Nashville,TN372011649 OPINIONFILED:򀀀AFFIRMEDJOEG.RILEY,JUDGE 7 XdXXd7@ OPINION  Appellant,JoeHenryMoore,appealsthesummarydismissalofhismotionfordelayedappealofhissecondpetitionforpostconvictionrelief.Findingnobasistograntthedelayedappeal,weAFFIRMthedismissalofhismotion. @ I  Appellantwasconvictedin1986offirstdegreemurderandreceivedalifesentence.TheconvictionandsentencewereaffirmedbythisCourtin1987,andtheTennesseeSupremeCourtdeniedapplicationforpermissiontoappealin1988. OnJanuary3,1989,appellantfiledhisfirstpetitionforpostconvictionrelief.ThetrialcourtdeniedreliefonApril10,1990,afteranevidentiaryhearing.Noappealwastaken.Appellantcontendshisattorneyfailedtoappealthisdismissalorotherwisenotifyhimofthedismissal. AppellantthenfiledhissecondpetitionforpostconvictionreliefonMay20,1993,requestingadelayedappealofthedenialofhisfirstpostconvictionpetition.Thebasisforthepetitionwastheallegedfailureofhisattorneytonotifyhimofthepriordismissalorotherwisefileanappealonhisbehalf.ThesecondpetitionwasdismissedonNovember19,1993,forfailuretostateaclaimandhavingbeenfiledbeyondthestatuteoflimitations.Counselwasnotappointed,nordidtheappellantseekanappealofthisdismissal. AppellantthenfiledhisthirdpetitionforpostconvictionreliefonOctober3,1994,againrequestingadelayedappealofthedismissalofhisfirstpostconvictionreliefpetition.ThispetitionwasdismissedbythetrialcourtonJuly11,1995,afteranevidentiaryhearing.Thetrialcourtfoundthatthethirdpetitionrelatedtothesamesubjectmattercontainedinthesecondpetitionwhichwasdismissedwithoutanappeal.Accordingly,thetrialcourtdeterminedthatappellantsfailuretoappealthedismissalofhissecondpetitionwasfataltohispursuitofthethirdpetition. Onappealfromthedismissalofthethirdpetition,thisCourtaffirmedthejudgmentofthetrialcourt.Wefoundthatappellantsfailuretoappealthedenialofhissecondpetitionconstituteda waiverwithinthemeaningofTenn.CodeAnn.4030112(b)(1)[repealed;nowTenn.CodeAnn.4030206(g)(Supp.1996)].JoeHenryMoorev.StateofTennessee,C.C.A.No.01C019601CR00009,DavidsonCounty(Tenn.Crim.App.filedApril3,1997,atNashville). OnFebruary5,1996,whiletheappealonthedenialofthethirdpetitionwaspending,appellantfileda MotionforDelayedAppealfromthedenialofhissecondpostconvictionreliefpetition.OnMarch27,1996,thetrialcourtdeniedthemotion.Itisfromthisdenialthattheappellantbringsthisappeal.@ II  Firstly,wenotethatthesolebasisallegedintheMotionforDelayedAppealisthefailureofthetrialcourttoappointlegalcounselupondismissingthesecondpetition.Thefactthatappellantdidnothaveanattorneydoesnotexcusethefailuretoappeal. Secondly,theMotionforDelayedAppeal,havingbeenfiledinFebruary1996,iscontrolledbythePostConvictionProcedureActof1995.SeeTenn.CodeAnn.4030201(Supp.1996),CompilersNotes.Adelayedappealunderthesestatutesisavailableonlyfromthe originalconviction.Tenn.CodeAnn.Ϝ4030213(Supp.1996).Inshort,adelayedappealpursuanttothepostconvictionstatutesisunavailableonanappealfromthedenialofpostconvictionrelief.
