However,thedefendantwasallowedtoremainintheMeigsCountyJailuntilheescapedinMay  1997.Afterhisrecapture,hewasreturnedtotheMeigsCountyJailforabriefperiodoftimeand  thentransferredtotheDepartmentofCorrection.HepleadedguiltytoescapeonDecember17, t 1997,andhewassentencedtoserveanadditionalyearintheDepartmentofCorrection ` consecutivelytohisexistingsentences. L     ` OnMarch31,2000,Millerfiledapetitionforwritofhabeascorpus,andonadate $ t notreflectedintherecord,heapparentlyfiledapetitionforwritoferrorcoramnobis.  #  2      ׀Thetenor  ` ofbothpetitionsisthatfollowinghisescapefromtheMeigsCountyJail,Millerwas resentenced  L  totheDepartmentofCorrectionwithouthavingbeenaffordedahearing.Millerclaimedinthe  8  petitionsthathispriorpleaagreementscalledforhimtoservehistimeintheMeigsCountyJail. $     ` Thetrialcourtthereafterconductedahearing.Millerstestimonywassomewhat   contradictory.Hetestifiedthatthejudgmentsinhisburglary,aggravatedburglaryandtheftcases   hadbeen altered,andhehadactuallybeen sentencedtothecountyjail.Hethenacknowledged   thattherehadbeennowrittenagreementthathewouldservehissentencesintheMeigsCountyJail, p althoughhisunderstandingwasthathewouldbeabletodoso.  #  3      ׀Thepetitioneraskedthecourtto \ modifyhissentenceto somekindofalternativesentencing.Attheconclusionofthehearing,the H courtdeniedrelief. 4    ` Onappeal,Millerarguesthatduetothe resentencingwithoutahearing,thelower  \ courtshouldhavemodifiedhissentenceunderCodesection4035314(c) topermitlocaljailservice. H Hefurtherarguesthatthecourterredinfailingtosetasidethepleaagreementsbaseduponafinding 4 thattheywerevoidedbyhistransfertotheDepartmentofCorrection.      ` InordertodeterminewhetherMillermayobtainthereliefrequested,wemust  examinethetypesofactionwhicharebeforethecourt,apetitionforthewritoferrorcoram  nobisandapetitionforthewritofhabeascorpus.     ` Withrespecttothewritoferrorcoramnobis,theCodeprovides X   D! 8  Uponashowingbythedefendantthatthedefendantwaswithoutfaultinfailingto  presentcertainevidenceatthepropertime,awritoferrorcoramnobiswillliefor  subsequentlyornewlydiscoveredevidencerelatingtomatterswhichwerelitigated  atthetrialifthejudgedeterminesthatsuchevidencemayhaveresultedinadifferent t judgment,haditbeenpresentedatthetrial.`   Tenn.CodeAnn.4026105(1997).Inthiscase,thepetitionersclaim,eveniftakenastrue,does 8  notfitwithinthecategoryofcognizableclaims.Heisnotseekingtobringnewevidencebeforethe $ t courtwhichmighthavehadaneffectonthejudgment.Further,thepetitionerdidnothaveatrial,  ` andthestatutecontemplatescoramnobisreliefupondiscoveryofevidencethatmighthavebeen  L  presented attrial.Id.Coramnobisrelief,therefore,cannotlie.  #  4        8     ` Habeascorpusreliefaddressesdetentionsthatresultfromvoidjudgmentsorexpired   sentences.SeeArcherv.State,851S.W.2d157,164(Tenn.1993).Asentencing"judgmentisvoid   ifthefaceofthejudgmentrevealsthatthecourtwaswithoutjurisdictionorauthoritytoissueit." X     ` Wethereforeconcludethatthepetitionersclaimwascognizableneitherinapetition 0"  forwritoferrorcoramnobisnorpetitionforwritofhabeascorpus.Forthatreasonalone,thelower #l! courtproperlydismissedthepetitions. $X"   $D #    ` Furthermore,thepetitionerfailedtoestablishthefactualpremiseswhichheclaims   wouldentitlehimtorelief.Hishabeascorpuspetitionallegesthathis pleas[sic]agreement  specificallystateshewastobeincarceratedinthecountyfacility.Hiscoramnobispetitionalleges  that hispleaagreementsentencingjudgement[sic]for2703Aand2727waschangedfromhim t servingtimein[theMeigsCounty]Jail,and[he]wasresentencedtoT.D.O.C.,withouthis ` knowledge,consentoranyhearing.Neitherallegationwasprovenatthehearing.Tothecontrary, L  thepetitionerhimselftestifiedthattherewasnotawrittenagreementthathewouldservehis 8  sentenceinthelocaljail.Heofferednoproofotherthanhisuncorroboratedtestimonythatthe $ t judgmentshadbeenaltered,andthattestimonywasdiscreditedbycontraryevidenceintheformof  ` thetranscriptofthepleasubmissionandsentencinghearingsatwhichthecourtorderedserviceof  L  thesentencesintheDepartmentofCorrection.Thus,thepetitionersfailuretoestablishafactual  8  basisuponwhichthelowercourtcouldgrantreliefprovidesanadditionaljustificationforthelower $  courtsruling.SeeBobbyLeeTatev.State,No.E2000-00796-CCA-R3-CD(Tenn.Crim.App.,   Knoxville,Dec.6,2000)(appellatecourtaffirmedlowercourtsdismissalof MotiontoVacate   Judgmentcountenancedaspetitionforwritofhabeascorpusbecausepetitionerfailedtoestablish   factualpremiseforhisclaim).      ` WehavealsoconsideredwhetherMillerscomplaintiscognizableasamotionto \ correctorreducesentenceunderTennesseeRuleofCriminalProcedure35.Weconcludethatitis H not.Thatrulecontainsa120daytimelimitwithinwhichthecourtmayact,andthejudgmentsof 4 whichMillercomplainswereenteredyearsbeforehispetitionswerefiled.  p    ` Finally,wehaverejectedthepetitionersargumentinhisbriefthatthetrialcourt H shouldhaveaddressedtheremainderofhissentencesunderCodesection4035314(c).That 4 provisionallowsthetrialcourttoretainjurisdictionoveradefendantduringthetimethatsuch   individualisconfinedinthelocaljail.Tenn.CodeAnn.4035314(c)(1997).Suchjurisdiction   allowsthetrialcourttoreduceormodifyasentenceorallowprobationsupervision.Id.Asstated  above,thepetitionerwassentencedtotheDepartmentofCorrection,andthelowercourttherefore  hadnojurisdictionunderthisCodesectiontoadjustthedefendantsremainingsentences.     ` Forthesereasons,weaffirmtheMeigsCountyCriminalCourtsdismissalofthe X  petitionsforwritoferrorcoramnobisandwritofhabeascorpus.
