMississippi€and€did€not€leave€until€after€1:00€a.m.€on€September€8.€Ìà ` àAppellant€also€presented€the€testimony€of€Steven€Russell,€an€investigatorÏwith€the€Tennessee€Department€of€Safety.€€Russell€stated€that€no€bullets€or€bulletÏâ âfragments€were€recovered€from€the€victimððs€vehicle.€€However,€even€though€noÐ à7€.0 Ðballistics€expert€examined€the€victimððs€vehicle,€Russell€testified€that,€in€hisÏopinion,€a€bullet€projectile€caused€the€damage€to€Keefusðð€truck.€Ìâ âà ` àAt€the€conclusion€of€the€proof,€the€jury€returned€a€guilty€verdict€for€theÏlesser€offense€of€felony€reckless€endangerment.€€A€date€for€sentencing€was€set,Ïbut€Appellant€failed€to€appear.€€He€was€eventually€apprehended€in€Arkansas€inÏApril€1997.€€The€trial€court€thereafter€sentenced€him€as€a€Range€I€offender€to€twoÏ(2)€years€incarceration.€€From€his€conviction€and€sentence,€Appellant€brings€thisÏappeal.ÌÌà@îî!®àò òòòSUFFICIENCY€OF€THE€EVIDENCEó óóóˆÐ Ðp ÐÌà ` àAppellant€claims€that€several€aspects€of€Keefusðð€testimony€wereÏinconsistent;€therefore,€his€testimony€should€be€disregarded€in€its€entirety.€€First,Ïhe€complains€that€Keefusðð€testimony€concerning€the€time€of€the€incident€wasÏcontradictory.€€During€his€direct€testimony,€Keefus€stated€that€the€altercationÐ à9€02 Ðoccurred€between€10:00€and€10:30€p.m.€€However,€on€cross€examination,€he€wasÏconfronted€with€a€report€to€his€employer€whereby€he€related€the€time€of€theÏincident€as€9:00€p.m.€€Although€Keefus€initially€denied€making€the€statement,€heÏeventually€conceded€that€he€gave€his€employer€the€wrong€time.€€Keefus€testifiedÏthat€at€the€time€he€reported€to€his€employer€he€was€possibly€confused€as€a€resultÏof€the€stress€of€having€a€weapon€fired€at€him.€€Furthermore,€Keefusðð€testimonyÏconcerning€the€time€of€the€incident€was€corroborated€by€the€testimony€ofÏTroopers€Blackmon€and€Yoquelet,€who€testified€that€the€incident€occurred€shortlyÏafter€10:00€p.m.€€Ìà ` àAppellant€also€claims€that€other€portions€of€Keefusðð€testimony€wereÏconflicting.€€However,€any€trivial€inconsistencies€were€resolved€by€the€trier€of€fact.ÏThis€issue€is€without€merit.Ìà@BB-®àò òC.ó óˆÐ   @ Ðà ` àAppellant€also€contends€that€because€the€state€did€not€present€a€weapon,Ïa€bullet€or€expert€ballistics€testimony€at€trial,€the€jury€was€allowed€to€speculateÏwhether€the€crime€was€committed€with€a€deadly€weapon.Ìà ` àReckless€endangerment€is€defined€as€ð ` àKeefus€testified€that€when€he€pulled€alongside€the€Appellant,€he€saw€theÏAppellant€pointing€a€small€firearm€at€him,€saw€ð ða€flashðð€and€then€heard€somethingÏhitting€his€truck.€€Although€he€did€not€hear€gunshots,€Keefus€examined€his€vehicleÏand€observed€marks€which€resembled€bullet€holes.€€Additionally,€TroopersÏBlackmon€and€Yoquelet€testified€at€trial€that€the€markings€on€the€victimððs€vehicleÐ
