Asst.DistrictAttorneyGeneral       363CourtSt.       Maryville,TN37804 OPINIONFILED:________________AFFIRMEDCURWOODWITT,JUDGE @ OPINION   Thedefendant,TroyMcLemore,appealstheBlountCountyCircuitCourt'srevocationofhisprobationarysentenceforthecrimesofburglaryandtheftofproperty.Hewasconvictedofthosecrimesin1994followinghisguiltypleasandreceivedaneffectivetwoyearsentenceofconfinementandprobation.Hissentencewasextendedbyconsentforanadditionalyearwhenhefailedtosatisfythefinancialobligationsimposedwiththeoriginalsentence.Duringthisextendedterm,aviolationsummonsissuedchargingthedefendantwithusingdrugsandfailingtopayhiscourtcosts,restitutionandprobationfees.Thetrialcourtfoundthatthedefendanthadviolatedthetermsofhisprobationarysentenceandorderedhimtoservefivemonthsandsixdaysinthecountyjail 1   ׀followedbysixmonthsofintensiveprobationwithdrugtreatment.Inthisappeal,hecontends(1)thereisnosubstantialevidencetosupportthetrialcourt'srevocationofprobation,and(2)thetrialcourterredinnotallowinghimtoservehissentenceinintensiveprobation.Havingreviewedtherecordandtheparties'briefs,weaffirmthejudgmentofthetrialcourt.@ I   Thefirstissueiswhetherthetrialcourtproperlyfoundthatthedefendanthadviolatedtheconditionsofhisprobation.Thestandardofreviewuponappealofanorderrevokingprobationistheabuseofdiscretionstandard.Statev.Harkins,811S.W.2d79,82(Tenn.1991).Inorderforanabuseofdiscretiontooccur,thereviewingcourtmustfindthattherecordcontainsnosubstantialevidencesufficienttosupporttheconclusionofthetrialjudgethattheviolationofthetermsofprobationhasoccurred.Harkins,811S.W.2dat82;Statev.Delp,614S.W.2d395,398(Tenn.Crim.App.1980).Thetrialcourtisrequiredonlytofindthattheviolationofprobationoccurredbyapreponderanceoftheevidence.Tenn.CodeAnn.4035311(d)(1997).Uponafindingofaviolation,thetrialcourtisvestedwiththestatutoryauthorityto"revokeprobationandsuspensionofsentenceandcausethedefendanttocommencetheexecutionofthejudgmentasoriginallyentered."Tenn.CodeAnn.4035311(d)(1997).Furthermore,whenprobationisrevoked,"insuchcasestheoriginaljudgmentsorenderedbythetrialjudgeshallbeinfullforceandeffectfromthedateoftherevocationofsuchsuspension."Tenn.CodeAnn.4035310(1997).Thetrialjudgeretainsthediscretionaryauthoritytoorderthedefendanttoservetheoriginalsentence.SeeStatev.Duke,902S.W.2d424,427(Tenn.Crim.App.1995).  Inthiscase,thedefendantadmittedthathehadusedillegaldrugs.Suchusewasinviolationofthetermsofhisprobationarysentence.Thisaloneissubstantialevidenceofrecordtosupportthetrialcourt'srevocationorder.SeeStatev.MichaelEmler,No.01C019512CC00424,slipop.at4(Tenn.Crim.App.,Nashville,Nov.27,1996)(wherethedefendantadmitsviolationofthetermsofprobation,revocationbythetrialcourtisnotarbitraryorcapricious);seealsoStatev.MitziAnnBoyd,No.03C019508CC00246,slipop.at3(Tenn.Crim.App.,Knoxville,Nov.1,1996).Afterthedefendantfailedadrugscreen,heclaimedtohavecontactedtworehabilitationprogramsbutdeterminedhecouldaffordneither.Hisprobationofficertoldhimabouttwootherprogramswhichhewouldbeabletoafford,buthedidnotbothertocontactthem.Headmittedusingmarijuanaonlyafewdaysbeforetherevocationhearing.  Inshort,thedefendantwasgivenafavorableformofalternativesentencingandfailedtoabidebytherulesimposeduponhim.Wecannotsaythetrialcourtabuseditsdiscretioninrevokingprobationforthedefendant'sϜillicitdruguse.@ II   Thedefendant'ssecondissueiswhetherthetrialcourterredinorderinghimtoserveaportionofhissentenceinthecountyjail,ratherthangivinghimanonincarcerativesentenceofintensiveprobationorCommunityCorrections.Heclaimsheisnotapropercandidateforincarcerationbecausetherecorddoesnotsupportconclusionsthathisincarcerationisnecessarytoprotectthepublicfromhimandthatthereisaneedfordeterrence.SeeTenn.CodeAnn.4035103(1)(1997).  Thestatuteprovidesthatuponthetrialcourt'sdiscretionarydecisiontorevokeadefendant'sprobationarysentence,"theoriginaljudgmentsorenderedbythetrialjudgeshallbeinfullforceandeffect...."Tenn.CodeAnn.4035310(1997).TheSentencingCommissionCommentsimplythatthetrialcourthasthediscretiontoplacealessersentenceintoeffectifitdeemsthatcourseofactiontobeappropriate.SeeTenn.CodeAnn.4035310,SentencingComm'nComments(1997)("Uponrevocation,theoriginalsentenceimposedcanbeplacedintoeffect.")(emphasisadded);Statev.MartyMiller,No.03C019602CC00056,slipop.at8(Tenn.Crim.App.,Knoxville,Mar.4,1997);Statev.MelvinGriffin,01C019503CC00090,slipop.at2(Tenn.Crim.App.,Nashville,Nov.16,1995);seealsoTenn.CodeAnn.4035311(d)(1997)(uponfindingthatdefendanthasviolatedconditionsofprobationandsuspension,trialcourt"shallhavetheright...torevoketheprobationandsuspensionofsentenceandcausethedefendanttocommencetheexecutionofthejudgmentasoriginallyentered,orotherwiseinaccordancewith4035310").Contrarytothedefendant'sassertion,thecourtisnotrequiredatthisstagetoreconsidertheprinciplesofsentencingafterfindingthatthedefendanthasviolatedthetermsofprobation.Statev.YvonneBurnette,No.03C019608CR00314,slipop.at4(Tenn.Crim.App.,Knoxville,July25,Ϝ1997),perm.app.denied(Tenn.1998);Statev.HowardLuroyWilliamson,Jr.,No.02C019507CC00201,slipop.at4(Tenn.Crim.App.,Jackson,Sept.30,1996);Statev.StevieQ.Taylor,No.02C019504CC00108,slipop.at5(Tenn.Crim.App.,Jackson,May1,1996).  AsdiscussedinsectionIabove,thetrialcourtwaswithinitsdiscretioninrevokingthedefendant'sprobationarysentence.Havingsofound,thecourthadthestatutoryauthoritytoorderthedefendanttoservehisentiretwoyearsentenceintheDepartmentofCorrection.Insteadoftakingthatcourseofaction,thetrialcourtextendedameasureofmercytothedefendantbyorderinghimtoservehisoriginalsentenceinsplitconfinement.Thecourtimposedconditionstohelpthedefendantmeetthefinancialobligationsofhisoriginalsentenceandreceiveassistanceforhissubstanceabuseproblem.Weseenoabuseofdiscretioninthatdecision.
