Thestatefiledananswerurgingthetrialcourttoconsiderthematterasapostconvictionpetition,generallydenyingtheallegationsofthepetitionandallegingnodeprivationofaconstitutionalright. Thetrialcourtdismissedthematterreferringtotheactionasa"postconvictionwrit"simplystatingthatthe"...petitionerhasnotstatedacauseofactionthathasnotbeenalreadyineffect..." Itisunnecessarytoaddresswhetherthismattershouldbetreatedasahabeascorpusorpostconvictiontoresolvetheissues.Wenote,however,thatinthisjurisdictionatrialcourthasthediscretiontotreatasuitforhabeascorpusasasuitforpostconvictionreliefiftheremedyisadequateandappropriatetoresolvethegroundsraised.Tenn.CodeAnn.4030108.ThisCourthasheldthatatrialcourtshouldtreatahabeascorpussuitasasuitforpostconvictionreliefwhenthepleadingsofthepartiesdonotcomportwiththerequirementsapplicabletohabeascorpussuits,Trolingerv.Russell,1Tenn.Crim.App.525,446S.W.2d538(1969);orthelimitedreliefinhabeascorpussuitspreventsanadjudicationonthegroundsraisedbythepetitioner,butthegroundsarecognizableinapostconvictionsuit.SeePorterv.State,2Tenn.Crim.App.437,455S.W.2d159(1970);Richmondv.Russell,2Tenn.Crim.App.345,454S.W.2d155(1970).̀Thetrialcourtwasauthorizedtotreatthismatterasoneforpostconvictionrelief.Thejudgmentsenteredbythetrialcourt,ifillegal,arevoidableasopposedtobeingvoid.SeeStatev.Burkhart,566S.W.2d871(Tenn.1978);Hendersonv.State,220Tenn.520,419S.W.2d176(1967).Thewritofhabeascorpuswillnot"lietoliberateapersonimprisonedunderavoidablejudgmentasopposedtoonewhichisvoid."Statev.Henderson,640S.W.2d56,57(Tenn.Crim.App.1982).̀TheresolutionofthismatteriscontrolledbyHendersonv.State,supra.InHendersonthedefendantcommittedarobberywithadeadlyweaponwhileonparoleforapreviousconviction.Thepartiesenteredintoapleabargainagreement.Itwasagreedthatthedefendantwouldpleadguiltytosimplerobbery,themaximumsentencewouldbefive(5)years,andthesentencewouldbeservedconcurrentlywiththeprevioussentence.Later,theappellantchallengedthevalidityofhisconvictiononthegroundthesentencewasillegal.Itwasconcededthatthetrialcourtwaspowerlesstoorderthatthesentenceswouldbeservedconcurrentlyastheapplicablestatutemandatedthatthesentencesmustbeservedconsecutively.Thetrialcourtsetasidetheconvictionfollowinganevidentiaryhearing.TheStateappealedthejudgment.Inaffirmingthejudgmentofthetrialcourt,theSupremeCourtsaid: 4   4   ̀Afterhavingthoughtaboutthematter,heardablearguments,readtherecordandauthorities,weagreethatthetrialjudgewascorrectinhisrulingherein.̀******̀Here,therewasnoofficialmisrepresentation.Theargumentismadeastowhattheythoughtwouldhappen,anditjustwasnotright.Whenitappearsthatthisistruetheaccusedshouldbeallowedtowithdrawhisplea.̀220Tenn.at525,419S.W.2dat178,179.       ̀Uponremandtheappellantshallbegiventheopportunitytoamendhispleadingswiththeguidinghandofcounsel.Thereafter,thetrialcourtshallconductanevidentiaryhearingonthegroundsraisedintheappellant'spleadings.    _____________________________CharlesLee,SpecialJudge&     CONCUR:____________________________PaulG.Summers,Judge____________________________JosephM.Tipton,Judge'
