ðthe€intentional€relinquishment€or€abandonment€of€a€known€right€orÏprivilege,ðð€finding€waiver€upon€a€presumption€of€knowledge€may€beÏproblematic.€òòJohnson€v.€Zerbstóó,€304€U.S.€458,€464,€58€S.Ct.€1019,€1023€(1938).€ÏMoreover,€these€courts€note,€it€is€a€reality€of€the€courtroom€that€defendants€whoÏspeak€out€of€turn€at€trial€are€often€quickly€reprimanded€and€instructed€to€addressÏthe€court€only€through€counsel.€€òòUnited€States€v.€Teagueóó,€908€F.2d€752,€759Ï(11th€Cir.€1990).ÌÌà àA€third€group€of€courts€has€devised€a€compromise€between€the€twoÏapproaches€previously€described.€€This€method€has€been€called€the€ð ðpost„trialÍchallenge€approach.ðð€€òòBoyd€v.€Stateóó,€586€A.2d€670,€677€(D.C.€App.€1991).€€InÏthis€approach,€the€trial€judge€need€not,€òòsua€sponte,óó€question€the€defendantÏduring€the€trial,€but,€even€if€the€defendant€does€not€bring€the€matter€to€theÏattention€of€the€trial€court,€€the€defendant€is€free€to€bring€a€post„trial€challengeÏgenerally€based€on€the€ineffective€assistance€of€counsel.€€€This€approachÏappears€to€be€the€practice€in€the€largest€number€of€jurisdictions,€both€state€andÏfederal.œ× ƒ@ ××  ×›€€€These€courts€hold€that€defense€counsel€has€the€responsibility€toÏadvise€the€defendant€of€the€reciprocal€rights€to€testify€or€to€remain€silent€and€toÏexplain€the€tactical€advantages€or€disadvantages€of€each,€and,€although€theÏdecision€is€one€that€is€fraught€with€implications€for€defense€strategy,€the€ultimateÏdecision€rests€with€the€defendant.€€€òòState€v.€Savageóó,€577€A.2d€455,€473€(N.J.Í1990).€€€The€duty€of€providing€advice€and€ensuring€that€any€waiver€of€the€right€toÏtestify€is€knowing€and€intelligent€rests€not€with€the€trial€court,€but€with€defenseÏcounsel.€€òòUnited€States€v.€Pennycookeóó,€65€F.3d€9,€12€(11th€Cir.€1995).€€ÌÌà àThe€courts€that€follow€the€demand€rule€and€those€that€adhere€toÏthe€post„trial€challenge€approach€agree€that€a€trial€court€may€presume€that€theÏdefendant€has€knowingly€and€voluntarily€waived€the€right€to€testify€from€theÏdefendantððs€€conduct.€€However,€a€major€difference€between€the€two€is€thatÏthose€that€follow€the€ð ðdemandðð€rule€find€that€the€defendantððs€silence€at€trial€notÏonly€waives€the€constitutional€right€but€denies€the€defendant€the€possibility€ofÏever€rebutting€that€presumption.€€The€post„trial€challenge€approach€allows€aÏdefendant€to€demonstrate,€either€on€direct€appeal€or€in€a€post„convictionÏproceeding,€€that€his€waiver€was€neither€knowing€nor€voluntary€becauseÏdefense€counsel€was€ineffective.€€ÌÌà àAlthough€Tennessee€courts€have€not€addressed€this€issue€directly,Ïthe€post„trial€challenge€approach€is€most€€consistent€with€the€manner€in€whichÏTennessee€courts€have€resolved€the€question€of€whether€an€accused€has€beenÏdenied€the€right€to€testify.€€In€òòVermilye€v.€Stateóó,€754€S.W.2d€82€(Tenn.€Crim.€App.Ï1987),€a€post„conviction€petitioner€claimed€ineffective€assistance€of€counsel€dueÍto€the€failure€of€defense€counsel€to€prepare€him€to€testify€at€trial€and€therebyÏdenied€him€the€right€to€testify€effectively.× ƒA ××  ×€€This€court€held€that€counsel€was€notÏineffective€as€he€had€met€with€the€petitioner€many€times,€the€recordÏdemonstrated€that€the€petitioner€had€made€the€decision€to€testify,€and€theÏpetitioner€had€failed€to€show€how€his€attorney€could€have€better€prepared€him€toÏtestify.€€òòIdóó.€at€88.€€€In€an€unpublished€case,€a€panel€of€this€court€held€that,€underÏTennessee€law,€the€trial€court€is€not€required€to€hold,€òòsua€sponteóó,€a€ð ðjury„outððÏhearing€for€the€purpose€of€advising€the€defendant€on€the€record€that€he€has€theÏright€to€testify€or€to€remain€silent€€and€determining€the€defendantððs€wishes.× ƒB ×× ×€€€BothÏòòVermilyeóó€and€òòEvansóó€were€post„conviction€proceedings€in€which€the€petitionersÏalleged€that€trial€counsel€had€been€ineffective€by€denying€them€the€right€toÏtestify€on€their€own€behalf.€€Neither€had€raised€the€issue€in€the€trial€court,€and,€inÏboth€instances,€this€court€concluded€that€the€record€contained€sufficient€proof€toÍdemonstrate€that€the€òòdefendantóó€had€made€the€decision€based€on€advice€ofÏcounsel.€€€€€ÌÌà àThe€issue€of€whether€defense€counsel€rested€his€case€withoutÏadvising€and€consulting€with€the€defendant€€is€ultimately€a€question€of€fact.€ÏòòSmith€v.€Campbellóó,€781€F.Supp.€521,€531(M.D.€Tenn.€1991).€€Both€NapoleonÏMomon€and€the€attorney€who€represented€him€at€trial€testified€that€the€attorneyÏhad€decided€that€Momon€would€not€testify€and€that€the€attorney€informedÏMomon€through€his€son€as€they€were€reentering€the€courtroom.€€Although€theÏattorney€explained€to€the€defendantððs€son€that€two€jurors€in€the€previous€trialÏhad€not€found€Momon€to€be€credible,€the€attorney€clearly€stated€that€he€wasÏpassing€on€the€information€rather€than€giving€advice€upon€which€the€defendantÏcould€make€his€own€decision.€€Moreover,€since€the€defendant€was€notified€of€theÍdecision€at€the€door€to€the€courtroom,€there€was€little€if€any€opportunity€for€him€toÏengage€in€any€discussion€with€his€attorney.€× ƒD ××  ×€€ÌÌà à€€In€his€written€findings€of€fact,€the€post„conviction€judge€found€thatÏtrial€counsel€made€the€decision€not€to€call€the€defendant€to€the€stand.€€However,Ïthe€judge€erroneously€determined€that€since€the€decision€was€a€matter€of€trialÏstrategy,€counsel€was€not€ineffective.€€Because€the€right€to€testify€is€aÏfundamental€constitutional€right€that€is€personal€to€the€defendant,€only€theÏdefendant€may€waive€that€right.€€Although€the€trial€judge€was€justified€inÏpresuming€at€trial€that€the€defendant€had€knowingly€and€intelligently€waived€hisÏright€to€testify,€uncontradicted€testimony€at€the€hearing€conclusivelyÏdemonstrates€that€his€attorney€neither€advised€him€that€he€had€the€right€to€testifyÏif€he€so€desired€nor€discussed€with€him€the€advantages€and€disadvantages€thatÏmight€flow€from€his€decision.€€Counsel€knew€that€the€defendantððs€statementsÏwere€inconsistent€in€some€regards€and€that€a€letter€from€Momon€to€his€sister„in„law€cast€the€defendant€in€an€unfavorable€light.× ƒE ××  ×€€€Yet€he€did€not€raise€theÏquestion€of€Momonððs€testimony€until€the€stateððs€proof€was€complete€or€nearlyÏcomplete.€€In€fact,€the€record€indicates€that€his€preparations€for€the€second€trialÏdid€not€include€meeting€with€his€client.€In€other€words,€trial€counsel€neverÏinformed€the€defendant€of€his€ultimate€right€to€decide€whether€or€not€to€testifyÏand€failed€to€consult€with€and€advise€his€client€on€what€may€be€the€single€mostÏimportant€decision€made€at€trial.€€òòBoyd€v.€United€Statesóó,€586€A.2d€670,€673Ï(D.C.App.€1991).€€Counsel,€despite€the€directives€of€the€American€BarÏAssociationððs€Standards€of€Criminal€Justice€and€the€pronouncements€of€theÏTennessee€Supreme€Court€in€òòCampbellóó€and€òòBurkhartóó€and€the€holding€of€thisÏcourt€in€òòVermilyeóó,€€apparently€believed€that€it€was€his€prerogative€to€make€theÏdecision€as€to€whether€the€petitioner€would€testify.€€€In€this€respect,€counselððsÏconduct€ð ðfell€below€an€objective€standard€of€reasonableness.ðð€€òòStrickland€v.ÏWashingtonóó,€466€U.S.€668,€690;€104€S.Ct.€2052,€2065€(1984).€€ÌÌà àOur€inquiry,€however,€does€not€stop€with€the€first€prong€of€theÏòòStricklandóó€standard.€€We€must€now€consider€whether€counselððs€error€was€soÍserious€as€to€deprive€the€defendant€of€a€fair€trial€and€to€call€into€question€theÏreliability€of€the€outcome.€€òòStrickland€v.€Washingtonóó,€466€U.S.€at€687,€104€S.Ct.Ïat€2064;€òòUnited€States€v.€Teagueóó,€935€F.2d€1525,€1534,€(11th€Cir.€1992);ÏòòCampos€v.€United€Statesóó,€930€F.Supp.€787,€793€(E.D.N.Y.€1996);€€òòPorter€v.ÏSingletaryóó,€883€F.Supp.€660,€667€(M.D.€Fla.€1995).œ× ðbattered€wife€syndrome,ðð€€he€changedÏhis€mind€and€rested€without€putting€on€any€proof.€€Counsel€then€referred€to€theÏabsent€evidence€again€in€his€closing€argument.€€òòIdóó.€at€225„226.€€€€Unlike€theÍattorney€in€the€present€case,€defense€counsel€in€òòZimmermanóó€discussed€theÏmatter€with€his€client€and€she€confirmed€her€approval€of€his€decision€in€a€jury„out€hearing.€€òòZimmermanóó,€823€S.W.2d€at€221.€€There€was,€therefore,€noÏdeprivation€of€the€constitutional€right€to€testify.€€The€issue€addressed€is€whetherÏthe€attorneyððs€decision€to€rest€without€putting€on€the€defendant€or€several€otherÏwitnesses€was€ineffective.€€In€determining€that€counsel€had€been€ineffective,€theÏZimmerman€court€cited€five€factors€which€tend€to€indicate€ineffective€assistanceÏwhen€defense€counsel€fails€to€call€a€defendant€to€the€stand:ÌÌÓÓà8 à(1)à àonly€the€victim€and€the€defendant€wereÏpresent€when€the€offense€was€committed;ÌÌà8 à(2)à àonly€the€defendant€could€present€a€ð ðfullÏversion€of€[the€defendantððs]€theory€of€the€factsðð;€ÌÌà8 àWe€recognize€the€special€nature€of€a€defendantððs€testimony€in€aÏcriminal€trial.€€A€defendantððs€testimony€gives€the€jury€ð ðan€immediate€and€visibleÏimpression€of€him€as€a€personðð€and€may€ð ðcolor€their€view€of€the€entire€caseÏagainst€him.€ð ð€€€òòPeople€v.€Curtisóó,€681€P.2d€504,€513€(Colo.€1984).€€Only€theÏdefendant€can€present€direct€evidence€of€his€state€of€mind,€and€when€anÏaccused€takes€the€stand€he€has€had€ð ðhis€day€in€courtðð€in€the€most€literal€sense.€ÏòòState€v.€Neumanóó,€371€S.E.2d€77,€81€(W.Va.€1988).€€€Therefore,€a€defendantððsÏtestimony€is€often€of€greater€significance€than€that€of€any€other€witness.ÌÌà àIn€this€case,€as€in€òòZimmermanóó€and€òòGfelleróó,€only€the€victim€and€theÏdefendant€were€present€when€the€offense€occurred€and€only€the€defendantÏcould€present€a€full€version€of€the€defense€theory€of€the€facts€and€testify€to€hisÏrelationship€with€the€victim.€€If€he€had€testified,€he€may€have€been€able€to€bluntÏthe€prosecutionððs€attack€on€his€credibility€in€closing€argument€by€explaining€€theÏinconsistencies€between€his€statement€to€the€police€and€his€deposition€taken€inÏa€related€civil€matter.€€He€may€have€convinced€the€jury€that€his€letterÍpropositioning€his€sister„in„law€was€inconsequential.€€This€defendant,€inÏparticular,€who€has€many€physical€infirmities,€may€have€colored€the€juryððs€viewÏof€the€entire€case€had€he€testified.€€And,€as€the€defendant€points€out,€when€heÏtestified€at€his€first€trial,€the€jury€acquitted€him€of€first€degree€murder€and€wasÏunable€to€return€a€verdict€on€second€degree€murder.€€ÌÌà àOn€the€other€hand,€Momonððs€theory€of€the€facts€was€before€the€juryÏin€his€statement€to€the€police€and€in€his€deposition.€€€Although€there€wereÏinconsistencies€between€the€two€statements,€the€inconsistencies€concernedÏrather€minor€points€such€as€whether€he€put€the€pistol€in€the€drawer€or€on€theÏstand€beside€the€bed,€or€the€precise€manner€in€which€he€was€holding€the€pistolÏwhen€he€alleged€she€grabbed€for€it.€€Moreover,€if€Momon€had€testified,€the€stateÏmay€have€been€able€to€impeach€Momonððs€credibility€with€a€twenty„year€oldÏconviction€for€manslaughter.€€The€fact€that€the€jury€in€the€first€trial€could€notÏreach€a€verdict€on€second„degree€murder€does€not€necessarily€mean€that€theÏdefendantððs€testimony€would€have€changed€the€result€in€the€second€trial.€ÏDefendants€are€not€infrequently€convicted€in€a€second€trial€despite€having€aÏð ðhungðð€jury€in€the€first.€€€€The€record€contains€indications€that€Momon€may€notÏhave€been€a€good€witness.€€According€to€the€trial€attorney,€he€interviewed€twoÏjurors€after€the€first€trial.€€These€jurors€told€him€that€they€had€not€believedÍMomonððs€story€of€an€accidental€shooting,€and€the€trial€judge€at€the€sentencingÏhearing€also€found€Momon€to€be€without€remorse€and€lacking€€credibility.€€€ÌÌà àMoreover,€the€record€before€us€lacks€sufficient€indication€of€whatÏMomonððs€testimony€would€have€been€had€he€testified.€€Although€he€took€theÏstand€at€the€post„conviction€hearing,€little€of€his€testimony€reflects€what€he€mightÏhave€said€at€trial.× ƒG ××  ×€€The€transcript€of€the€first€trial€is€not€in€the€record€onÏappeal.× ƒH ××  ×€€Unlike€the€jury€in€òòZimmermanóó,€this€jury€was€not€led€to€believe€that€theÏdefendant€would€testify,€nor€were€other€witnesses€favorable€to€the€defenseÏsilenced€by€the€unilateral€decision€to€rest€without€putting€on€any€proof.€€DespiteÏthe€obvious€importance€of€any€defendantððs€testimony,€€it€would€be€sheerÏspeculation€to€evaluate€the€potential€impact€of€Momonððs€testimony€absent€someÏknowledge€of€what€that€testimony€would€have€been.ÌÌà àWe€find,€therefore,€that€although€trial€counselððs€performance€fellÏbelow€an€objective€standard€of€reasonableness€under€prevailing€professionalÏnorms€so€that€he€was€not€functioning€as€"counsel"€guaranteed€by€the€UnitedÏStates€Constitution,€the€petitioner€has€failed€to€meet€his€burden€ofÏdemonstrating€that€there€is€a€reasonable€probability€that€but€for€counsel's€failureÏto€inform€and€advise€the€defendant€of€his€right€to€testify,€the€result€of€theÏproceeding€would€have€been€different.€€òòStricklandóó,€466€U.S.€at€695.€€ÌÌIII.€€ò òOther€Allegations€of€Ineffective€Assistance€of€Counseló óÌà àThe€petitioner€also€contends€that€trial€counsel€was€ineffectiveÏbecause€he€failed€to€raise€the€theory€of€self„defense,€because€he€did€notÏinvestigate€the€stateððs€witnesses€thoroughly,€and€because€he€failed€to€conferÏwith€the€defendant€prior€to€his€second€trial.€€We€have€already€found€that,€prior€toÏthe€second€trial,€€the€attorney€failed€to€inform€and€advise€his€client€about€hisÏright€to€testify,€but€that,€on€these€facts,€we€are€unable€to€conclude€that€thisÏdeficiency€deprived€the€defendant€of€a€fair€trial€or€created€serious€questionsÏabout€the€validity€of€the€outcome.€€With€respect€to€the€other€allegations,€the€trialÏjudge€found€that€the€defendant€had€never€raised€the€issue€of€self„defense€withÏhis€attorney€and€that€the€entire€defense€was€predicated€on€Momonððs€statementÏthat€the€shooting€was€accidental.€€The€trial€judge€accredited€the€attorneyððsÍtestimony€and€found€that€the€attorney€had€met€with€the€defendant€and€his€sonÏnumerous€times€prior€to€the€first€trial€and€that€he€was€sufficiently€familiar€with€theÏcase€at€the€second€trial.€€After€a€thorough€review€of€the€record,€we€conclude€thatÏthe€evidence€does€not€preponderate€against€the€trial€judgeððs€findings€and€that,Ïwith€respect€to€these€matters,€trial€counsel€performance€was€not€deficient.€€Ìà@ àÌIV.€€ò òConclusionó óÌà àThe€decision€to€waive€or€exercise€the€constitutional€right€to€testifyÏmust€be€made€by€the€accused€with€the€thorough€and€careful€advice€of€counsel.€€€ÏIn€this€case,€the€petitionerððs€trial€counsel€failed€to€advise€him€of€his€constitutionalÏright€to€testify€and€made€the€unilateral€decision€that€the€petitioner€would€not€takeÏthe€stand€at€the€second€trial.€€€In€this€respect,€trial€counselððs€performance€wasÏdeficient.€€However,€on€this€record,€we€are€unable€to€conclude€that,€but€forÏcounselððs€error,€there€is€a€reasonable€probability€that€the€outcome€of€the€trialÏwould€have€been€different.ÌÌà
