Ðthem€during€the€struggle,€but€he€did€not€think€it€caused€any€damage.€€Ailey€reported€that€theÐ $X" ÐDefendant€had€the€bow€pulled€back€ð ðat€least€seventy„five€percent.ðð€€He€stated€that€the€Defendant€didÐ ô$D # Ðnot€say€anything€or€make€any€threats€while€he€was€holding€the€bow.€€Ailey€testified,€ð ðI€guess€he€wasÐ à%0!$ Ðsurprised€to€see€me.ðð€€Ailey€stated€that€the€Defendant€had€the€bow€pointed€at€him€for€three€or€fourÐ Ì&"% Ðseconds€before€Ailey€kicked€it€out€of€his€hands.€€He€recalled€that€after€subduing€the€Defendant,€AileyÐ ¸'#& Ðasked€him€ð ðwhat€he€thought€he€was€doing,ðð€but€the€Defendant€did€not€respond.€€Ailey€was€not€sureÐ ¤(ô#' Ðif€the€Defendant€knew€that€his€cousin€was€in€custody.Ð )à$( Ðâ âÐ |*Ì%) Ðà  àAiley€testified€that€someone€other€than€the€Defendant€made€the€911€call.€€He€believed€thatÐ ° Ðâ âthe€card€game€was€in€a€third€partyððs€trailer€and€that€third€party€actually€made€the€call.€€Ailey€testifiedÐ œì Ðthat€the€Defendant€was€moderately€intoxicated€when€he€arrived€at€the€scene.€€Ailey€recalled€that€theÐ ˆØ ÐDefendant€had€ð ðslurred€speech,ðð€was€ð ðunsteady€on€his€feet,ðð€and€was€ð ðsort€of€weaving.ðð€€AccordingÐ tÄ Ðto€Ailey,€the€Defendant€said€that€he€was€angry€at€his€cousin.€€Ailey€testified€that€he€unloaded€the€gunÐ `° Ðin€the€Defendantððs€presence.€€Ð L œ ÐÌà  àThe€Defendant€testified€that€he€lives€at€627€Reservoir€Road€in€Blount€County€with€hisÐ $ t Ðgirlfriend€of€five€months,€Valerie€Johnson.€€He€stated€that€his€mother,€Katie€Franklin,€lives€nextÐ  ` Ðdoor.€€The€Defendant€testified€that€at€the€time€of€the€sentencing€hearing,€he€was€taking€five€differentÐ ü L  Ðkinds€of€medication€in€accordance€with€doctorððs€orders.€€He€reported€that€the€medications€were€firstÐ è 8  Ðprescribed€approximately€three€months€earlier.€€The€Defendant€testified€that€he€receives€a€monthlyÐ Ô$  ÐSocial€Security€disability€check€based€on€his€bipolar€disorder.€€He€stated€that€his€mother€is€theÐ À  Ðguardian€of€his€Social€Security€checks.Ð ¬ü  ÐÌà  àThe€Defendant€acknowledged€that€he€had€been€charged€with€several€misdemeanor€offensesÐ „Ô  Ðrelating€to€alcohol€in€the€1980's€and€continuing€until€1994.€€The€Defendant€testified€thatÐ pÀ Ðapproximately€one€or€two€weeks€after€the€events€in€this€case,€he€called€the€ð ðCrisis€Unit.ðð€€He€statedÐ \¬ Ðthat€he€was€then€admitted€to€Peninsula€Hospital,€where€he€stayed€for€seven€days€until€he€wasÐ H˜ Ðevaluated.€€The€Defendant€testified€that€he€was€diagnosed€with€a€bipolar€disorder.€€Ð 4„ ÐÌà  àThe€Defendant€testified€that€at€the€time€of€the€hearing,€he€had€not€committed€any€offensesÐ  \ Ðsince€those€that€are€the€subject€of€this€case.€€He€also€testified€that€he€no€longer€had€any€weapons€inÐ øH Ðhis€home.€€The€Defendant€stated€that€he€quit€drinking€but€admitted€drinking€a€beer€ð ðon€occasion.ðð€Ð ä4 ÐHe€reported€that€prior€to€December€2000,€he€typically€drank€one€or€two€ð ðfifthsðð€of€liquor€a€week.€Ð Ð  ÐHowever,€he€claimed€that€since€that€date,€he€had€drunk€a€total€of€ð ðmaybe€three€beersðð€and€no€liquor.€Ð ¼  ÐThe€Defendant€also€submitted€to€a€drug€screen€on€May€22,€2001,€which€yielded€negative€results.Ð ¨ø Ѐ€Ð ”ä Ðà  àThe€Defendant€stated€that€before€this€incident,€he€was€ð ðbasically€.€.€.€killing€[himself]€.€.€.Ð €Ð Ð[w]ith€the€drinking.ðð€€He€explained,€that€ð ð[a]ll€[he]€wanted€to€do€before€was€die.ðð€€However,€theÐ l¼ ÐDefendant€testified€that€he€now€has€a€better€outlook€on€life.€€He€stated€that€now€when€he€feelsÐ X ¨ Ðdepressed,€he€ð ðfind[s]€something€to€do€in€the€yard,€or€.€.€.€play[s]€a€video€game€.€.€.€[or]€lift[s]Ð D!” Ðweights.ðð€€The€Defendant€admitted€that€he€still€has€the€urge€to€drink,€but€he€refrains€from€doing€so.€Ð 0"€  ÐÌà  àRegarding€the€events€in€this€case,€the€Defendant€testified€that€he€was€in€a€friendððs€trailerÐ $X" Ðlistening€to€music,€when€ð ðfor€no€reason€at€all€[his]€cousin€just€jumps€up€out€of€his€seat€and€starts€aÐ ô$D # Ðfight€with€[the€Defendant].ðð€€The€Defendant€testified€that€he€punched€his€cousin€in€the€face,€and€hisÐ à%0!$ Ðcousin€punched€him€in€the€face.€€He€stated,€ð ðNext€thing€I€know€a€knifeððs€drawn.ðð€€The€DefendantÐ Ì&"% Ðtestified€that€his€friend€was€able€to€convince€his€cousin,€Ron,€to€leave,€and€then€the€Defendant€calledÐ ¸'#& Ðthe€police.€€The€Defendant€stated€that€he€waited€at€his€friendððs€trailer€for€the€police€to€arrive.Ð ¤(ô#' ÐÌà  àThe€Defendant€admitted€that€he€had€drunk€approximately€a€fifth€of€liquor€plus€several€beersÐ |*Ì%) Ðon€the€day€of€the€crimes€in€this€case.€€He€stated,€ð ðThe€only€thing€I€remember€is€being€at€home€andÐ h+¸&* Ðnext€thing€I€know€thereððs€three€or€four€officers€standing€in€my€living€room€with€guns€drawed.ðð€€TheÐ ° ÐDefendant€claimed€that€he€did€not€know€what€happened€with€regard€to€the€bow€and€the€officers,€butÐ œì Ðhe€ð ðbelieve[d]€he€was€startled.ðð€€He€stated,€ð ðI€remember€attempting€to€put€the€bow€up€and€next€thingÐ ˆØ ÐI€know€thereððs€officers€with€guns€drawed.ðð€€The€Defendant€claimed€that€he€did€not€rememberÐ tÄ Ðspeaking€to€the€officers€before€they€had€their€guns€drawn.€€He€admitted€being€angry€with€his€cousin,Ð `° Ðbut€he€claimed€that€he€did€not€intend€to€harm€any€officers.€€The€Defendant€testified€that€the€gun€thatÐ L œ ÐOfficer€Ailey€found€was€not€loaded.€€The€Defendant€stated€that€he€had€the€shells€in€his€pocket.€Ð 8 ˆ ÐÌà  àThe€Defendant€testified€that€his€mother€provides€him€with€transportation€and€that€his€brother,Ð  ` ÐDewayne,€sometime€helps.€€The€Defendant€stated€that€he€sees€his€brother€ð ðmaybe€once€a€week.ðð€€TheÐ ü L  ÐDefendant€testified€that€his€medication€has€ð ðleveled€[him]€out.ðð€€He€stated€that€his€mother,€who€isÐ è 8  Ðfifty„four€years€old,€insures€that€he€takes€his€medication€regularly.€€The€Defendant€testified€that€heÐ Ô$  Ðis€not€a€ð ðmean€person,ðð€but€that€he€just€made€a€mistake.€€Ð À  ÐÌà  àOn€cross„examination,€the€Defendant€testified€that€he€remembered€ð ðhavingðð€the€bow€whenÐ ˜è  Ðthe€officers€entered€the€trailer,€but€he€stated€that€he€did€not€remember€drawing€the€bow.€€He€alsoÐ „Ô  Ðtestified€that€he€did€not€remember€loading€the€gun€or€Officer€Ailey€unloading€it.€€The€DefendantÐ pÀ Ðclaimed€that€he€did€not€remember€saying€that€he€wanted€to€kill€his€cousin,€although€he€stated€that€heÐ \¬ Ðremembered€being€angry€at€his€cousin.€When€asked€if€he€intended€to€kill€his€cousin,€the€DefendantÐ H˜ Ðreplied,€ð ðMay€be.ðð€€The€Defendant€testified€that€although€he€ordinarily€stored€his€bow€in€a€ð ðcustomÐ 4„ Ðcontainerðð€in€his€bedroom,€the€bow€was€out€of€its€container€because€he€had€been€shooting€at€targetsÐ  p Ðin€his€yard€earlier€that€day.€€The€Defendant€recalled€that€on€the€day€of€the€offense,€he€was€not€onÐ  \ Ðmedication,€but€admitted€that€he€had€consumed€ð ðwhiskey€and€beer.ðð€€Ð øH ÐÌà  àThe€Defendant€acknowledged€that€he€was€convicted€in€1998€of€assault,€for€which€he€receivedÐ Ð  Ðprobation.€€He€stated€that€he€attended€a€class€on€managing€emotions€as€part€of€his€probation.€€InÐ ¼  Ðaddition,€the€Defendant€admitted€that€he€assaulted€his€wife€on€another€occasion,€but€he€reported€thatÐ ¨ø Ðhe€believed€that€the€case€had€been€dismissed.€€He€testified€that€he€was€convicted€in€1994€for€recklessÐ ”ä Ðendangerment€because€he€was€driving€ð ðtoo€fastðð€on€his€motorcycle.€€Ð €Ð ÐÌà  àThe€Defendant€testified€that€he€had€received€disability€payments€for€ten€years€based€on€hisÐ X ¨ Ðbipolar€disorder.€€He€reported€seeing€two€doctors€since€he€began€receiving€disability€payments.€€HeÐ D!” Ðstated€that€the€first€physician€who€treated€him€passed€away€and€that€he€subsequently€had€trouble€withÐ 0"€  Ðhis€insurance€and€finding€a€new€doctor.€€He€testified€that€over€a€year€elapsed€before€he€found€aÐ #l! Ðsecond€doctor,€whom€he€had€last€visited€approximately€a€month€or€two€prior€to€the€sentencingÐ $X" Ðhearing.€€On€redirect€examination,€a€letter€from€Peninsula€Outpatient€Centers€was€entered€intoÐ ô$D # Ðevidence€showing€that€the€Defendant€was€a€current€patient.€€Ð à%0!$ ÐÌà  àThe€State€read€into€evidence€portions€of€the€probation€report,€in€which€the€DefendantÐ ¸'#& Ðreportedly€told€his€probation€officer€that€while€in€the€back€of€the€police€cruiser,€he€had€asked€whyÐ ¤(ô#' Ðhe€had€been€arrested.€€According€to€the€State,€he€was€told€to€ð ðshut€upðð€or€someone€would€ð ðshut€[him]Ð )à$( Ðâ âup.ðð€€In€the€report,€the€Defendant€stated€that€he€woke€up€in€jail€with€his€mouth€and€lips€ð ðbusted€soÐ |*Ì%) Ðbad€[he]€couldnððt€eat.ðð€€However,€at€the€hearing,€the€Defendant€admitted€that€he€was€not€suggestingÐ ° Ðthat€the€officers€hurt€him.€€Ð œì Ðâ âÌà  àThe€Defendantððs€mother,€Katie€Rose€Franklin,€testified€that€she€had€lived€next€door€to€herÐ tÄ Ðson€for€eleven€years€and€that€she€sees€him€every€day.€€Franklin€testified€that€after€the€offenses€in€thisÐ `° Ðcase,€the€Defendant€sought€treatment.€€She€stated€he€entered€Peninsula€Hospital€and€was€placed€onÐ L œ Ðmedication€ð ðwhich€controls€his€temper.ðð€€Franklin€explained€that€the€Defendant€ð ðhad€a€very€violentÐ 8 ˆ Ðtemper.ðð€€She€testified€that€since€being€treated,€the€Defendant€had€been€making€progress.€€FranklinÐ $ t Ðtestified€that€she€insures€that€the€Defendant€takes€his€medication€by€giving€it€to€him€herself.€€SheÐ  ` Ðtestified€that€she€walks€to€the€Defendantððs€home€every€morning€and€every€evening€to€make€sure€thatÐ ü L  Ðthe€Defendant€takes€his€medication.€€€Ð è 8  ÐÌà  àFranklin€stated€that€she€knew€that€the€Defendant€drank€too€much€in€the€past,€but€sheÐ À  Ðmaintained€that€she€had€not€seen€him€drink€since€he€began€treatment.€€Although€Franklin€testifiedÐ ¬ü  Ðthat€the€Defendant€had€not€had€any€alcohol€in€a€year,€she€admitted€on€cross„examination€that€heÐ ˜è  Ðwould€not€tell€her€if€he€did€drink.€€She€testified€that€the€Defendant€would€try€to€hide€his€drinking.€Ð „Ô  ÐÌà  àFranklin€testified€that€she€is€the€payee€for€the€Defendantððs€Social€Security€disability€checks.€Ð \¬ ÐFranklin€explained€that€the€Defendant€overdosed€in€Knoxville,€Tennessee,€and€the€Social€SecurityÐ H˜ Ðboard€ð ðhad€to€have€somebody€to€be€over€his€check.ðð€€She€stated€that€although€her€name€is€on€theÐ 4„ Ðchecks,€the€checks€are€deposited€into€the€Defendantððs€account.€€She€also€testified€that€she€pays€theÐ  p ÐDefendantððs€rent,€makes€sure€his€utilities€are€paid,€and€buys€his€clothing.Ð  \ ÐÌà@’’$ìàII.€ANALYSISˆÐ ä4 ÐÌà  àThe€Defendant€now€challenges€on€appeal€the€trial€courtððs€order€that€he€serve€his€entire€four„Ð ¼  Ðyear€sentence€in€the€Tennessee€Department€of€Correction.€€Ô‡X!XXX!ÔWhen€a€criminal€defendant€challengesÐ ¨ø Ðthe€length,€range,€or€manner€of€service€of€a€sentence,€the€reviewing€court€must€conduct€a€òòdeóó€òònovoóóÐ ”ä Ðreview€of€the€sentence€with€a€presumption€that€the€determinations€made€by€the€trial€court€are€correct.€Ð €Ð ÐòòóóTenn.€Code€Ann.€ðð€40„35„401(d).€€This€presumption,€however,€ð ðis€conditioned€upon€the€affirmativeÐ l¼ Ðshowing€in€the€record€that€the€trial€court€considered€the€sentencing€principles€and€all€relevant€factsÐ X ¨ Ðand€circumstances.ðð€€òòState€v.€Ashbyóó,€823€S.W.2d€166,€169€(Tenn.€1991).€€In€the€event€that€the€recordÐ D!” Ðfails€to€show€such€consideration,€the€review€of€the€sentence€is€purely€òòdeóó€òònovoóó.€€òòState€v.€Sheltonóó,€854Ð 0"€  ÐS.W.2d€116,€123€(Tenn.€Crim.€App.€1992).Ð #l! Ða€conscious€decision€not€to€let€go€of€the€bowstring.€€But€this€is€an€unusual€case€in€that€regard.ðð€€TheÐ à%0!$ ÐDefendant€argued€that€the€trial€court€should€not€have€considered€the€high€risk€to€human€life€becauseÐ Ì&"% Ðits€consideration€of€this€factor€was€equivalent€to€enhancing€the€Defendantððs€sentence€based€on€anÐ ¸'#& Ðelement€of€the€offense.€€However,€the€information€which€charged€the€Defendant€with€aggravatedÐ ¤(ô#' Ðassault€alleged€that€the€Defendant€caused€the€victim€to€reasonably€fear€imminent€bodily€injury€byÐ )à$( Ðâ âusing€or€displaying€a€weapon.€€The€trial€court€correctly€concluded€that€a€high€risk€to€human€life€isÐ |*Ì%) Ðnot€an€element€of€the€charged€offense.€€Therefore,€the€fact€that€the€Defendant€created€a€high€risk€toÐ ° Ðhuman€life€was€a€proper€sentencing€consideration€for€the€trial€court.Ð œì Ðâ âÌÔ‡X!XXX!Ôà  àIn€our€view,€the€record€supports€the€manner€of€service€of€the€sentence€imposed.€€TheÐ tÄ ÐDefendant€aimed€a€loaded€weapon€at€a€police€officer,€punched€another€police€officer,€and€claimedÐ `° Ðthat€he€did€not€remember€anything€because€he€had€been€drinking.€€The€Defendant€has€a€long€historyÐ L œ Ðof€criminal€conduct€involving€alcohol,€and€he€admitted€at€the€sentencing€hearing€that€he€continuesÐ 8 ˆ Ðto€drink€on€occasion.€€For€these€reasons,€we€conclude€that€the€presumption€of€alternative€sentencingÐ $ t Ðwas€sufficiently€rebutted€in€this€case€and€that€the€trial€court€thus€did€not€err€by€imposing€a€sentenceÐ  ` Ðof€confinement.€€òòÔ#†X!XXX!%|#ÔÔ‡X!XXX!ÔóóÐ ü L  ÐÌà  àAccordingly,€we€AFFIRM€the€judgments€of€the€trial€court.Ô#†X!XXX!G#ÔÐ Ô$  ÐÌÌÌÌà  àà ` àà ¸ àà  àà h àà À àà  à___________________________________€Ð pÀ Ðà  àà ` àà ¸ àà  àà h àà À àà  àROBERT€W.€WEDEMEYER,€JUDGE
