OnFebruary5,1985,theappellantpledguiltytoonecountofburglaryandfivecountsofconcealingstolenpropertyforwhichhereceivedaneffectivesentenceoffiveyears. %   ׀Theappellantdidnotappealtheseconvictions.HeiscurrentlyconfinedattheNortheastCorrectionalCenterlocatedinJohnsonCounty.OnJanuary2,1997,theappellantfiledaprosepetitionforwritofhabeascorpus.Thepetitionallegesthattheevidencewasinsufficienttoconvicthimoftheseoffenses,thatthefivecountsintheindictmentwereimproperlypresentedtothegrandjury,thattherespectivecountsoftheindictmentfailtostateanoffense,andthattrialcounselwasineffective.TheJohnsonCountyCriminalCourtdismissedtheappellantspetition. Thetrialcourtdeterminedthattheappellantspetitionfailedtostateacognizablegroundforhabeascorpusrelief.Habeascorpusreliefisonlyavailablewhenaconvictionisvoidbecausetheconvictingcourtwaswithoutjurisdictionorauthoritytosentenceadefendant,orthatadefendantssentencehasexpiredandheisbeingillegallyrestrained.Archerv.State,851S.W.2d157,164(Tenn.1993).Moreover,itiswellestablishedlawinthisstatethatthewritofhabeascorpusmaynotbeusedasasubstitutefor,orinlieuofanappeal.Statev.Bomar,368S.W.2d748,749(Tenn.1963).Indistinguishinghabeascorpusrelieffrompostconvictionrelief,thiscourt,inPassarellav.State,891S.W.2d619,627(Tenn.Crim.App.1994),heldthat:8 Ifthecourtrenderingajudgmenthasjurisdictionoftheperson,thesubjectmatter,andhastheauthoritytomakethechallengedjudgment,thejudgmentisvoidable,notvoid;andthejudgmentmaynotbecollaterallyattackedinasuitforhabeascorpusrelief.Conversely,ifthefaceoftherecordrevealsthatthecourtdidnothavepersonalandsubjectmatterjurisdiction,ortheauthoritytomakethechallengedjudgment,thejudgmentisvoid.Onlyoneoftheappellantsclaimsallegesavoidconviction,i.e.,theindictmentsarefatallydefectivebecausetheydonotstateanoffense.However,theappellantfailstoexplainthebasisofhisclaim.Moreover,fromareviewofthevariouscountsintheindictment,itisclearthatastatutoryoffensehasbeenstated.Thus,thetrialcourtcorrectlyconcludedthatthepetitionfailedtostateacognizableclaimforhabeascorpusrelief.Notwithstandingthisconclusion,thetrialcourtnotedthattheappellantsclaimofineffectiveassistanceofcounseliscognizableasapostconvictionclaim,seeTenn.CodeAnn.4030205(c)(1996Supp.).However,thecourtcorrectlyconcludedthatapostconvictionclaimisnonethelesstimebarredasthepetitionwasfiledoutsidetheapplicablethreeyearstatuteoflimitationsperiod.TennCodeAnn.4030102(1990)(repealed1995). Theappellantalsoarguesthatthetrialcourterredbydismissinghispetitionwithouttheappointmentofcounsel.Apetitionforwritofhabeascorpusreliefmaybesummarilydismissedbythetrialcourtwithoutappointmentofcounsel,withoutanevidentiaryhearing,andwithouttheopportunitytoamendthepetition,if,fromthefaceofthepetition,thereviewingcourtfindsnothingtoindicatethattheappellantschallengedconvictionsmightbevoid.SeeTenn.CodeAnn.2921101,109(1980);seealsoVillaneuvav.Carlton,No.03C019611CR00425(Tenn.Crim.App.atKnoxville,Oct.3,1997).WeconcludethatthetrialcourtproperlyfollowedtheprovisionsofTenn.CodeAnn.2921101etseq.insummarilydismissingthepetition.
