àThe€defendant€was€indicted€for€Murder€Second€Degree,œ× ƒ0 ××  ×›€a€Class€A€felony,Ïand€Abuse€of€a€Corpse,€a€Class€E€felony.€€Pursuant€to€a€plea€agreement,€theÏdefendant€entered€a€guilty€plea€to€the€lesser€included€offense€of€Facilitation€ofÍMurder€Second€Degree,€a€Class€B€felony,€as€a€Range€One,€Standard€Offender,Ïleaving€the€determination€of€punishment,€which€would€fall€between€8€and€12Ïyears,€to€the€trial€court.€€He€also€œpled›€guilty€to€Abuse€of€a€Corpse,€agreeing€to€a€2Ïyear€sentence,€to€be€served€concurrently€with€the€sentence€he€would€ultimatelyÏreceive€on€his€more€serious€charge.€€When€an€appeal€challenges€the€length,Ïrange,€or€manner€of€service€of€a€sentence,€this€Court€conducts€a€de€novo€reviewÏwith€a€presumption€that€the€determination€of€the€trial€court€was€correct.€T.€C.€A.€ððÏ40„35„401(d).€However,€the€presumption€of€correctness€is€"conditioned€upon€theÏaffirmative€showing€in€the€record€that€the€trial€court€considered€the€sentencingÏprinciples€and€all€relevant€facts€and€circumstances."€òòState€v.€Ashbyóó,€823€S.W.2dÏ166,€169€(Tenn.€1991).€In€the€event€that€the€record€fails€to€demonstrate€suchÏconsideration,€review€of€the€sentence€is€purely€de€novo.€€In€this€review,€we€mustÏconsider€(1)€the€evidence,€if€any,€received€at€the€trial€and€sentencing€hearing,€(2)Ïthe€presentence€report,€(3)€the€principles€of€sentencing€and€arguments€as€toÏsentencing€alternatives,€(4)€the€nature€and€characteristics€of€the€criminal€conduct,Ï(5)€any€mitigating€or€statutory€enhancement€factors,€(6)€any€statement€that€theÏdefendant€made€on€his€own€behalf€and€(7)€the€potential€for€rehabilitation€orÏtreatment.€T.C.A.€ðððð€40„35„102,€„103€and€„210;€see€òòAshbyóó,€823€S.W.2d€at€168;ÏòòState€v.€Mossóó,€727€S.W.2d€229,€236„37€(Tenn.€1986).€Ìà àThe€facts€of€defendantððs€offense€are€uncontroverted.€€He€had€known€theÏvictim,€Phyllis€Miller,€from€1966€until€her€death€in€1993.€€They€had€dated€off€and€on,Ïwere€married€in€1974,€divorced€in€1984,€and€then€after€the€divorce€continued€toÏlive€together€up€until€the€time€of€the€victimððs€death,€even€though€having€no€furtherÍsexual€relationship.€€Their€living€together€appeared€to€be€for€financial€and€drug„related€purposes€only,€as€the€victim€had€a€date€planned€with€another€man€theÏnight€of€her€death.€€From€the€time€of€their€marriage€they€both€used€illegal€drugs€onÏa€weekly€basis.€€She€used€cocaine€and€he€used€PCP,€in€his€words,€until€it€ð ðjustÏabout€got€where€you€couldnððt€find€it,ðð€and€then€he€switched€to€cocaine€as€well.€€TheÏtwo€of€them€would€inject€cocaine€ð ðjust€about€every€weekend.ðð€€The€weekend€of€herÏdeath,€the€defendant€testified€thatÌÓÓà0 à[I]t€started€on€Thursday,€and€weððd€been€doing€some€Thursday€night.€€SheÏhad€to€go€to€work€Friday,€and€she€did....€And€then€during€the€day,€œsheððd›€getÏa€break€and€Iððd€go€over€and€meet€her€and€sheððd€do€some€more.Ìà0 àà àAnd€that€afternoon€when€she€got€off€of€work,€we€went€straight€fromÏher€job€down€to€where€we€pick€our€drugs€up€and€bought€some€more,€andÏwe€went€home...and€we€did€one€when€we€got€home,€each€of€us,€and€thenÏwe€was€doing€another€one€and€she€was€fixing€to€take€a€shower...and€all€of€aÏsudden,€she€just€laid€back.ððÌÓÓÌThe€defendant€removed€her€from€the€bathtub,€placed€her€on€the€bed,€and€tried€toÏrevive€her€for€about€45€minutes,€to€no€avail.€€There€is€no€proof€in€the€record€he€everÏattempted€to€call€for€emergency€medical€help€during€this€time.€€He€left€her€body€onÏthe€bed€from€that€Friday€afternoon€until€sundown€Saturday,€at€which€time€heÏplaced€it€in€the€hatchback€of€his€car,€intending€to€dispose€of€it€secretly.€€HeÏcontinued€to€use€cocaine€that€Friday€and€Saturday.€€He€also€made€a€trip€back€toÏthe€drug€house€where€they€had€bought€their€weekend€cocaine€during€this€time,Ïand€kept€up€a€pretense€with€the€victimððs€family€that€all€was€well.€€When€he€ran€outÏof€cocaine€Sunday€morning,€he€finally€called€her€family€and€the€police,€still€ð ðhighððÏby€his€own€admission€when€he€œtalked›€œÌto›€the€police€about€what€had€happened.€€He€at€first€gave€the€police€a€detailedÍfabrication€about€how€the€victim€had€died€at€another€location,€and€that€one€of€herÏfriends€had€called€him€to€come€pick€up€her€body,€which€he€had€then€placed€in€hisÏcar.€€When€he€realized€the€police€did€not€believe€him,€he€then€told€them€the€truthÏabout€the€circumstances€surrounding€her€death.€€Ìà àThe€presentence€report€reveals€that€the€defendant€has€a€criminal€record€ofÏsubstance€abuse€going€back€to€1974,€when€he€was€convicted€of€glue€sniffing€andÏmarijuana€possession.€€His€convictions€include€cocaine€possession,€multiple€DUIÏconvictions,€and€possession€of€drug€paraphernalia.€€His€only€felony€conviction€wasÏfor€Felonious€Operation€of€a€Motor€Vehicle,€for€which€he€received€one€year€in€theÏworkhouse.€€He€had€also€been€placed€on€a€community€corrections€program€inÏ1994.€€He€has€a€high€school€degree€and€some€college,€dropping€out€when€his€wifeÏbecame€pregnant.€€At€the€time€of€his€sentencing€hearing,€he€was€unemployed,Ïeven€though€his€former€employer€stated€it€would€be€glad€to€have€him€return€toÏwork,€despite€his€past€drug€use.€€He€currently€lived€in€a€free€apartment€withÏanother€woman€who€was€on€disability.€€The€defendant€admitted€that€he€had€beenÏusing€cocaine€for€25€years,€having€received€treatment€for€his€addiction€three€timesÏat€Moccasin€Bend.€€He€claimed€to€have€stopped€using€cocaine€on€his€own€in€May,Ï1995,€about€22€months€after€the€victimððs€death,€7€months€prior€to€the€hearing.€€TheÏdefendant€was€on€probation€at€the€time€of€the€commission€of€the€offense.Ìà àThe€trial€court€imposed€a€10€year€sentence€in€the€Department€of€Correction,€Ïfinding€three€enhancement€factors:€1)€that€the€defendant€had€a€previous€history€ofÏcriminal€convictions€or€criminal€behavior€in€additional€to€those€necessary€toÍestablish€the€appropriate€range,× ƒ1 ××  ×€2)€that€the€offense€involved€a€victim€and€wasÏcommitted€to€gratify€the€defendantððs€desire€for€pleasure€or€excitement,× ƒ2 ××  ×€and€3)€thatÏthe€felony€was€committed€while€the€defendant€was€on€probation.× ƒ3 ××  ×€€ÌÌà àThat€the€defendant€has€a€previous€history€of€criminal€convictions€or€criminalÏbehavior€is€amply€supported€by€the€record.€€The€presentence€report€showedÏeleven€prior€misdemeanor€convictions,€primarily€for€drug€or€alcohol€abuse,€andÏone€felony€driving€conviction.€€Although€not€mentioned€by€the€trial€court,€this€CourtÏcan€and€does€also€consider€the€constant€abuse€of€cocaine€or€PCP€and€otherÏsubstances€over€the€last€25€years€as€ð ðcriminal€behavior,ðð€even€when€no€criminalÏconvictions€have€resulted€from€such€behavior.€òòState€v.€Hunteróó,€926€S.W.2d€744,Ï748„749€(Tenn.€Crim.€App.€1995).Ìà àThat€this€offense€was€committed€to€gratify€the€defendantððs€pleasure€is€borneÏout€by€the€defendantððs€testimony€in€the€hearing€as€to€their€long€partnership€in€drugÏuse,€and€his€statement€to€the€police€about€their€using€drugs€together€to€ensureÏtheir€safety.€€He€stated€in€his€confession,€when€asked€if€he€used€cocaine€while€theÏvictim€took€her€last€ð ðhitðð€before€she€died,€that€ð ðI€didnððt€right€then.€€I€let€her€do€hers.€€IÏlike€to€watch€her.€€I€donððt€want€to€be€skeetso€if€something€happens.ðð€€She,€likewise,Ïwould€watch€him€when€he€ð ðdid€his.ðð€€Defendant€admits€in€his€brief€that€the€type€ofÍrelationship€that€he€and€the€victim€had€ð ðwas€one€where€they€both€procured€andÏshared€drugs€obtained€from€a€street€dealer.ðð€€The€unlawful€distribution€of€cocaineÏresulting€in€the€victimððs€death€therefore€was€committed€for€their€mutual€pleasure,€inÏthe€context€of€the€facts€of€this€case.€€Although€the€trial€court€found€that€theÏdefendant€seemed€to€get€pleasure€from€watching€her€use€drugs,€for€which€there€isÏlittle€proof€in€the€record,€it€is€clear€that€the€defendantððs€obtaining€drugs€for€theirÏmutual€use€aided€his€use€of€drugs,€and€was€therefore€committed€to€gratify€hisÏdesire€for€the€pleasure€of€his€own€drug€use,€as€well€as€hers.Ìà àThe€trial€courtððs€finding€as€an€enhancement€factor€that€the€defendant€was€onÏprobation€at€the€time€of€the€offense€was€error.€€T.C.A.€ðð€40„35„114(13)€providesÏthat€€it€is€an€enhancement€factor€if€the€felony€was€committed€while€on€ð ðany€of€theÏfollowing€forms€of€release€status,ðð€€listing€probation€in€subsection€œ(c)›€as€oneÏqualifying€form€of€release€status,€only€ð ðif€such€release€status€is€from€a€prior€felonyÏconviction.ðð€€The€presentence€report€shows€that€although€the€defendant€was€onÏprobation,€it€was€for€a€misdemeanor€offense,€not€a€felony.€€Therefore,€this€factorÏcannot€be€used€to€enhance€defendantððs€sentence.€€However,€because€the€recordÏshows€that€defendant€bought,€delivered€to€the€victim,€and€used€cocaine€repeatedlyÏwhile€on€probation,€this€Court€finds€an€additional€enhancement€factor,€that€theÏdefendant€ð ðhas€a€previous€history€of€unwillingness€to€comply€with€the€conditions€ofÏa€sentence€involving€release€into€the€community,ðð× ƒ4 ××  ×€due€to€his€constant€purchaseÏand€use€of€illegal€drugs€while€on€probation.€Ìà àThe€trial€court€also€found€three€mitigating€factors:€1)€that€the€defendantÍplayed€a€minor€role€in€the€commission€of€the€offense,× ƒ5 ××  ×€2)€that€he€assisted€theÏauthorities€in€apprehending€other€persons€who€had€committed€the€offense,× ƒ6 ××  ×€and€3)Ïthat€there€were€unusual€circumstances€surrounding€the€death€of€the€victim,€the€trialÏcourt€stating€therefore€that€ð ðmaybe€that€was€not€a€sustained€intent€to€violate€theÏlaw.ðð× ƒ7 ××  ×€€Each€mitigating€circumstance€the€court€found€ð ðsomewhat,ðð€which€this€CourtÏtakes€to€mean€that€although€the€trial€court€found€the€mitigating€factors€to€exist,€itÏgave€them€little€weight.€€From€the€record€before€us,€the€trial€court€was€veryÏgenerous€to€the€defendant€in€giving€these€three€factors€any€weight€at€all.€€TheÏdefendant€admitted€to€preparing€one€of€the€ð ðhitsðð€of€cocaine€the€victim€took€theÏafternoon€she€died,€and€in€fact€took€her€to€buy€the€cocaine,€and€took€her€cocaine€toÏuse€while€she€was€at€work€the€day€she€died,€which€would€hardly€qualify€as€aÏð ðminor€role.ðð€€The€defendant€was€convicted€of€Facilitation,× ƒ8 ××  ×€€defined€as€knowinglyÏfurnishing€substantial€assistance€in€the€commission€of€the€felony,€although€lackingÏthe€necessary€intent€to€be€criminally€responsible€for€the€felony€itself.€€He€clearlyÏhad€a€major€role€in€furnishing€this€assistance,€even€though€not€intending€the€deathÏof€the€victim.€€Also,€although€the€defendant€eventually€ð ðassisted€the€authoritiesðð€byÏtelling€the€authorities€who€the€person€was€who€sold€him€the€cocaine,€and€admittingÏto€what€he€himself€had€done,€he€at€first€led€them€on€what€could€be€described€as€aÍð ðwild€goose€chase,ðð€purposefully€misdirecting€the€investigation.€€The€third€mitigatorÏthe€trial€court€found,€stated€fully€in€T.C.A.€ðð€40„35„113(11)€as€that€the€defendant,Ïð ðalthough€guilty€of€the€crime,€committed€the€offense€under€such€unusualÏcircumstances€that€it€is€unlikely€that€a€sustained€intent€to€violate€the€law€motivatedÏhis€conduct,ðð€is€not€supported€by€the€proof.€€The€trial€judge€stated,€when€findingÏthis€mitigating€factor€present,€thatÌÓÓà0 àNumber€11,€about€the€unusual€circumstance,€itððs€not€really€unusual€in€thatÏsense,€but€there€was€a€mutual€sharing€of€drugs,€so€maybe€that€was€not€aÏsustained€intent€to€violate€the€law€so€again,€I€find€those€somewhat.ÌÌÓÓThe€defendantððs€steady€use€of€illegal€drugs€over€25€years,€and€particularlyÏobtaining€for€and€shooting€cocaine€with€this€particular€victim€weekly€for€at€least€9Ïyears€before€her€death,€does€not€show€at€all€that€ð ðit€is€unlikely€that€a€sustainedÏintent€to€violate€the€law€motivated€his€conduct.ðð€€The€ð ðsubstantial€assistanceðð€heÏfurnished€was€clearly€a€violation€of€the€law.€€Also,€the€defendant€was€well€aware€atÏthe€time€of€the€offense€that€he€or€the€victim€could€die€from€the€ð ðhitsðð€they€injected,Ïand€watched€each€other€for€this€purpose,€so€that€to€the€defendant,€the€victimððsÏdeath€was€not€at€all€under€ð ðunusual€circumstances.ðð€€According€to€the€defendantððsÏtestimony,€he€and€the€victim€had€even€made€a€promise€to€each€other€ð ðover€theÏyearsðð€that€if€either€one€of€them€died€of€an€overdose,€the€other€would€dispose€ofÏthe€body,€planning€for€such€an€event.Ìà àThe€record€supports€the€application€of€enhancement€factors€(1)€and€(7),€andÏalthough€the€application€of€enhancement€factor€(13)€is€not€proper€due€to€theÏdefendantððs€being€on€only€misdemeanor€probation,€enhancement€factor€(8)€isÏapplicable€to€defendantððs€conviction.€€Mitigating€factor€(11)€is€not€supported€by€theÍrecord,€and€the€two€remaining€mitigating€factors,€(4)€and€(9),€are€entitled€to€littleÏweight.€€The€record€therefore€fully€supports€the€sentence€of€ten€years€given€theÏdefendant€by€the€trial€judge.Ìà
