Thepetitionercollaterallychallengeshis1978convictionsforseconddegreemurderandcriminalsexualassault,forwhichhereceivedconsecutivesentencesofninetynineyears.Thiscourtaffirmedhisconvictions,seeStatev.PerryTyroneMiller,No.8082III,LincolnCounty(Tenn.Crim.App.Feb.3,1981),andalsoaffirmedthedenialofthepetitionersfirstpetitionforpostconvictionrelief.PerryTyroneMillerv.State,No.85267III,LincolnCounty(Tenn.Crim.App.Apr.7,1987).ThepetitionerfiledthepresentpetitiononJanuary5,1996,allegingthatthereasonabledoubtinstructiongivenathistrialisunconstitutionalunderCagev.Louisiana,498U.S.39,111S.Ct.328(1990).̜ BecausethepetitionersconvictionbecamefinalbeforetheenactmentofT.C.A.4030102(repealed1995),thepetitionerhadthreeyearsfromJuly1,1986,tofileapostconvictionpetition.Sandsv.State,903S.W.2d297,301(Tenn.1995);Abstonv.State,749S.W.2d487,488(Tenn.Crim.App.1988).ThepetitionercitesRickmanv.Dutton,864F.Supp.686(M.D.Tenn.1994),toarguethathecouldnothavechallengedthereasonabledoubtinstructiongivenathistrialduringthisperiodbecausethegroundforreliefwasnotestablished.However,Rickmandidnotcreateanewconstitutionalrulethatwouldjustifythetollingofthepetitionersstatuteoflimitations,andRickmanisnotbindingonthiscourt. ThepetitionerfiledthepresentpetitionmorethanfiveyearsafterthedecisioninCagev.Louisiana.Thus,evenifitcreatedanewruleofconstitutionallaw,thepetitionerhasfailedtoraisetheissueinatimelymanner.SeeODonnellv.State,905S.W.2d951,953(Tenn.Crim.App.1993)(petitionuntimelywhenfiledmorethanthreeyearsaftergroundforreliefarose). The1995PostConvictionActdidnotreinstateafilingperiodforpostconvictioncasesrelativetoconvictionsforwhichtheformerthreeyearpostconvictionstatuteoflimitationshadalreadyrun.ArnoldCarterv.State,No.03S019612CR00117,MonroeCounty(Tenn.Sept.8,1997)(forpublication).Thepetitionerhadareasonableopportunitytobringhispostconvictionclaimbeforetheenactmentofthe1995PostConvictionAct,buthefailedtodoso.Thetrialcourtproperlydismissedthepresentpetitionasbeinguntimelyfiled.
