Inthisappeal,theappellantcontendsthatthetrialcourterredindismissinghispetitionforawritofhabeascorpuswithoutahearing.PursuanttoRule20oftheTennesseeCourtofCriminalAppeals,weaffirmthejudgmentofthetrialcourt. Inhisprosehabeascorpuspetition,theappellantchallengedthevalidityoftheindictmentcharginghimwithaggravatedrape.RelyinguponthisCourtsdecisioninStatev.RogerDaleHill, (   ׀appellantarguedthattheindictmentwasfatallydeficientinfailingtoincludetherequisitemensreafortheaggravatedrapeoffense.Thetrialcourt,however,declinedtodecidethecaseonitsmerits.Instead,thetrialcourtdismissedappellantspetitionupondeterminingthatthejudgmentswerenotvoidontheirface.Thetrialcourtfurtherdeclinedtotreatthepetitionasoneseekingpostconvictionreliefbecausethepetitionwasnotfiledinthecourtwheretheconvictionswereoriginallyobtained.Tenn.CodeAnn.4030204(a)(Supp.1996). Weagreewiththetrialcourtsdecisiontodismissappellantspetition.Itiswellestablishedthatchallengestothesufficiencyofanindictmentcannotbetestedinhabeascorpusproceedings.SeeHaggardv.State,475S.W.2d186,187(Tenn.Crim.App.1971);Brownv.State,445S.W.2d669,674(Tenn.Crim.App.1969).Furthermore,thepetitioncouldnothavebeenconsideredasoneseekingpostconvictionrelief.Appellantdidnotfilethepetitioninthetrialcourtwhereheobtainedhisoriginalconvictions,asrequiredbyTennesseeCodeAnnotatedsection4030204(Supp.1996).Moreover,thethreeyearstatuteoflimitations,thenineffect,precludedhimfromfilingapostconvictionpetitionin1996.SeeTenn.CodeAnn.4030102(repealed1995).  Assumingarguendo,however,thatthetrialcourtshouldhaveconsideredappellantspetitiononitsmerits,thepetitionneverthelessiswithoutmerit.Inchallengingtheindictment,appellantreliessolelyonthisCourtsdecisioninRogerDaleHill,No.01C019508CC00267(Tenn.Crim.App.atNashville,June20,1996). OursupremecourthasrecentlyreversedthedecisioninHill.SeeStatev.Hill,No.01S019701CC0005(Tenn.atNashville,Nov.3,1997).TheCourtrecognizedthatmodernstatutorycodesservetoavoidthehypertechnicalrequirementofcommonlawpleading.Therefore,asreasonedbytheCourt,anomissionofthemensreaelementfromanoffenseisnotalwaysfataltotheindictment.SeeSlipop.at56.TheCourtheldthatanindictmentislegallysufficientif:(1)Itslanguagesatisfiestheconstitutionalrequirementofnoticetotheaccused,(2)ItsformmeetstherequirementssetforthinTennesseeCodeAnnotatedsection4013202(Supp.1996), )   ׀and(3)Therequisitementalstatecanbelogicallyinferredfromtheallegedcriminalconduct.Seeid.at3. TheindictmentinthiscasecontainsmuchmorelanguagerespectingthemensreathanthatinHill.Itstatesinpertinentpart:8  THEGRANDJURORSfortheStateaforesaid,beingdulysummoned,elected,impaneled,swornandchargedtoinquirefor thebodyoftheCountyaforesaid,upontheiroathspresent:8  ThatRogersMcKinleyheretoforeonMarch31,1990,intheCountyaforesaid,didunlawfully,forcibly,orcoercively,sexuallypenetrateLindaSimmons,whilehewasarmedwithaweaponoranarticleusedorfashionedinamannertoleadthevictimreasonablytobelieveittobeaweapon,inviolationofTennesseeCodeAnnotated 3913502,againstthepeaceanddignityoftheState. TheindictmentinHilldidnotchargethattheappellantactedunlawfully,forciblyorcoercively.WefindthattheindictmentinthiscasewouldhavebeenvalidevenabsentoursupremecourtsholdinginStatev.Hill.Moreover,itsetsforthfactsconstitutingtheoffenseandprovidestheappellantwithsufficientnoticeofthechargesasmandatedbyourconstitution.Accordingly,weconcludethattheindictmentisvalid.
