M   ׀ThetrialcourtgrantedthedefendantfullprobationthroughAugust10,1994.OnFebruary12,1993,afteroneormoreprobationviolations,thedefendant'sprobationwasextendedthreeyears,presumablythroughAugust10,1997.OnJuly8,1996,thetrialcourtrevokedprobationwhenthedefendantwasconvictedofforgeryandfailedtopayrestitutionasrequiredbythepriororder.Thetrialcourtorderedbothfiveyearconsecutivesentences,atotaloftenyears,tobeexecuted.  Inthisappealofright,thedefendantclaimsthatthetrialcourterredbyrevokingprobation.Weaffirm.̀  Attherevocationhearing,itwasconceded%  Ԁthatthedefendanthadfailedtopayrestitutionandhadanewconvictionforforgery.Nonetheless,thedefendantarguedthatheshouldnotbesentencedtoincarcerationbecausehewasthesolecaretakerofhisill,elderlymother.Thedefendanttestifiedabouttheseverityanddurationofhismother'sillnessandclaimedthathewasforcedtocommitforgeryinordertopayforhismother'smedicalcare.Thedefendantclaimedthathisownsonhadstolen$2,800fromhim.  LebronSmith,thedefendant'sprobationofficer,testifiedthathespokewithanelderlysoundingwomanoverthetelephonewhoidentifiedherselfasthedefendant'smother.Hetestifiedthatsheclaimedtobeinpoorhealthandneededhersonforsupport.  Thetrialcourtfoundthatthedefendanthadnohesitationaboutviolatingthelaw,failedtoinformhisprobationofficerofhisforgeryconviction,andhadfailedtocomplywiththetermsofhisprobation.Thetrialcourtnotedthatthreeyearsbefore,thedefendanthadaprobationrevocationhearingbasedonthefailuretopay$500permonthrestitution;afterward,theamountofrestitutionwasreducedto$333permonth,anamountthedefendantagreedhecouldaffordtopay.Thedefendantfailedtopayrestitutionundertherevisedpayschedule.  Whenaprobationrevocationischallenged,theappellatecourtshavealimitedscopeofreview.Ifthetrialjudgefindsbyapreponderanceoftheevidence"thatthedefendanthasviolatedtheconditionsofhisprobation,"probationmayberevoked.Tenn.CodeAnn.4035311(d).Thisdecisiontorevokeasuspendedsentencerestsinthesounddiscretionofthetrialcourt.TheSentencingCommissionCommentstoSection4035310providethat"[u]ponrevocation,theoriginalsentenceimposedcanbeplacedintoeffect."Thedeterminationbythetrialcourt,ifconscientiouslymade,isentitledtoanaffirmance;therecordmustmerelydemonstratethatthereissubstantialevidencetosupportitsconclusions.Statev.Delp,614S.W.2d395,398(Tenn.Crim.App.1980);seealsoStatev.Williamson,619S.W.2d145,147(Tenn.Crim.App.1981).  Onappeal,thefindingsofthetrialcourtareentitledtotheweightofajuryverdict,andthedefendanthastheburdentodemonstratethattherecordcontainsnosubstantialevidencetosupportthefindingofthetrialcourtthataviolationoftheconditionsofprobationhasoccurred.Statev.Wall,909S.W.2d8,910(Tenn.Crim.App.1994);Statev.Harkins,811S.W.2d79,82(Tenn.1991).Uponaviolationofprobation,"thetrialjudgeshallhavetherightbyorderdulyenteredupontheminutesof[the]court,torevoketheprobationandsuspensionofsentenceandcausethedefendanttocommencetheexecutionofthejudgmentasoriginallyentered,orotherwiseinaccordancewith4035310...."Tenn.CodeAnn.4035311(d).  Inourview,thetrialcourtdidnotabuseitsdiscretion.Therewasclearlysufficientevidencetosupportthetrialcourt'sdeterminationthatthetermsofprobationhadbeenviolated.  Therearetwoissues,however,whichwerenotraisedbyeitherparty.First,thedefendantwassentencedtotwo,fiveyearsentences.Theywereorderedtobeconsecutive.Atfirstglance,itwouldappearthatoneofthesentenceshadexpiredbythetimethetrialcourtrevokedprobation.Atourrequest,therecordonappealwassupplementedwithcopiesofthejudgmentforms.Thesedocumentsconfirmthatthethesesentenceswereto"beservedconsecutivewith...TexasDistrictCourtNo.180."WithoutknowingwhentheTexassentenceexpired,wecannotdeterminewhethereitherofthedefendant'sfiveyearsentenceshadexpiredbeforetherevocationofprobation. N   ׀Ifthedefendanthadservedhisentireprobationarytermononeoftheconvictions,thetrialjudgewouldhavebeenwithoutauthoritytoorderserviceoftheexpiredsentence;Tenn.CodeAnn.4035310providesauthoritytorevokeonlyduringthe"timewhichwasdirectedandorderedbythecourtforsuchsuspension."SeealsoRowellv.Dutton,688S.W.2d474,477(Tenn.Crim.App.1985)(holdingthathabeascorpusreliefwasappropriatewheretheGovernorhad"exercise[d]hisrevocationauthorityoveracommuteeaftertheexpirationofhissentence.")Yetthisrecorddoesnotprovideuswiththeinformationnecessarytomakeanassessmentonthatissue.  AsecondobservationrelatestotheFebruary12,1993,extensionofthedefendant'sprobationforaperiodofthreeyears.Thatextensionexceededtheauthorityvestedinthetrialcourt"attheconclusionofaprobationrevocationhearing,thecourtshallhavetheauthoritytoextendthedefendant'speriodofprobationsupervisionforanyperiodnotinexcessoftwo(2)years."Tenn.CodeAnn.4035308(c)(emphasisadded).Because,however,thedefendant'sprobationviolationsoccurredpriortotheJuly8,1996,revocationhearing,withinthetwoyearsauthorizedbystatute,thetrialcourtactedincompliancewiththelaw.
