TheproofatthepostconvictionhearingestablishedthatappellantstrialcounselwasatenyearveteranofthepublicdefendersofficeinShelbyCounty.Atthehearing,theappellant'strialcounseltestifiedthatheandpreviouscounselmetwiththeappellantonatleastfourorfiveoccasions.Trialcounselstatedthattheinvestigatorwiththepublicdefendersofficetookthestatementsofalltestifyingwitnessesandthevictiminthiscase.Aftertalkingwiththeappellantsmother,counseldecidednottocallherasawitnessbecausehertestimonycontradictedthatoftheappellants.TherecordindicatesthatcounselscrossexaminationofStateswitness,Hooker,wasmorethanadequate.Counselstatedthathewasunawareofthepossibilityofthetwopotentialdefensewitnessesuntilafterthewitnesseshadbeensittinginthecourtroomandafterhearingtheproof.Moreover,counselstatedthattheappellantmaintainedhisinnocenceandwantedtoproceedtotrial.  Indenyingrelief,thepostconvictioncourtaccreditedthetestimonyoftheappellantstrialcounselandconcludedthattheappellanthadnotmethisburdenofprovingthathehadbeendeprivedoftheeffectiveassistanceofcounsel.Toprovethathewasdeniedtheeffectiveassistanceofcounsel,theappellantmustshow,byapreponderanceoftheevidence,Taylorv.State,875S.W.2d684,686(Tenn.Crim.App.1993),perm.toappealdenied,(Tenn.1994),first,thatcounsel'srepresentationfellbelowtherangeofcompetencedemandedofattorneysincriminalcases,Baxterv.Rose,523S.W.2d930,936(Tenn.1975),and,second,that,butfortheseerrors,theresultoftheproceedingwouldhavebeendifferent.Stricklandv.Washington,466U.S.668,694,104S.Ct.2052,2068(1984);Statev.Melson,772S.W.2d417,419n.2(Tenn.),cert.denied,493U.S.874,110S.Ct.211(1989).Onpostconvictionreview,thereisastrongpresumptionofsatisfactoryrepresentation,Barrv.State,910S.W.2d462,464(Tenn.Crim.App.1995).
