In1982,thepetitionerwasindictedforfirstdegreemurder,assaultwiththeintenttocommitanotherfirstdegreemurder,andtheuseofafirearminthecommissionofafelony.Thepetitionerwasconvictedofallthreecounts.HisconvictionswereupheldbythisCourtinStatev.RobertMoore,No.84160III(Tenn.Crim.App.,atNashville,Feb.15,1985),perm.toapp.denied,(Tenn.Apr.29,1985).Subsequently,thisCourtupheldthedenialofthepetitionersfirstpostconvictionpetitioninRobertS.Moorev.State,No.87174III(Tenn.Crim.App.,atNashville,Aug.10,1988),perm.toapp.denied,(Tenn.Dec.5,1988).ThedismissalofthepetitionerssecondpostconvictionpetitionwasupheldinRobertS.Moorev.State,No.01C019001CC00017(Tenn.Crim.App.,atNashville,May16,1990),perm.toapp.denied,(Tenn.July30,1990).  Inhismotiontovacate,thepetitionerarguedthatthetrialcourtshoulddismisstheindictmentandvacatehisconvictionforpossessionofafirearminthecommissionofafelonyonthegroundsthattheoffensewasnotpresentedintheindictmentundertheapplicablestatute,hisconvictionforpossessionofafirearmviolateddoublejeopardy,thatpossessionofafirearmdoesnotconstituteaseparateoffense,andthatheshouldnothavereceivedconsecutivesentences.Onappeal,thepetitioneralsocontendsthatthetrialjudgehadtheauthoritytoreopenthecaseunderthe1995PostConvictionAct.Healsoarguesthatthejudgeshouldhaverecusedhimselfinthismatterbecausehewastheoriginaltrialjudge.  Indenyingrelief,thetrialjudgeenteredanorderstating [t]hisCourthasnoauthoritytoreopenthiscase,andthereforethepetitionmustbeandishere[sic]bydismissed.  Initially,wenotethatthereisnostatutoryprovisionforthefilingofamotiontovacateajudgmentthatisovertenyearsold.Generally,atrialcourtiswithoutauthoritytovacateoramendajudgmentonceithasbecomefinalasinthiscase.SeeStatev.Lock,839S.W.2d436,440(Tenn.Crim.App.1992).Ifthemotiontovacatewasconsideredasapetitionforpostconvictionrelief,itwouldbeoutsidethestatuteoflimitations.T.C.A.4030202;seealso,Carterv.State,952S.W.2d417(Tenn.1997).Moreover,ifthemotionwastreatedasamotiontoreopenthepetitionerspostconvictionpetition,noneofthepetitionersclaimsmeetthecriteriaforgrantingsuchreliefassetforthinT.C.A.4030217(a).
