Ԁ Theappellantcontendsthatthetrialcourtshouldhaveinstructedthejurywiththelawregardingthecasualexchangeofdrugs.Generally,thesaleofacontrolledsubstanceinTennesseeisafelony.Tenn.CodeAnn.3917417(1991).However,thesalecanbeamisdemeanorifthecontrolledsubstancewas casuallyexchanged.Tenn.CodeAnn.3917418(1991).Acasualexchangeresultswhenthetransferismadewithoutdesign.Statev.Helton,507S.W.2d117,120(Tenn.1974).Thestatecontendsthatbecausetheevidenceclearlyshowedthattheappellantactedwithadefinitedesign,thechargewasnotwarranted.Atthemotionfornewtrialhearing,thetrialjudgestatedthathefeltthatthefactsofthiscasedidnotsupportsuchacharge. Acriminaldefendanthasaconstitutionalrighttoacorrectandcompletechargeofthelaw.Statev.Teel,793S.W.2d236,249(Tenn.1990).However,tobeentitledtoachargeonalessergradeorclassofthechargedoffense,theremustbesomeevidencetosupportthelesseroffense.Statev.Trusty,919S.W.2d305,311(Tenn.1996). Therecordrevealsthattheappellantflaggeddowntwoundercoverpoliceofficersdrivingthrougharesidentialarea.Theappellantapproachedthedriverandaskedwhatsheneeded.Thepoliceofficertoldtheappellantthatshewanteda$20pieceofcocaine.Theappellantwalkedovertoanothermanandretrievedapieceofrockcocaine.Thepoliceofficerpaidtheappellant$20,tookthecocaine,andleft.Theappellantwasthenarrested. Wefindthatthetrialcourtwascorrectindisallowingthechargeoncasualexchange.Nothingpresentedattrialindicatesthattheappellantpossessedanyothermotiveforthetransferexceptpecuniarygain.See,Statev.Prince,713S.W.2d914(Tenn.Crim.App.1986).Theevidenceclearlyillustratesthathewasactingwithaclear,definitedesign.Therefore,thefactsdidnotsupportachargeconcerningthecasualexchangeofcocaine.Thisissueiswithoutmerit. Theappellantnextcontendsthatheisentitledtoanewsentencinghearingbecausethetrialjudgefailedtoarticulateontherecordhisreasonsfortheappellantstenyearsentence.Wedisagree. Wefirstnotethatadiscrepancyexistsbetweenthejudgmentsheetandthesentencinghearingtranscript.ThejudgmentsheetindicatesthattheappellantwasconvictedofaClassCfelonyasaRangeIII,persistentoffender.ThesentencingrangeforaRangeIII,persistentoffenderconvictedofaClassCfelonyisnotlessthantenyearsnormorethanfifteenyears.Tenn.CodeAnn.4035112(c)(3)(1990).Theappellantwassentencedto10yearsincarceration,thepresumptiveminimumwithinRangeIII.However,thesentencingtranscriptstatesthattheappellantwasaRangeII,multipleoffender.Uponreviewofthissituation,wefeelthatthetrialjudgeandtheattorneysforbothsidesmisstatedtheappellantsclassification.ItisclearthattheprosecutorprovedtherequisitefelonyconvictionstoclassifytheappellantasaRangeIII,persistentoffender.Thedefenseattorneystipulatedtotheseconvictions.Furthermore,thedefenseattorneyaskedthejudge toconsiderimposingtheminimumamountoftimeinthiscase,whichwouldbetenyearsat45percent.ThisrequestobviouslyreferstotheminimumsentenceforaClassCfelonycommittedbyaRangeIII,persistentoffender.Tenn.CodeAnn.4035112(c)(3)(1990).Therefore,wefindthejudgmentsheetclassifyingtheappellantasaRangeIII,persistentoffendertobecorrect. Wefindthatthetrialjudgesdeterminationtosentencetheappellanttothepresumptiveminimumoftenyearsatfortyfivepercenttobeappropriate.Thisissueiswithoutmerit.
